SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 7, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD TOWN PLANNING BOARD: This application was referred to the Planning Board of the Town of Southold for comments. In the Planning Board Chairman's memorandum of October 27, 2017, he indicated that the applicant is currently the subject of a pending site plan application and finds that the relief requested will not affect the site plan reviewed to date because the footprint of the building will not be altered. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 10,664 square foot parcel located in an LB Zoning District. The parcel measures 66.10 feet fronting NYS Route 25 (Main Road, the northerly property line), 164.44 feet along the Easterly property line;, 64.53 feet along the southerly property line;, and 163.57 feet along the westerly property line. The parcel is improved with a one and one half story frame house and a concrete block garage all as shown on a survey prepared by John T Metzger, last revised July 12, 2017. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-42A and the Building Inspector's January 11, 2016 Amended March 30, 2016 and June 19, 2017 Notice of disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling with a business office at: 1) less than the code required minimum rear yard setback of 75 feet; 2) less than the code required minimum side yard setback of 20 feet; 3 less than the code required total side yard setback of 45 feet located at 30675 NYS Route 25 Cutchogue, NY 11935. Page 2,November 16,2017 #7098,Mattituck 2012,LLC SCTM No. 1000-97-3-2 RELIEF REQUESTED: The applicant requests variances to make additions and alterations to an existing single family dwelling with business office that will maintain the existing non-conforming rear yard setback of 60.7 feet where code requires a minimum of 75 feet, a single side yard setback of 11 feet where code requires a minimum of 20 feet and a combined side yard setback of 25.2 feet where code requires a minimum of 45 feet. The footprint of the structure will not be altered. ADDITIONAL INFORMATION: Public hearing notices were mailed to owners of adjacent parcels as required and no comments were received. Responding to Board member's questions, the applicant's representative indicated that no chemicals will be stored on this site which is proposed as a business office for "East End Tick Control." The Board requested that a licensed design professional certify in writing that the building is structurally viable and will not require demolition. On November 14, 2017 the Board received a letter from Mark Schwartz, Architect, stamped with his registration, stating that he had conducted an inspection of the subject property and that "the condition of the foundation and structure is stable and can be restored without demolition." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 12267-1b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes, a winery, and farms. The easterly property line is screened by fencing; the rear yard adjoins a wooded property. The applicant proposes to maintain the existing setbacks and the legally established uses as a residence and professional office. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's lot is a small non-conforming lot and the applicant is maintaining the existing setbacks. Any proposed alterations and additions will require variance relief for pre-existing nonconforming rear yard and side yard setbacks. 3. Town Law &267-b(3)(1b)(3). The variance for the single side yard setback granted herein is mathematically substantial, representing 45% relief from the code. The combined side yard setback granted is substantial representing 44% relief from the code. The rear yard setback granted is substantial representing 20% relief from the code. However, the applicant is proposing to maintain all existing setbacks which were established in 1959 when the structure was originally built. 4. Town Law .4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The building has a certificate of occupancy. The applicant's representative indicated that no demolition is proposed, only rehab is planned; and further remarked that the building is viable when asked about its structural integrity. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant has applied to the Southold Town Planning Board and the NYS Department of Transportation for approvals. It is believed that approvals from both agencies are forthcoming. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The uses of the site are allowed pursuant to Business LB Zoning District. The current setbacks were established when the dwelling and professional office received a building permit and certificate of occupancy in 1959 which is prior to current zoning. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated structure containing a single family dwelling and a professional office while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The LB Business Zoning District allows the proposed uses. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to GRANT the variances as applied for, and shown on the Architectural plans prepared by Mark Schwartz, Architect, labeled as pages Al-4, and F-1, and last revised May 6, 2014; and the survey prepared by John T Metzger dated July 3, 2013 and last updated July 12, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: I. The subject structure may not be demolished pursuant to the provisions in Section 280-4 Definitions, which prohibits reconstruction of a structure or portion thereof that exceeds 50% of the market value of the existing structure before the start of removal. 2. The proposed use must obtain site plan approval from the Southold Town Planning Board. Failure to do so will render the variances granted herein null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. BACKGROUND: The Malon decision was rendered by the ZBA on May 20, 2004 based on an application for a multiple-use building (proposed to contain up to 8 uses) on a 53,821 sq, ft. lot in the B-Genetal Business Zone District. The Building Department issued a Notice of Disapproval on May 20, 2003 that cited the bulk schedule requirement of 30,000 sq.-ft. per use. The applicant requested an interpretation by the ZBA of Code Section 100- 102 to determine if 30,000 sq, ft. of land area per permitted use in the B-General Business Zone District was required. In its decision the Board stated that "this requirement is interpreted to apply to each building rather than to each use or occupancy within the building area in the General Business B Zone District." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this request for an interpretation on October 1,2015,at which time written and oral evidence were presented. Based upon all testimony,documentation, review of the minutes from the public hearings associated with Malon application#5383, and other evidence,the Zoning Board answers the question of whether the Malon Decision#5383 applies to the LB (Limited Business)Zone District as well as the B (Business)Zone District as follows: Page 2 of 2—October 15,2015 ZBA#6885—Interpretation Town Wide 1. No, the"Malon Decision" does not apply to the LB Zone District, as said decision is only applicable to properties located in the B Zone District and no other zoning districts located within the Town of Southold. The Board finds that the plain reading of the "Malon Decision #5383" clearly memorializes the intent of the Board to limit the reach of the decision to the B Zone District exclusively.
