That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. - 2. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. Moore, Esq., on behalf of CHARLES ROSENBAUM & KIMBERLY LANDMAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 8, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 20, 2017, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 i WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of CHARLES ROSENBAUM & KIMBERLY LANDMAN to install a proposed pervious gravel driveway not to exceed 12' in width and conform to Chapter 236 of the Town Code-Stormwater Management; maintain existing discharge pipe located under the driveways on Lot 1 (SCTM# 1000-59-8-6.1) and Lot 2 (SCTM# 1000-59-8-6.2) in order to facilitate water flow to the freshwater wetlands located on Lot 1 and Lot 2; establish and perpetually maintain a 75' wide conservation or scenic easement along the landward edge of the freshwater wetland vegetation; establish and perpetually maintain a 50' wide non- disturbance buffer along the landward edge of the freshwater wetland vegetation; along the landward edge of the 50' wide non-disturbance buffer install either a split rail fence (using untreated lumber), a stone wall, stone boulders, or boulders and native plantings, all with sufficient penetration or spacing in the wall or boulders to allow water and small natural habitat to pass under or through the wall penetrations; and to submit final design and specifications of pervious driveway prior to construction of driveway; with the condition that owners conclude tree removal process as indicated by the New York State Department of Environmental Conservation Forest Health Section; and as depicted on the survey prepared by Peconic Surveyors, P.C., last dated August 14, 2017, and stamped approved on September 20, 2017. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) These are the type of measures that keep tree diseases like this in check.Jason passed along information regarding tree removal at 6710/6610 Soundview Avenue,Southold, NY. The 2 items that are of concern to me within this group of photos is the discoloration pattern of the leaves and the fact that trees suffering are all within root connection distance and in a clump.These are both indicators that it may be oak wilt. My recommendation for the removal is that it be done while the tree is dormant(fall/winter when leaves are not on deciduous trees) and that wood be chipped before leaving the site.This will pose the least amount of risk of initiating the disease elsewhere.The first recommendation only applies if there are adjacent oak trees that may be at risk of getting the disease through root connection.The root connection distance being between 50'—100'. If the trees need to be removed now we could team up and I would be happy to schedule sampling of this tree.Sampling would be easier while the tree is removed so we would have to coordinate our presence there at the same time.That way the town could be aware that an infection occurred there. Mike and John were concerned that the trees appeared to be diseased (some terrible and very contagious disease which the NYSDEC is trying to eradicate). I checked with the clients and they had already consulted with an arborist who advised that the trees died due to "root compaction" as a result of the construction. Please include the removal of 5 diseased oak trees on the Rosenbaum wetland permit. Since the Trustees saw the condition of the trees and the risk they pose to the house, we hope that Mike Domino will allow removal of these trees immediately. Thank you Pat PATRICIA C.
