HomeMy WebLinkAboutMeskouris, Chris Page 1 of 1 Standish, Lauren From: Robert Herrmann [rherrmann@enconsultants.com] Sent: Tuesday, November 09, 2010 5:16 PM To: Bob Ghosio; David Bergen, Bredemeyer,-John; Jill Doherty - Forward Cc: Notaro, Frank; Standish, Lauren; Hulse, Lori Subject: Meskouris topo Attachments: Meskouris 1'-topo.pdf hi all, please find attached the updated survey by peconic surveyors, which has been revised to depict the beach (as defined by chapter 275); the edge of beach grass (which represents the landward limit of the beach); and topographic elevations in one-foot contours. unfortunately, the topographical data does not reveal any demonstrative dune formation with two sloping sides and a definable crest and toe. it does reveal that the steepest slope and most identifiable dune-like formation occurs adjacent to the landward edge of beach,where the land distinctly rises in elevation between 2 and 3 feet (from below elevation T to elevation 9')over a distance of 15 feet or so. the land then drops less than a foot below 9 feet until it rises back to 9 feet about 25 to 30 feet farther landward. (i suspect that these two outer borders of this first 9-foot contour represent the 2 places dave and i were standing on the day of our field inspection, although the more landward of the two is elevated no more than 12 inches higher than its surrounding grade for at least 30 feet in either direction). the land elevates again from 9'to 10' (1 Vto the west), where it then remains relatively flat until it gradually slopes back down toward the road over a distance of 100 feet or so. due to the undulating topography and gradual change(s) in elevation, it is difficult to determine what if anything might be considered a dune on this property landward of the first formation described above, and unfortunately there is virtually no language in chapter 275 to help make such a determination. therefore, it is my opinion that the trustees should derive their jurisdiction from the one readily identifiable dune formation that occurs just landward of the beach, as described above. the crest of this formation would be the seaward border of the 9' contour, which would extend the board's 1 00'jurisdiction to a location virtually identical to the landward border of the coastal erosion hazard area boundary line. i will be at next week's hearing, but it would of course be helpful to know what direction the board plans to take beforehand in case we could provide information prior to the hearing that would save us from extending the process an additional month. best regards, Robert E. It has 50 feet of frontage on Sound Beach Drive, 328.02 feet along the westerly property line, 50.31 feet on Long Island Sound and 333.56 along the easterly property line. BASIS OF APPLICATION: Request for Variance from Code Section 280-124, based on an application for building permit to construct new single-family dwelling, and the Building Inspector's September 3,2009, Updated February 4, 2010 Notice of Disapproval concerning proposed new single family dwelling, exceeding maximum lot coverage of 200/o(buildable area). RELIEF REQUESTED: The applicant proposes to construct a new two story dwelling on pilings, which proposed plans require 29% coverage of the buildable lot area. The applicant requests a 9% variance to the Code required 20%maximum lot coverage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 20,2010,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Town Law 4267-b(3)(b)(1). Granting of the requested variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area is almost built out and many homes have excessive lot coverage.The style of the proposed dwelling is similar to that which exists in the neighborhood. The side yard,front yard and rear yard setbacks are in conformance with the Code. 2. Town Law 4267-b(3)(b)(2)._The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could design a smaller proposed dwelling requiring a lesser lot coverage variance or no variance at all. 3. Town Law 4267-b(3)(b)(3). The variance requested herein is mathematically substantial requiring a 45% variance from the Code. The substantiality of the requested variance may be mitigated when considering that the Coastal Erosion Hazard Line may in some cases be more arbitrary in its exact demarcation on a particular parcel, consequently creating a detriment to the applicant by lessening that parcels calculated buildable lot area under the Code. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created insofar as the applicant chooses to construct a house that is larger than what is permissible by Town code. 6.Town Law 4267-b. Granting of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the construction of a proposed new dwelling while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried,to GRANT, the variance as applied for, and shown on the Survey of SCTM# 1000-99-01-12.1 prepared by John T. Metzger, L.S. dated August 27, 2009, and Architectural Drawings prepared by Frank Notaro, R.A., Titled Meskouris Residence, Sheets A-0,A-1 and A-4 all dated 1/28/10. SUFFOLK COUNTY ADKMSTRATpE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 2, 2010 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application was referred for-reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. ' BASIS OF APPLICATION: Request for Variance from Code Section 280-124, based on an application for building permit to construct new single-family dwelling, and the Building Inspector's September 3, 2009, Updated February 4, 2010 Notice of Disapproval concerning proposed new single family dwelling, exceeding maximum lot coverage of 20%(buildable area). RELIEF REQUESTED: The applicant proposes to construct a new two story dwelling oniling s which plans require 29% coverage of the buildable lot area. The applicant requests a 9% variance t he Code required 20%maximum lot coverage. ADDITIONAL INFORMATION: This waterfront parcel is the narrowest of waterfront parcels in the immediate neighborhood. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 20,2010,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law&267-b 3)(b)(1). Granting of the requested variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area is almost built out and many homes have excessive lot coverage. The style of the proposed dwelling is similar to that which exists in the neighborhood. The side yard,front yard and rear yard setbacks are in conformance with the Code. 2. Town Law&267-b(3)(b)(2) The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant could design a smaller proposed dwelling requiring a lesser lot coverage variance or no variance at all. 3. Town Law 4267- )(3)(b)(3). The variance requested herein is mathematically substantial requiring a 45% variance from the Code. The substantiality of the requested variance may be mitigated when considering that the Coastal Erosion Hazard Line may in some cases be more arbitrary in its exact demarcation on aparticular parcel, consequently creating a detriment to the applicant by lessening that parcels calculated buildable lot area under the Code. 4. Town Law 4267= )(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law &267-b(3)(b)(5) The difficulty has been self-created insofar as the applicant chooses to construct a house that is larger than what is permissible by Town code. 6.Town Law&267-b Granting of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the construction of a proposed nety and welfare of ew dwelling while preserving and protecting the character of the neighborhood and the health; safthe community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, in duly carried, to otion was offered by Member Schneider, seconded by Member Goehringer, and GRANT, the variance as applied for, and shown on the Survey of SCTM# 1000-99-01-12.1 prepared by John T. Metzger, L.S. dated August 27, 2009, and Architectural Drawings prepared by Frank Notaro, R.A., Titled Meskouris Residence, Sheets A-0, A-1 and A-4 all dated 1/28/10. Subject to the following conditions: 1. Applicant to follow all recommendations of LWRP. 2. Leaders, gutters and drywells shall be installed to control all storm water runoff from all impervious surfaces. 3. Covenants and Restrictions shall be required per LWRP recommendations for a perpetual preservation of all natural vegetation seaward of the Coastal Erosion Hazard Line to the tie line as per the definition in the LWRP memorandum dated March 3,2010. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Upon my inspection of the site plan and the property itself, however, I raised the question of whether the limit of the Board's jurisdiction over the property had been established, and Mr. Meskouris indicated that to his knowledge it had not. The Board's jurisdiction should extend 100 feet landward of the most landward regulated area listed under §275-3(C), which for the subject property would be the landward limit of the "beach." Based on my delineation of the landward limit of the beach, which here is the well defined seaward limit of beach grass that represents the "marked change in material or physiographic form from the line of permanent vegetation," the proposed dwelling is located approximately 120 to 125 feet landward of the beach. As it appears that the proposed construction may thus lie beyond the Board's jurisdiction, I am respectfully requesting on Mr. Meskouris' behalf that the Board meet me at the subject property during its October field inspections to evaluate my finding.
