A 125-127 Main Street Greenport, NY 11944 Re: Waiver request to dig temporary trench Dear Mr. Mills: The following action was taken by the Board of Town Trustees during their regular meeting held on November 16, 1989 as follows: WHEREAS the Town Trustees have conducted an on site inspection of the subject property, RESOLVED that the Town Trustees approve the waives request made by William J. Mills to dig a temporary trench to install wires and pipes on property located on Main Road, Greenport, NY. President Board of Town Trustees Recommendations of 11/9/89 "~ Page 2 RESOLVED to recommend to the Southold Town Trustees disapproval of Waiver Request of Richard Mohrinc~ #97-3-13.4, to construct a single family dwelling. The CAC applicant should go through the permit process. ROW off Main Road, Cutchogue Vote of Council: Ayes: All Motion carried. The CAC did not comment on the violation of James Bitses, Hummel~s Pond, Southold. The Council was advised the matter is now in court. RESOLVED to recommend to the Southold Town Trustees disapproval of the dredging project submitted by Al Koke. The Council disapproves because the Trustees have a moratorium on dredging in Town Creek and Jockey Creek, and the ramp is accessible to trailored boats therefore no need is shown. Vote of Council: Ayes: John Holzapfel, Stephen Angell, Margaret Feeney; and Daniel Kujawski Nays: Bruce Loucka, John Tuthill, and Betty Wells because they feel the project is maintenance dredging but they are concerned about the placement of the spoils. Motion cai"ried. RESOLVED to recommend to the Southold Town Trustees approval of the Waiver request of William J. Mills Co. to dig a trench to install wires and pipes. Main Road, Greenport. Kujawski, Jr. August 23, 1989 Mills Company, Main Road, Greenport TELEPHONE (516) 765-1892 The Board of Trustees have inspected the above referenced site on August 22, 1989 and found that fill has been placed at the rear of the property. It appeared to the Trustees that fill had not been placed directly on wetlands but freshwater wetlands did exist nearby. We met with Mr. Mills and explained that no further fill should be deposited and that if more fill was brought in it would enter wetlands nearby. In regards to the 25' limit for activities, the fill deposited clearly exceeded 25' but the Trustees did not feel that a wetlands violation existed. FAK: jas FRANK A. Dear Mr. De Friest: On March 16, 1989 the Board of Trustees inspected the above referenced property. Please be advised that the front corner, nearest the Main Road, may be filled by requesting a waiver from the Trustees. In addition we plan to put some bluestone over top of the dirt in the area indicated to keep dust levels low. Because we understand this is an "Action" we request a waiver to complete the work.
