The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, January 16, 2019:
RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative
Amendment to Wetland Permit#9109 to further reconfigure the existing travel lift by
reconstructing the easterly runway, shifting it westward by 2.0', and reconstructing the westerly
runway, shifting it westward by±4.0'; each runway is to be supported/secured by twelve (12)
pilings (14" diameter minimum); and the existing work dock attached to the west side of the
westerly runway is to be removed, and a new 2.0'x40.0' runway is to be constructed to the east
side of the easterly runway; and as depicted on the site plan prepared by Suffolk Environmental
Consulting, Inc., dated December 11, 2018, and stamped approved on January 16, 2019.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not an approval from any other agency.

Request for amendment of permit (#9009) is hereby made limited to a minor re-
design of the travel lift at Albertson's Marina, Inc. as follows:
PROTECT DESCRIPTION: Applicant proposes to amend the existing "inforce"
Town of Southold Board of Trustees Permit No. 9109 to further reconfigure the
existing travel lift by reconstructing the easterly runway, shifting it westward by
2.0', and reconstructing the westerly runway, shifting it westward by 4.0' ±. Each
runway is to be supported/secured by twelve (12) pilings (14" @ minimum).
Additionally, the existing work dock attached to the west side of the westerly
runway is to be removed, and a new runway is to be constructed to the east side
of the easterly Runway (2.0' x 40.0').
Please find enclosed herewith for your review:
(1) Project Plans concerning the re-designed travel lift, prepared by
Suffolk Environmental Consulting, Inc., last dated December 11, 2018 (2
sets); indicating updates & clarifications (four [4] copies); and
(2) Check made payable to the Town of Southold in the amount of$50.00.

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on October 18,2017, and
in consideration of application fee in the sum of$250.00 paid by Budd's Pond Marina, Inc. and subject to the
Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits
the following:
lr Wetland Permit for the reconstruction of existing±51' long wave wall which will be comprised of vinyl
sheathing secured between two(2)tiers of timber waters(6"x6"-both sides),and 8" diameter timber
pilings; widen the existing boat launch runway by relocating/reconstructing the runway an additional±2'
further towards the west in order to widen the overall width of the boat launch runway from±16.5' to
±18x5'; and to construct a±97' low-sill bulkhead comprising of vinyl sheathing sandwiched by 6"x6l'
timber top whalers,61' diameter timber pilings(in a staggered formation on either side of the bulkhead),
with a top elevation of 2' in order to allow tidal flow over the structure during high tides; area directly
landward of new bulkhead to be filled with±20 cubic yards(:L250sq.ft.),obtained from an approved
upland source,graded,groomed and planted with compatible native wetland vegetation (i.e.Spartina
ssp.at V o/c) ; with the condition that a silt curtain be utilized during construction to control turbidity;
and as depicted on the site plan prepared by Suffolk Environmental Consulting,Inc.,dated January 26,
2017,and stamped approved on October 18,2017.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Budd's Pond Marina, Inc., 61500 Route 25, Southold, New York, as part of
the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
10. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others
in order to perform the permitted work nor does it authorize the impairment of any rights,
title, or interest in real or personal property held or vested in a person not a party to the
permit.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, October 18, 2017 regarding the above matter:
WHEREAS, Suffolk Environmental on behalf of BUDD'S POND MARINA, INC. applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated August 14, 2017, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 18, 2017, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of BUDUS POND
MARINA, INC. for the reconstruction of existing ±51' long wave wall which will be
comprised of vinyl sheathing secured between two (2) tiers of timber walers (6"x6"-both
sides), and 8" diameter timber pilings; widen the existing boat launch runway by
relocating/reconstructing the runway an additional ±2' further towards the west in order

Permit to construct and complete project will expire two years from the date the permit

Permit fees are now due. Please make check or money order payable to Town of Southold.
The fee is computed below according to the schedule of rates as set forth in Chapter 275 of the
Southold Town Code.
The following fee must be paid within 90 days or re-application fees will be necessary. You will
receive your permit upon completion of the above.

Applicant proposes to improve upon three (3) areas within the
existing commercial marina as follows:
(1) Reconstruction of the existing Wave Wall located within the southern
section of the property. The Reconstructed Wave Wall is to maintain the
same length as the existing Wave Wall (51.0' ±) and be comprised of Vinyl
Sheathing (10' Deep) secured between two (2) tiers of Timber Walers (6" x 6"
-both sides), further secured by Timber Pilings (8.0" diameter);
(2) Widening of Boat Launch Runway located within the northwesterly section
of the property. The westerly Boat Launch Runway is to be
relocated/reconstructed 2.0' ±further towards the west in order to widen the
overall width of the Boat Launch Runway to 18.5' ±(from 16.5' ±); and
(3) Applicant proposes to construct a Low-Sill Bulkhead off a portion of the
shoreline within the southwestern section of the property. The proposed
Low-Sill Bulkhead will measure 97.0' ±in overall length and be comprised of

1. That it is the intention of the undersigned to request a Permit from the Board of
Trustees to conduct regulated activities:
(1) Reconstruction of the existing Wave Wall located within the southern section of the property. The
Reconstructed Wave Wall is to maintain the same length as the existing Wave Wall (51.0' ±) and be
comprised of Vinyl Sheathing (10' Deep) secured between two (2)tiers of Timber Walers (6"x 6" - both
sides), further secured by Timber Pilings (8.0"diameter); (2) Widening of Boat Launch Runway located
within the northwesterly section of the property. The westerly Boat Launch Runway is to be
relocated/reconstructed 2.0'± further towards the west in order to widen the overall width of the Boat
Launch Runway to 18.5'± (from 16.5' ±); and (3) Install a Low-Sill Bulkhead off a portion of the shoreline
within the southwestern section of the property. The proposed Low-Sill Bulkhead will measure 97.0' ± in
overall length and be comprised of Vinyl Sheathing (C-Loc or similar), sandwiched by Timber Top Walers
(6.0"x 6.0"), and all secured by Timber Pilings (6.0"0—staggered formation on either side of the bulkhead).
The proposed Top Elevation of the Low-Sill Bulkhead will be 2.0' in order to allow tidal flow over the
structure during high tides. The area directly landward of the proposed Low-Sill Bulkhead is to be filled with
clean fill/sand (250 square feet±/20 cubic yards±), obtained from an approved upland source, graded,
groomed and planted with compatible native wetland vegetation (i.e., Spartina spp. @ 1.0' o/c).

SUBJECT OF PUBLIC HEARING : For the reconstruction of existing ±51' long wave wall which
will be comprised of vinyl sheathing secured between two (2) tiers of timber walers (6"x6"-both sides), and
8" diameter timber pilings; widen the existing boat launch runway by relocating/reconstructing the runway
an additional ±2' further towards the west in order to widen the overall width of the boat launch runway
from ±16.5' to ±18x5'; and to construct a ±97' low-sill bulkhead comprising of vinyl sheathing sandwiched by
61"x6" timber top whalers, 6" diameter timber pilings (in a staggered formation on either side of the
bulkhead), with a top elevation of 2' in order to allow tidal flow over the structure during high tides; area
directly landward of new bulkhead to be filed with ±20 cubic yards (±250sq.ft.), obtained from an approved
upland source, graded, groomed and planted with compatible native wetland vegetation (i.e. Spartina ssp.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form should review the exempt
minor action list,policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
