COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN, there has been presented to the
Town Board of the Town of Southold, Suffolk County, New York, on the 26th day of September,
2017 a Local Law entitled "A Local Law to Amend the Town of Southold Water Supply
Plan Map to a Portion of Griffing Street, Cutcho2ue, New York, SCTM# 1000-102.00-
05.00-009.004, and
NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will
hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road,
Southold, New York, on the 21st day of November, 2017 at 4:31 p.m. at which time all
interested persons will be given an opportunity to be heard.
The proposed Local Law entitled, "A Local Law to Amend the Town of Southold Water
Supply Plan Map to Griffing Street, Cutcho2ue, New York" SCTM# 1000-102.00-05.00-
009.004 reads as follows:
LOCAL LAW NO. 2017
A Local Law entitled, "A Local Law to Amend the Town of Southold Water Supply Plan
Map to a Portion of Griffing Street, Cutcho2ue, New York".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent.
This Local Law proposes to amend the Town of Southold Water Supply Plan Map to
include the extension of a waterline to 260 Griffing Street, Cutchogue, SCTM #1000-102-5-9.4.
Historically, the Water Supply Plan Map reflects the physical changes in the water supply
network since 2000. The property owner, William J. Baxter, Jr., has represented to the Town

that he wishes to include accessory apartments in the standard subdivision. In order for the
Suffolk County Board of Health to allow this all lots in the subdivision must be serviced by
public water. The extension of the transmission main is intended to supply the Baxter
subdivision and is not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services to provide safe drinking water to the Baxter subdivision, and
upon our consideration of the recommendations of the Town Planning Department, and the
public comments taken at the public hearing, we hereby amend the Town of Southold Water
Supply Plan Map to include the extension of a water line to 280 Griffing Street, Cutchogue.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Resolution No. 2017-403, is hereby amended
to reflect the extension of a water line to the Baxter subdivision, Cutchogue.
Section 4. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 5. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
I have here an affidavit that this has been published in the Suffolk Times and posted on the Town
Clerk's bulletin board, the town website and in the Town Clerk's Office. That's it.

ABIGAIL WICKHAM: Good evening, Abigail Wickham, representing the applicant William
Baxter, my office is in Mattituck. Thank you for considering this request. It is merely a short
extension of the public water main into a hamlet business district. The proposed office and retail
uses in the commercial district of this subdivision have already been approved by the Health
Department for well water and can be accommodated with well water but the extension of the
water main will provide not only a more reliable and presumably safer water supply but most
importantly will enable the inclusion of accessory apartments within the buildings to be
constructed here. So we would ask that you approve this. Thank you.

A Local Law entitled, "A Local Law to Amend the Town of Southold Water Supply Plan
Map to a Portion of Griffins Street, Cutchogue, New York".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent.
This Local Law proposes to amend the Town of Southold Water Supply Plan Map to
include the extension of a waterline to 260 Griffing Street, Cutchogue, SCTM#1000-102-5-9.4.
Historically, the Water Supply Plan Map reflects the physical changes in the water supply
network since 2000. The property owner, William J. Baxter, Jr., has represented to the Town
that he wishes to include accessory apartments in the standard subdivision. In order for,the
Suffolk County Board of Health to allow this all lots in the subdivision must be serviced by
public water. The extension of the transmission main is intended to supply the Baxter
subdivision and is not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services to provide safe drinking water to the Baxter subdivision, and
upon our consideration of the recommendations of the Town Planning Department, and the
public comments taken at the public hearing, we hereby amend the Town of Southold Water
Supply Plan Map to include the extension of a water line to 280 Griffing Street, Cutchogue.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Resolution No. 2017-403, is hereby amended
to reflect the extension of a water line to the Baxter subdivision, Cutchogue.
Section 4. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 5. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

This Local Law proposes to amend the Town of Southold Water Supply Plan Map to
include the extension of a waterline to 260 Griffing Street, Cutchogue, SCTM#1000-102-5-9.4.
Historically, the Water Supply Plan Map reflects the physical changes in the water supply
network since 2000. The property owner, William J. Baxter, Jr., has represented to the Town
that he wishes to include accessory apartments in the standard subdivision. In order for the
Suffolk County Board of Health to allow this all lots in the subdivision must be serviced by
public water. The extension of the transmission main is intended to supply the Baxter
subdivision and is not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services to provide safe drinking water to the Baxter subdivision, and
upon our consideration of the recommendations of the Town Planning Department, and the
public comments taken at the public hearing, we hereby amend the Town of Southold Water
Supply Plan Map to include the extension of a water line to 280 Griffing Street, Cutchogue.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Resolution No. 2017-403, is hereby amended
to reflect the extension of a water line to the Baxter subdivision, Cutchogue.
Section 4. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
Section 5. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

The Planning Board has reviewed the above referenced legislation and provides the
following comments.
1. The Planning Board supports the proposal to amend the Town of Southold Water
Supply Plan Map to include the extension of a waterline to 260 Griffing Street.
Public water will enhance future development possibilities on this Hamlet
Business-Zoned parcel to potentially include accessory apartments, a much-
needed resource in Southold Town. -
2. This parcel is located adjacent to the Heritage at Cutchogue, which required an
extension of the water transmission main. The close proximity of the Heritage to
the subject parcel will facilitate implementation of the water transmission main
extension, as little infrastructure will be needed to provide this increase in
connectivity. This extension would also enable additional water connections in
surrounding residential areas and poses minimal impacts to the surrounding
area.

3. The project is located within the Hamlet Business Zoning District and the Hamlet
Center. Many businesses and residences in the surrounding area already
possess water connections (Figure 1). If the water main were extended, some of
the surrounding residential and hamlet businesses uses without public water
currently would be given the opportunity to connect to public water. This would
particularly benefit the Hamlet Business Zoning District, as the extension would
provide increases in water availability for Cutchogue's downtown.

Your notification for SEQR Coordination was received and reviewed by our agency.
Please be advised that our agency,the Suffolk County Water Authority,has no objection to
the Town of Southold's Planning Board assuming Lead Agency status for the project captioned
above, however SCWA would like to provide the following comments.
The EAF prepared by the applicant indicates that the initial anticipated water demand data is
based on the project using private wells.And that"when SCWA public water is available,which
is expected prior to final approval,water usage/demand will be double."
Anticipated water usage patterns and demand should not be any different based upon where
the supply of the water comes from,private well verses public supply. However, if the applicant
at a later date should connect his project to public water after individual wells have been
installed, SCWA strongly recommends that the private wells be maintained for strictly irrigation
purposes, which would alleviate some of the demand in this area.
Additionally,you had indicated in an email to staff,that the applicant anticipates connecting
to public water once "the public water line is ran past their property to the Heritage of Cutchogue
property."
The Heritage project developer through SCWA and at their own expense,will be extending
the water main from Bridle Lane, which is on the north end of the Heritage property in addition
to extending the water main from Schoolhouse Road,in order to serve their project. There is no
water main being installed on Griffing Street as part of the Heritage project.

The applicant is encouraged to contact SCWA's New Service Department if they have not
already done so to discuss their options of connecting to public water. They may be reached by
calling 631-218-1148.
I also encourage that representatives of the Town of Southold schedule a meeting with
SCWA_staff to discuss the cumulative impacts that the recently submitted projects and
anticipated future projects may have on SCWA's supply in this area and SCWA's ability to meet
peak demand.
