Resident parking permit. [Amended 5-25-1971; 5-9-1972; 3-25-1975 by L.L. No. 1-1975; 12-28-1984 by L.L. No. 10-1984; 7-14-1987 by L.L. No. 11-1987; 10-18-1994 by L.L. No. 21-1994; 9-26-2017 by L.L. No. 13-20171 (1) A resident parking permit shall be issued by the Town Clerk or a person designated by him to all persons who are qualified residents of the Town of Southold. Persons applying for a resident parking permit shall be requested to sign an application in affidavit form and submit for inspection the following as proof of residence: (a) A valid tax receipt stub for the current year for any taxable real property within the Town of Southold assessed in the name of the applicant. (b) A valid motor vehicle registration in the name of the applicant and to an address located within the Town of Southold or to an address corresponding to the address of a validated tax receipt stub for the current tax year for any taxable real property within the Town of Southold affixed to the application. (c) Such other proof of residence as is satisfactory to the Town Clerk. (2) The Town Clerk or a person designated by the Town Clerk shall inspect such application to determine that the applicant is a qualified resident of the Town. Upon approval of the application, a resident parking permit shall be issued and inscribed with the vehicle license registration number. Such permit shall not be transferred to any other vehicle. (3) Resident parking permit for motor vehicles shall be permanently affixed to the right side of the front bumper of such vehicle and shall be valid for the vehicle and an attached trailer. (4) A resident parking permit shall be valid for two years. The first two-year permit period shall commence January 1, 2018, and terminate on December 31, 2019. Thereafter, a new two-year permit period shall commence on January 1 of every even-numbered year. (5) The fee for the residential parking permit period, or any part thereof, shall be prescribed by resolution of the Southold Town Board. B. Lessee parking permit. (1) A lessee parking permit shall be issued by the Town Clerk or a person designated by him to all persons who lease or rent property within the Town of Southold but do not qualify as residents as defined in § 189-3A hereof. Persons applying for a lessee parking permit shall present an application in affidavit form, signed by the lessee and the owner of the property, setting forth: (a) The location of the leased or rented property. (b) The persons occupying the same. (c) The term of such tenancy. 189:7 11-01-2017 § 189-3 SOUTHOLD CODE § 189-3 (2) Upon a determination by the Town Clerk or person designated by him that the applicant is entitled to a lessee parking permit and upon the payment of the permit fee, such permit shall be issued and inscribed with the vehicle license registration __ r number and shall be affixed to the vehicle in the same manner as provided in § 189-3A(3) hereof. (3) The fee for the issuance of a lessee parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. C. Hotel-motel parking permits. (1) Hotel-motel parking permits shall be issued by the Town Clerk or a person designated by him to the owners or their designated managers of hotels, motels, rooming or boarding houses and trailer parks, for use by the paying guests temporarily residing therein. Persons applying for a hotel-motel parking permit shall present an application to the Town Clerk in affidavit form, signed by the applicant, setting forth: (a) The number of rental units available at the applicant's premises. (b) The number of permits applied for. (c) The designated business name, if any, of the premises applied for. (2) Upon a determination by the Town Clerk or a person designated by him that the applicant is entitled to such permits and upon payment of the required permit fee, permits shall be issued; provided, however, that the number of permits issued shall not exceed the number of rental units available at the premises applied for. Such permits shall be inscribed with the name of the applicant or the designated business name of the applicant's premises and shall be used only by paying guests occupying the premises for which such permits are issued. (3) Hotel-motel parking permits shall be transferable and shall be displayed on the dashboard on the passenger side of the vehicle. The owner or manager to whom such permits are issued shall make no charge for the use of such permits by such guests, but may require a deposit to ensure return of a permit. [Amended 11-24-1992 by L.L. No. 19-19921 (4) The fee for the issuance of a hotel-motel parking permit shall be such fee as shall be prescribed by resolution of the Southold Town Board. D. One-day nonresident permits. (1) One-day nonresident parking permits may be issued for the parking of vehicles on the parking areas at Southold Town Beach, Norman E. Klipp Marine Park and New Suffolk Beach to any person by the attendant on duty at such parking areas or by the Town Clerk. [Amended 5-9-1972; 4-14-1998 by L.L. No. 5-1998; 7-17-2007 by L.L.No. 17-20071 189:8 11-01-2017 § 189-3 PARKING § 189-3 (2) Such permit shall be valid only for the day on which the same is issued. Any permit not fully filled in shall be invalid. [Amended 4-14-1998 by L.L. No. 5-1998] 189:8.1 11-01-2017 § 280-118 ZONING § 280-121 access or egress and may not restrict the public right-of-way or be placed in the minimum-required landscape buffer areas. § 280-119. Long-term outdoor display or storage. [Added 6-11-1996 by L.L. No. 13-1996] All uses which seek to display or store merchandise or property on any basis other than temporary, as described above, must obtain site plan approval for this activity. This section primarily is intended to apply to that merchandise or property which is too large to be kept inside, such as automobiles, boats, artifacts of museums or historical societies and building materials. ARTICLE XXIII Nonconforming Uses and Buildings [Added 1-10-1989 by L.L. No. 1-19891 § 280-120. Purpose. The purpose of this article is to reduce or minimize impacts of uses and buildings which do not conform to the use or bulk requirements set forth in this chapter, all uses and buildings that become nonconforming by reason of any subsequent amendment to this chapter and all buildings containing nonconforming uses. § 280-121. Nonconforming uses. Except as provided hereinafter, nonconforming use of buildings or open land existing on the effective date of this chapter or authorized by a building permit issued prior thereto, regardless of change of title, possession or occupancy or right thereof, may be continued indefinitely, except that such building or use: A. Shall not be enlarged, altered, extended, reconstructed or restored or placed on a different portion of the lot or parcel of land occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever. B. Shall not be moved to another location where such use would be nonconforming. C. Shall not be changed to another nonconforming use without approval by the Board of Appeals and then only to a use which, in the opinion of the said Board, is of the same or of a more-restrictive nature. D. Shall not be changed back to a less-restrictive use if changed to a more-restrictive nonconforming use. E. Shall not be reestablished if such use has been changed to or replaced by a conforming use. 280:119 11-01-2017 § 280-121 SOUTHOLD CODE § 280-123 F. Shall not be repaired or rebuilt unless the use is changed to a conforming use if the nonconforming use is damaged by fire or other causes to the extent of 50% of its fair f value. G. Whenever a nonconforming use of a building or premises has been discontinued for a period of more than two years or has been changed to a higher classification or to a conforming use, anything in this article to the contrary notwithstanding, the nonconforming use of such building or premises shall no longer be permitted unless a variance therefor shall have been granted by the Board of Appeals. § 280-122. Nonconforming buildings with conforming uses. [Amended 4-24-2012 by L.L. No. 6-2012; 9-26-2017 by L.L. No. 14-2017551 A. Nothing in this article shall be deemed to prevent the alteration or enlargement of a nonconforming building containing a conforming use, provided that such action does not create any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings. B. Reconstruction of a damaged building. (1) Nothing in this chapter shall prevent the complete restoration of a building destroyed by accidental cause such as fire, flood, explosion, riot, or act of God, nor prevent the continuance of the use of such building or part thereof. Such restored building shall not exceed the dimensions of the building destroyed. (2) Application for a permit to build or restore the damaged portion of any building - damaged or destroyed as set forth in Subsection B(1) above shall be filed within i one year of the date of such damage and shall be accompanied by plans for Y reconstruction which, as to such portion, shall comply with the requirements set forth above. If such permit is issued, it shall lapse one year thereafter unless reconstruction in accordance with the approved plans has been initiated. § 280-123. Nonconforming buildings with nonconforming uses. [Amended 10-19-1999 by L.L. No. 16-19991 A. A nonconforming building containing a nonconforming use shall not be enlarged, or structurally altered or moved, except as set forth below, unless the use of such building is changed to a conforming use. [Amended 4-24-2012 by L.L. No. 6-20121 (1) Nonresidential uses: (a) Nothing in this article shall be deemed to prevent the alteration or enlargement of a nonconforming or conforming nonresidential building with a nonconforming nonresidential use or construction of an addition to existing buildings or additional building on the premises, so long as said increase in size of the buildings created by enlargement of the existing buildings or 55.
