A Regular Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was
held at the Southold Town Hall, 53095 Main Road, Southold, New York 11971-0959, on
Thursday November 2, 2017 commencing at 8:30 A.M.
Present were:

8:36 A.M. Chairperson Weisman called the public hearings to order.
8:37 a.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to
enter into Work Session. Vote of the Board: Ayes: All. This Resolution was duly adopted (3-0)-
Member Dantes was absent and Patricia Acampora was not present.
WORK SESSION:
A. Requests from Board Members for future agenda items.
B. Review of Agenda Items and pending applications.
RESOLUTIONS
A. Reminder Confirmation: Special Meeting Date for November 16, 2017 at 5:00 PM.
B. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman,
seconded by Member Goehringer to set the next Regular Meeting with Public

This Resolution was duly adopted (4-0). Member Dantes was absent.
C. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded
by Member Planamento to approve Minutes from Special Meeting held October 19,
2017. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0).
Member Dantes was absent.
D. Reminder Confirmation: Training Scheduled—Case Law Update - 4:00 PM during
Special Meeting
9:30 a.m. Chairperson Weisman called the meeting to order with the Pledge of Allegiance.
STATE ENVIRONMENTAL QUALITY REVIEWS;
A. BOARD RESOLUTION: Motion was offered by Chairperson Weisman,
seconded by Member Goehringer, to declare the following applications as Type
II Actions and not subject to environmental review pursuant to State
Environmental Quality Review (SEQR) 6 NYCRR, Part 617.5 (c) (3), with No
Adverse Effect for the following projects as applied:

PUBLIC HEARINGS: The following public hearings were held, with Chairperson Weisman
introducing each application and reading of the Legal Notice as published:
9:30 A.M. - MATTITUCK 2012. LLC#7098 by Mike Kimack,Agent. Request for
Variances under Article IX, Section 280-42A and the Building Inspector's January 11,
2016,Amended March 30, 2016 and June 19, 2017 Notice of Disapproval based on an
application for a permit to construct additions and alterations to an existing single
family dwelling with a business office; at: 1) less than the code required minimum rear
yard setback of 75 feet; 2) less than the code required minimum side yard setback of 20

1000 A.M. - ROBERT RAGONA#7060 (Adj. from July 6, 2017) by Patricia Moore,
Agent; Robert Ragona, owner; Edwin Kinscherf; Genevieve Neff and Adam Neff in
opposition. Request an interpretation pursuant to Article II, Section 280-10A and the
Building Inspector's March 8, 2017 Notice of Disapproval based on an application for a
waiver of merger. The applicant requests; 1) that the applicant be exempt from the
Town of Southold Waiver of Merger Law; 2) that the Board amend Appeal#3827 dated
October 4, 1989 to remove the reference of"subdivision;" located at: 350 Wood Lane,

1040 A.M. - 55500 MAIN ROAD, LLC/ERIC AND SUSAN RUSSELL#7100 by Eric
Russell, owner. Request for a Variance under Article XIX, Section 280-85 N(1), and the
Building Inspector's July 18, 2017 Notice of Disapproval based on an application for a
permit to install a wall sign; at: 1) proposed wall sign to project more than one foot
from the exterior wall of the building; at: 55500 NYS Route 25 (Main Road), Southold,
NY, SCTM#1000-62-3-1. BOARD RESOLUTION: (Please see transcript of written

offered by Chairperson Weisman, seconded by Member Goehringer, to close the

owner and Arlene Castellano, opposition. Request for Variances under Article III,

1:20 P.M. - JOHN WICKHAM #7101 by Eric Bressler, Agent. Request for a Variance
under Article IV, Section 280-14 and the Building Inspector's May 23, 2017 Notice of
Disapproval based on an application for a permit for a lot line modification (to combine
two lots and then create a new lot); at: 1) proposed lot measures less than the code
required minimum lot area of 80,000 sq. ft. at: 744 Old Pasture Road, Cutchogue, NY,

Chairperson declared the meeting adjourned. The meeting was adjourned at 1:30 P.M.
