We have filed a request for an"amendment to wetland permit#8922"to reduce the size of the approved pool to 14'x 28' and patio to 1360 sq.ft. (340 sq.ft.pervious artificial turf and 340sq.ft.pervious masonry) as shown on plans prepared by Joyce Grigonis dated 4-5-2018. The pool has been constructed and owners have requested the C.O. The final plan of the pool and patio was a result of 7 revisions with the NYSDEC and is shown on a Peconic Surveyor's survey last dated October 12, 2017. For purposes of clarity, the final plan was redrawn by Joyce Grigonis dated 4-5--20-18 and both survey and site plan are herein attached. The Board granted variances (alternative relief)for the construction of an above ground swimming pool 16'x 32' and patio with 22% lot coverage on January 5, 2017. The Board stamped "Final Map reviewed by ZBA 1-5-2017" which showed the larger pool and 24.2% lot coverage. The survey stamped by ZBA is last dated December 22, 2016 In order to obtain 22% granted lot coverage, the proposed pool and patio was reduced in size to 14' x 28' and patio,with total square footage of 1360 sq.ft. Finally, the New York State Department of Environmental Conservation approved a 14'x 28' swimming pool on October 23, 2017 based on a Peconic surveyors' last dated survey October 12, 2017. In order to meet the percentage of impervious coverage the patio was designed with 340 sq.ft. of artificial turf and 340 sq.ft. of pervious masonry. The total patio and pool is less than 1,360 sq.ft. We have applied to the Southold Town Trustees for an amendment to their permit to conform the DEC plan. The Trustees have requested that I obtain a deminmis determination for the plan. The final plan proposed to the Trustees was approved by NYSDEC, conforms to your Board's decision(not to exceed 22%), and has additional environmental mitigation approved by NYSDEC, we believe that a deminimis determination should be issued. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. A Board of Trustees Wetland Permit (5421) was issued in 2000 that required a 50' wide, non-disturbance/non-fertilization buffer adjacent to the tidal wetland boundary (Figure 1). The submitted survey shows "edge of clearing" within the tt 50' non-disturbance/non-fertilization buffer area. Note that tr►2 wetland line differs from the 2000 approved survey and the September 2015 survey last revised April 29, 2016. This change would relocate the non-disturbed/non- fertilization 50' wide buffer. It is recommended that the 50' non-disturbance/non- fertilization buffer be added to the submitted survey to determine if any encroachments would occur. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 6, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. Based upon the survey submitted and the conditions imposed herein the Board finds the proposed action LWRP CONSISTENT PROPERTY FACTS/DESCRIPTION: The applicant's property is a 29,021 square feet non-conforming parcel - located in an R-40 Zoning District. The parcel's southerly property line, fronting Goose Creek, measures 115.88 feet and measures 90 feet along the northerly property line fronting Clearview Avenue.The parcel measures 288.42 feet along the easterly property line and 324:31 feet along the westerly property line, both boundaries adjacent to residential lots.The property is improved with a two(2) story frame,house and attached garage with existing upper deck and a dock. About half of the property is labeled as wetlands and non-disturbance areas. The property has a buildable lot area of 17,900 square feet as is shown on a survey prepared by John T. SCTM# 1000-70-10-29.2 RELIEF REQUESTED: The applicant requests a variance to construct a pool and raised patio that will result in lot coverage of 24.2%where code allows a 20%maximum. ADDITIONAL INFORMATION: The applicant testified that he needs to build a raised pool and patio with a retaining wall because of the sloping topography on the subject property and the fact that the water table is high and he cannot dig down into the soil .Because of concerns with proximity to wetlands, in a letter dated August 30, 2016, the ZBA Chairperson requested that the applicant request the Board of Town Trustee's approval before proceeding with this petition. An updated survey, dated September 27,2016, has been submitted and reviewed by the Board which depicts the proposed pool and patio encroaching into the 50 foot non-disturbance-non fertilization buffer area corresponding with the June 2000 Board of Trustee's Wetlands Determination. A revised survey required by the Town's Board of Trustee was submitted by the applicant (along with a planting plan), dated December 22, 2016, prepared by John T. Metzger, L.S., depicting a revised "limit of 50 ft. non- disturbance/non-fertilization buffer line." The survey depicts additional elements in-the non- disturbance area; a proposed pervious stone path and pervious stone landing, both of which require further approval by the Board of Trustees. - FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on October 6,2016 and December 1,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the'property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of alternative relief will not'produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The applicant's proposed pool and raised patio is 1,766 square feet in area and the applicant can construct a smaller 1,002.4 square foot pool and raised patio and be more conforming to the Town's zoning code. 2. Town Law4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance, as applied for. The applicant could build a smaller pool and raised patio that is more conforming to the code. However, alternative relief is mitigated by the fact that extensive wetlands on the property render about half of the applicant's parcel as unbuildable when calculating lot coverage. By reducing the lot coverage allowed, the applicant has the ability to reduce sizes of proposed structures and relocate elements, such as the proposed pervious path and landing landward of the limit of 50 ft. non- disturbance/non-fertilization buffer line. 3. Town Law §267-b(3)(b)(3). The variance(s) requested herein is mathematically substantial, representing 21% relief from the code. Granting alternative relief for lot coverage of 22% would not be mathematically substantial representing 10%relief-from the code. 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this-residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Town Law 6267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool and raised patio while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. In 2000 prior to the construction of the existing house,a 50'non-disturbance and non- fertilization condition from the edge of wetlands was added to the permit. The then owner built the house and planted native, drought tolerant indigenous plants within the"limit of clearing area". Over the years the prior owner obtained additional permits for the walkways and to cut the Phragmites. This property was inspected by the Trustees for every permit and the landscaping was an improvement to the property which required clearing. The new owner has proposed a pool and patio which is at 54.3'from the edge of wetlands and also landward of the limit of clearing area. The new owners: Douglas A. Gerowski, Michelle Gerowski&Douglas J. Gerowski have asked the Trustees to have the prior permits transferred into their name(permit#5421,permit #5962, and 6952A). During the ZBA hearing the LWRP coordinator raised the issue of the old limit of clearing line as measured from the old wetland line and the location of the new wetland line. A 50'natural buffer from the edge of wetlands remains. The land was cleared in order to plant the native drought tolerant plants. The LWRP coordinator did not see the existing landscaping which was planted by the prior owner. The plantings are seen on the photographs submitted with the application. 1 r r � r In addition,to help the Boards understand the height of the retaining wall,the 4' elevation is shown. The patio (and pool)is proposed approximately 4' (48") above natural grade. Similar to the construction of a raised sanitary system,the swimming pool will be inside the retaining walls of the patio.
