New York 11971 October 8~ 1992 Regi Weile, Architect 22 East 22nd Street NY, New York 10010 RE: Milano SCTM %1000-21-2-9 & 10 Dear Ms. Weile: With respect to your letter of October 5, 1992, I must caution you thaE I was not authorized by the Board of Trustees to negotiate or form agreements with you or Mr. Georgi (on behalf of Mr. and Mrs. Milano) nor to modify their permit unilaterally. As president of the Trustees I shall enforce all conditions of the permit, among which are the construction of a berm and retaining wall which will improve upon the existing natural run-off conditions. Any changes mutually agreed to between you and the Milano's which do not negatively impact on run-off conditions and which are viewed as acceptable but substantial by the Board shall require a permit modification or amendment. Any final determination on changes to the permit shall be made by the entire Board of Trustees at a public meeting upon weighing all the facts. In the meanwhile I commend you to try to work with your neighbors to solve your mutual erosion problem. ~_/John M. SOUTHOLD Dear Mr. Bredemeyer, As per our meeting yesterday at the site of the above Permit in East Marion wlth Mr. Georgio (representing the Milamo Family) we agreed on the following: Grading of the land abutting the Tallarek property will be done in such a manner that water run off will be directed in a westerly direction and away from the Tallarek property.,'~way from the Tallarek property"sh~ll mean: in relation to any changes in the grading of the entire property of the Milanos onto the entire property of the Tallareks including but not limited to areas above the break of the bank and the bank proper, that no runoff shall be directed west. Appromed site plan as accepted by the Sout~l, dBoard shall be ammended to include "Ail work performed in re-grading of this site under this permit shall insure that all drainoff water is directed away from a~joining properties. Ail work performed will be in compliance with all governing codes." No part of the present bank now protecting adjoining properties will be removed or disturbed. Proposed burm will be set an an elevation high enough to hold by and divert run-off west and away from adjoining properties. Burm will be maintained under the maintenance Agreement as signed by applicant. Construction of retaining walls will not disturb existing adjoining site elevations Prior to their construction the Contractor will clarify his scope of work with the Tallarek Family and representatives in order that there are no misunderstanding of purpose. Any damage to the adjoining property will be the responsibility of the Contractor and the Milano Family. If this does not agree with your understanding of our meeting please notify TRUSTEES John M.
