SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 7, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. The LWRP Coordinator issued a recommendation dated October 23, 2017 recommending that the proposed action is EXEMPT from LWRP review and that the action will not impact a regulated natural feature and is not located within the Coastal Erosion Hazard Area(CEHA). PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 71,553 sq. ft. parcel located in the R-80 Zoning District measuring 125.01 feet fronting Shelter Island Sound along the easterly property line, measuring 571.98 feet along the southerly property line, measuring 125.00 feet fronting Paradise Point Road along the westerly property line and measuring 572.87 feet along the northerly property line adjacent to a 10 foot right of way. The property is improved with a one and one-half story frame & brick house with a rear porch and an accessory frame garage as shown on a survey prepared by Nathan Taft Corwin III, L.S., last revised November 3, 2016. BASIS OF APPLICATION: Request for Variances under Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's June 1, 2017 Notice of Disapproval, amended July 19, 2017 based on an application for a permit to construct additions and alterations to an existing single family dwelling at: 1) Single family dwelling located less than the code required minimum side yard setback of 20 feet; at: 1350 Paradise Point Road, (Adj.to Southold Bay), Southold,NY, SCTM#1000-81-3-23. RELIEF REQUESTED: The applicant requests a variance for proposed alterations and additions to an existing single family dwelling which will enlarge it to two and one half stories, and will include an attached two car garage Page 2,November 16,2017 #7099,Daley SCTM No. 1000-81-3-23 accessed via a conditioned mudroom/breezeway, having a setback of 13.5 feet from the side yard property line where the code requires a minimum of 20 feet. ADDITIONAL INFORMATION: The applicant's attorney, Charles Cuddy, explained that the side yard setback of the proposed additions to the dwelling will maintain the existing non-conforming 13.5 foot side yard setback. The Board heard testimony from the neighbor residing to the south of the subject property, and received a letter from him indicating that he has no concerns with the proposed construction, and therefore, supports the proposed application for variance relief. The applicant's architect, John Nastasi presented to the Board additional plans, which included a color rendering of the finished dwelling and proposed locations of accessory structures not part of this application; i.e., not requiring variances FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is a non-conforming, 71, 533 sq. ft. parcel having ample depth of 572 plus feet. The proposed construction will be substantially set back from the road and the additions and alterations are in keeping with the size and style of other dwellings in the neighborhood. Both of the subject side yards are screened from adjacent properties with solid wood fencing and the proposed non-conforming 13.5 foot side yard setback already exists and will be maintained. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance. The applicant wishes to build an attached garage rather than an accessory garage. The subject dwelling already exists with a 13.5 foot side yard setback. The proposed attached garage has a side yard setback of 14.5 feet and 15.5 ft.; and moving it to a conforming 20 feet would require major changes on the easterly side of the home; place it partially in front of the dwelling, thereby blocking light, air and view, and would produce an awkward and dysfunctional floor plan. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 32.5% relief from the code. However, the house pre-dates zoning and the existing 13.5 foot non-conforming side yard setback will be maintained. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The variance requested is self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to the existing dwelling including an attached garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,November 16,2017 #7099,Daley SCTM No. 1000-81-3-23 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Acampora, and duly carried,to GRANT the variance as applied for, and shown on the Site Plan and Floor Plans(Pages A-002 thru A-004, A-101 thru A-103,A-201 thru A-204 and A-301)by John Anthony Nastasi,R.A., last revised May 24, 2017. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. However, based upon Town Code Section 280-146 they have been denied a Certificate of Occupancy.This is a unique situation and I request that it be resolved administratively. On November 22,2017,the Zoning Board of Appeals granted an area variance with a side yard set back of 13.5 feet instead of 20 feet,for alteration and addition to their existing home. Subsequently, after the work was commenced a significant issue arose as to the extent of the alteration. The Building Inspector, John Jarski, issued a Stop Work Order in October 2019 and construction was halted. Little progress was made as a result of meetings with the builder, the owners of the site, Edward and Diane Daley,and the Senior Building Inspector.Ultimately the applicants met with the Chief Building Inspector,Town Attorney and the architect.The problem was resolved in November, 2019. After a two (2) months delay construction was resumed. Shortly thereafter Covid caused a shutdown of activity for many months. Supplies were delayed, labor was unavailable. My understanding is Covid permits were extended for six (6) months, The Stop Work Order, which was questionable and finally resolved in the owners' favor, and the of Covid StTr ?�. sie two e�t�aOylf �uysituations. Thus the application is for an amended Certificate, it does not appears the Code addressed that situation.There is no benefit to the Town by requiring further proceedings by the applicant who had little control over a difficult situation. The penalty of re-applying ,for a variance is disproportionate to the offense and does not consider this novel fact pattern. Under these particular circumstances we request that the Board determine the 3-year limitation in the Town Code is tolled and a Certificate of Occupancy be authorized and issued for the home at 1350 Paradise Point Rd., Souhtold. Cuddy Attorney at Law 445 Griffing Avenue Riverhead,NY 11901 Re: De Minimus Request,File#7099 Daley, 1350 Paradise Point Road, Southold SCTM No. 1000-81-3-23 Dear Mr. Cuddy, I received your email correspondence, dated October 15, 2019, requesting a de minimus determination relating to the proposed additions and alterations to the single-family residence located on the property cited above. I am also in receipt of the e mail from the applicant's architect, John Nastasi, with related photos Mr. Nastasi explained that, during construction the general contractor removed two interior non-load bearing bathroom partitions that were not called out on the architectural drawings stamped as approved by the ZBA for side yard variance relief for additions and alterations to the as built dwelling (ZBA #7099 November 16, 2017). He further explained that the existing wood studs of the partitions were too deteriorated to salvage. According to the photos taken by the Building Department during an inspection of the subject property, and submitted to my office, additional exterior walls have also been removed, thereby exceeding the scope of approval by the ZBA. They have further informed me that the construction undertaken on the subject dwelling may now constitute a demolition. According to Town Code definition, Section 280-4, a demolition is "any removal of a structure of portion thereof, where the total cost of reconstruction of the structure or portion thereof exceeds 50% ,of the market value of the existing structure before,the start of removal." J At the October 24, 2019 Special Meeting of the Board of Appeals, I discussed your request with the members of the Board. Since a demolition is not a de minimus change from an approval for additions and alterations, to properly consider your request, the Board of Appeals would need to receive certified, signed and stamped plans from Mr.Nastasi, as architect of record, comparing what was originally approved by the ZBA, exactly what has been removed to date, and calculations demonstrating that the v demolition that has taken place so far has not exceeded 50% of the market value of the original dwelling. If the construction to date is now greater than 50%, then the applicant/homeowner will be required to return to the Building Department to obtain a new Notice of Disapproval for a demolition with a non- \ Page 2, DeMinimus Daley, SCTM No. 1000-81-3-23 conforming side yard setback and apply to the ZBA for a variance. In the alternate, your client has the option to conform to the 20-foot single side yard setback, in which case no ZBA relief will be necessary. The general contractor proceeded with a partial demolition and included additional interior walls. These walls were in a unacceptable deteriorated condition. At the foundation inspection, a stop work order was issued. The entire project has come to a halt, including framing scheduled for this date. The architect,John Nastasi, has written a letter dated October 11, 2019, describing the change. As part of the partial demolition Scope of Work,the GeneralContractor removed two additional interior non- load bearing bathroom partitions that were not called for on my construction drawings. The general contractor has indicated to me that during his demolition, he determined that the existing wood studs of these partitions were in too-deteriorated a condition to keep. Please advise as to how to request the Zoning Board to weigh in on this situation. The Construction Official is understandably looking for the Zoning Board to weigh-in and make a determination whether this issue needs to be brought back to the Zoning Board for a re-review. In my professional opinion, this should probably only require a construction drawing update and not a Zoning Board Review as this change in scope has no affect on the Approved Zoning Criteria that has already been presented to and approved by the Zoning Board. Southold Town Building Department. These images taken at the site this weekend shows that the general contractor is following the approved set of drawings utilizing the existing foundation and first floor framing.The removed bathroom partitions will require an update to the Daley Residence - 1350 Paradise Point Road construction drawings on file in the Southold Town Building Department but nota new zoning review.
