Structures will be adjacent to an existing fixed pier. The proposed structure will extend approximately 40-linear feet from the Plane of Mean Low Water into the waterway. Other proposed work includes the following: [Under Nationwide Permit Number 3 - MAINTENANCE] Replace, in-place, approximately 136-linear feet of bulkhead. [Under Nationwide Permit Number 13 — BANK STABILIZATION] Install approximately 7 cubic yards of riprap along a 24-foot-long area over an area of 192 square feet. Approximately 5.2 cubic yards of riprap will be placed below the plane of Spring High Water. The purpose of this project is to provide safe recreational access to the waterway and to stabilize the shoreline. WATERWAY: Mattituck Creek, a tributary of the Long Island Sound LOCATION:. 15 East Mill Road, Mattituck, Town of Southold, Suffolk County, New York As the proposed work is minor in nature, authorization may be by Letter of Permission. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. No right to trespass or interfere with riparian rights. Box 2124 Greenport, NY 11944 RE: RUSSELL BATES 15 EAST MILL ROAD, MATTITUCK SCTM# 1000-106-4-2 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 18, 2017 regarding the above matter: WHEREAS, Costello Marine Contracting Corp., on behalf of RUSSELL BATES applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 14, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application for for removal of 122' of existing north and east side bulkheads and 12' of west return; construct 122' of new north and east side bulkheads in-place; construct new 16' long west bulkhead return; add an additional 24' of rip-rap to top of approximately 82' of existing rip-rap at end of west return to raise top elevation one foot; be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application for the construction of a 4'x5' platform; install a Tx20' seasonal aluminum ramp onto a 6'x20' seasonal floating dock secured by two (2) 8" diameter anchor pilings; be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: ramp and float are essentially being added to 2 l catwalk, they are NOT a second dock, and they add to the safety of dock owners for access at low tide; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2017, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of RUSSELL BATES to remove 122' of existing north and east side bulkheads and 12' of west return; construct 122' of new north and east side bulkheads in-place; construct new 16' long west bulkhead return; add an additional 24' of rip-rap to top of approximately 82' of existing rip-rap at end of west return to raise top elevation one foot; construct a 4'x5' platform; install a 3'x20' seasonal aluminum ramp onto a 6'x20' seasonal floating dock secured by two (2) 8" diameter anchor pilings; and as depicted on the site plan prepared by Costello Marine Contracting Corp., dated August 29, 2017, and stamped approved on October 18, 2017. SCTM# 1000-106-4-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal to remove the 122' of existing north and east side bulkheads and 12' of west return; construct 122' of new north and east side bulkheads in-place; construct new 16' long west bulkhead return; add an additional 24' of rip-rap to top of approximately 82' of existing rip-rap at end of west return to raise top elevation one foot bulkhead replacement is CONSISTENT. The proposal to construct a 4'x5' platform; install a 3'x20' seasonal aluminum ramp onto a 6'x20' seasonal floating dock secured by two (2) 8" diameter anchor pilings is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. The applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and A discussion on cumulative impacts of dock density in Mattituck Creek is not provided.
