SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated August 18, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator, Mark Terry, issued his recommendation dated October 23, 2017. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available t, it is the Coordinator's recommendation that the proposed action is INCONSISTENT with policy standards and therefore is INCONSISTENT with the LWRP. The Coordinator noted that the as-built shower was constructed in FEMA flood zone elevation VE(which indicates high risk coastal area). PROPERTY FACTS/DESCRIPTION: The subject property is a 3,621 square foot parcel in the MII Zoning District of which 5,512 sq. ft. is buildable. The parcel measures 50.53 feet fronting First Street along the westerly property line, 70.59 feet along the northerly property line, 50.55 fronting the Great Peconic Bay along the easterly property line and 72.72 feet along the southerly property line. The property is improved with a two story dwelling on a foundation of wood piles, wood steps, second floor cantilevered deck and a wood bulkhead as shown on a survey prepared by John T.Metzger, L.S., last revised June 14, 2016. BASIS OF APPLICATION: Request for Variances under Article 111, Section 280-15; Article XIII, Section 280- 55C(1); and the Building Inspector's July 19, 2017, Amended July 20, 2017 Notice of Disapproval based on an application to legalize an "as built" accessory outdoor shower; at: 1) located in other than the code required rear yard; 2) more than the code permitted maximum lot coverage of 30%: located at: 1200 First Street, (Adj. to Cutchogue Harbor)New Suffolk,NY. SCTM#1000-117-7-30. RELIEF REQUESTED: The applicant requests an area variance to legalize an "as-built" accessory outdoor shower is partially located in the side yard where the code requires a rear yard location. Additionally, the as built shower increases the existing lot coverage to 39.4% where the ZBA previously granted relief for 38.2% lot coverage Page 2,November 16,2017 #7104, Grella, Osborn SCTM No. 1000-117-7-30 (Appeal No. 6773 dated November 6, 2014) The code permits a maximum of 30% lot coverage in the MI1 zone district where the subject property is situated. ADDITIONAL INFORMATION: The applicant was granted six area variances and an interpretation on November 6, 2014 (Appeal Nos. 6773 &6789). The area variances permitted a front yard setback of 3 feet; side yard setbacks of 2.7 feet and 13 feet, respectively; lot coverage of 38.2%; bulkhead setback of 21 feet; and building height of more than the code permitted 2 stories, all of which were considered mathematically substantial and granted in consideration of the removal of concrete planters and decking which would reduce lot coverage from the existing 66.9% and increase the bulkhead setback from 2 feet to 21 feet. The code interpretation established that a floor is not considered a finished floor when the floor is constructed at grade with a concrete slab as the bottom of an unconditioned, non-habitable space of a structure elevated on wood pilings in a flood zone to be FEMA compliant. At the public hearing the applicant stated that an accessory shower had previously existed where the current shower is built. No records showing same were submitted. Previously approved plans by the ZBA (Appeal # 6773 and #6789) did not include a proposed shower. Written correspondence and photographic documentation were received from a neighboring resident who also testified in person in opposition to the requested variance relief.Also, entered into the record was the fact that several violations on this property were still outstanding with the Southold Town Board of Trustees. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2,2017, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is very small and nonconforming in size with a reduced amount of buildable area since the bulkhead is landward of the property line. The existing code requires outdoor accessory showers to be in a rear yard. The non-conforming location of the "as-built" outdoor shower increases the degree of non-conformity on this already substantially non-conforming lot and is located in a FEMA (VE)Flood Zone which creates a hazard to the subject property and nearby properties.. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible to pursue, other than an area variance. Due to the small size of the lot, there is limited space in the seaward non- conforming rear yard and no room in a front yard since the subject dwelling has a front yard setback of only 3 feet.. The "as-built" shower is in a FEMA flood zone with a very fragile ecosystem. The applicant was already granted substantial lot coverage of 38.2% instead of the permitted lot coverage of 30% in a 2014 decision. This variance, if granted,would allow for a lot coverage increase to 39.4%. 3. Town Law§267-b(3)(b)(3). The variance requested herein is mathematically substantial;representing 31% relief from the code permitted minimum lot coverage of 30%. In addition the as built accessory shower further reduces the bulkhead setback of 21 feet granted previously by the Board(a 72%relief from the code required 75 foot minimum). Prior variance relief was largely granted in consideration of the removal of concrete planters and decking which would reduce lot coverage from the existing 66.9% and increase the bulkhead setback from 2 feet to 21 feet. Finally the structure exists in a FEMA regulated flood zone with potential adverse risks. 4. Town Law §267-b(3)(b)(4). Evidence suggests that that this variance would have adverse impacts on the physical or environmental condition s in the neighborhood. The requested area variance, if granted, will alter the essential character of the neighborhood and have a potential negative effect on the adjacent surface water of the Page 3,November 16,2017 #7104, Grella, Osborn SCTM No. 1000-117-7-30 bay. This "as-built" shower is right on the southerly property line which is currently used for boat storage. Even though the applicant has received substantial relief in the past in order to build a FEMA compliant dwelling, the property is still located in a FEMA Flood Zone which requires that any improvements be considered as possible environmental risk to the coastal location. The drainage and run-off from the shower is a concern to the natural environment and may result in adverse impacts to the coastal location This project is INCONSISTENT with the Town of Southold's LWRP as stated in the LWRP determination by LWRP Coordinator There is no evidence of a prior preexisting shower in the current location of this illegal"as-built"shower. 5. Town Law X267-1b(3)(b)(5) The alleged hardship has been self-created. Although, the applicant claimed that he was not aware that constructing this outdoor shower without a permit would be a problem, he has applied to the Building Department, ZBA and Town Trustees in the past and is familiar with the code requirements and the limits of the relief previously granted. He has also been informed about illegalities on his property through receiving a number of violations form the Town of Southold. Finally the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. . 6. Town Law X267-b. Grant of the requested relief is NOT the maximum action necessary to enable the applicant to enjoy the benefit of the "as-built" accessory outdoor shower in a FEMA Flood Zone with the possibility of endangering the fragile ecosystem that currently exists. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to DENY the area variance as applied for, and the applicant is hereby notified that the accessory structure for which the variance was sought, and related plumbing, must be removed immediate. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial'use of a coastal location, and minimizes adverse effects of development. Development that does not reinforce the traditional land use patterns and comply with zoning regulations of the Town of Southold results in an erosion of the community and landscape character. The as built shower was constructed without the benefit of Zoning Board of Appeals Review exceeding approved lot coverage requirements. Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. The as-built shower was constructed in FEMA flood zone elevation VE. r Policy 6. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing structure was constructed in 1962, and is located on a small non-conforming parcel. There is no feasible conforming area on the parcel available to move the structure, even if it was feasible to move it. The new construction required to make the structure FEMA flood zone compliant cannot be done without the grant of variances. 3. Town Law 5267-b(3)(b)(3). Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant will construct a new,county certified septic system. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code,and the applicable regulations of other Town,county,and state agencies. 5. Town Law&267-b(3)(b)(5). The difficulty has been self-created.The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a newly reconstructed FEMA compliant single family dwelling,while preserving and prptecting the character of the neighborhood and the health,safety and welfare of the community. A floor is not a"finished floor"when it is constructed at grade with a concrete slab floor,as the bottom of an unconditioned non-habitable space of a structure that is located within a designated flood zone,and that is required to be elevated on pilings in order to be compliant with FEMA regulations. 2. When an existing or proposed new structure is/will be located within a designated flood zone and therefore must be elevated on pilings for FEMA compliant building construction,the space created by the pilings foundation shall not be considered a"story'so long as it is non- habitable/unconditioned,unenclosed,or if enclosed with either breakaway walls or lattice. Hearing set: 11/2/17 I understand Mr. Portillo has current"as-built" applications open with the ZBA as well as the Board of Trustees. In his application to the ZBA,he is seeking further relief from the code permitted lot coverage of 30% in the MEI zone (mislabeled R40 in the application). I'd like to `�-call your attention to the lot coverage numbers in this and previous applications regarding this property. The Suffolk County Tax Map lists this particular lot as 50'x 60'x 50'x 55' as does the map of New Suffolk found in Grella/Osborne's file. Using those numbers,the lot size amounts to 2875 sq. ft. Elaine Romagnoli,the next door neighbor, has a slightly larger lot, measuring 50'x 60' according to the Suffolk County Tax Map. In 2000,the ZBA recognized her lot size as 3000 sq. ft., and in 2007 it was listed with the Trustees as 2952 sq. ft. In 2001, Gekee Wickham, 1200 First Street's previous owner,made an application to the Board of Trustees and listed the land area as 3111 sq.ft. (50.52'x 61.45').A survey was prepared and listed the lengths of the property, extending from the front of the property towards the Peconic Bay, as 61.72' (N) and 61.45' (S).At that time, the bulkhead was extended past the existing steel sheeting. In 2006,Mr.Anthony Portillo prepared an application to the Board of Trustees on behalf of Grella/Osborne and listed the land area as 3,118 sq. ft. In 2013, Mr. Bruce A.Anderson of Suffolk Environmental Consulting listed the land area as 3621 sq. ft.with 3512 sq. ft. buildable land in a ZBA application dated 8/9/13. The surveys, plans, and applications prepared for Grella/Osborne in the subsequent years (2013-present) regarding the rebuild of their home, utilized those numbers. The lot coverage of 3621 sq. ft. is being calculated using the width of the property (50.55') and the distance from the front of the property to a survey "tie-line"that at its furthest point reaches 72.72'well past the bulkhead and deep into the Peconic Bay. Those representing Grella/Osborne claimed the lot coverage would be decreased from 66.9% (including the house, deck, and illegal planter)to 38.2% (including only the house). This substantial reduction of lot size was the single most important condition upon which the multitude of variances were granted. The 38.2% lot coverage number was repeated at every meeting and in every application. From what I can see,variances were granted based on inaccurate, false calculations. Using the square footage of the house alone (13 43 sq. ft.),the lot coverage, according to the Suffolk County lot numbers is 46.7%. Using Ms. Wickham's 2000 and Mr. Portillo's 2006 application numbers,the lot coverage would be 43.3%. I would also ask that the Board look at the bulkhead setback that is currently listed at 21ft where 75ft is required. Also, on the matter of lot coverage, I would like to know if the above grade septic system should be considered building area. I see the Town of Southold defines building area as, "terraces, patios, decks, and other structures above the finished grade." Seeing how it is being used as a patio area with a lawn, gardens, and waterfall,well above grade,l would think it would be included in the lot coverage percentage. I would urge the Board to take a close look at the applications and surveys for 1200 First Street, New Suffolk,NY. The Peconic Bay comes right up to the bulkhead on this lot. Mr. Portillo claimed the land area was 3,118 sq. ft. in 2006. Today he claims it is 3,621 sq. ft. According to these numbers, the depth of the lot has increased by 11 feet since 2006. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The lot measures only 3000 sq. ft., and the existing house is very small, shown on a survey dated January 18, 2000 at 705 sq. ft. Testimony at the hearing on June 8 indicated that the south-side "pop-out' is 7.5 sq, ft. larger than shown on the survey, making the house 712.5 sq. ft. (2) The Building Inspector's Notice of Disapproval states that current lot coverage is 24.67%; however, a house measurement of 712.5 sq. ft. results in coverage of 23.75%. In either case, coverage exceeds the allowable 20% and any expansion therefore requires a variance. (3) The proposed expansion is only 60 sq. ft. but according to applicant will significantly improve living conditions. Because the lot is only 3000 sq. ft., the expansion adds 2% to lot coverage. (4) This Board is generally reluctant to permit lot coverage on the scale proposed by applicant. However, the proposed addition merely fills in the southwest front corner of the house and will not substantially increase its bulk. Because the property is bounded by water on the north and east, it does not appear seriously crowded despite the high degree of lot coverage. The Suffolk County Tax Map lists the lot size as 2,875 sq. ft. Mr. Portillo reported the lot size was 3,118 sq. ft in 2006 and today he lists it as 3,621 sq. ft,meaning it has grown over 11 feet towards the bay since 2006. The entirety of this lot was completely excavated during construction. The claim that the outdoor shower was built in its previous location using existing plumbing is not accurate. I strongly urge the ZBA to deny this application. There is absolutely no point for Southold citizens to go through proper channels and the permit process when all you have to do is build whatever you like and then simply apply to legalize violations.All that I expect is that the town code be followed.
