Box 2124 Greenport, NY 11944 RE: JAMES WEEDEN 1175 BRIDGE LANE, CUTCHOGUE SCTM#: 1000-118-2-16.1 Dear Ms. Costello: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, June 19, 2019: RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#9091to construct 178' of 1.5 to 2 ton rock revetment landward of the tidal wetland boundary line. Install 12" diameter fiber 'coirlogs' at base of bank. Establish and perpetually maintain a 10' wide non-turf buffer landward of rock revetment; vegetate buffer area with Cape American Beach Grass; replant any disturbed plantings in the wetland area; and as depicted on the site plan prepared by Costello Marine Contracting Corp., dated August 15, 2018, and stamped approved on June 19, 2019. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. Any other activity within 100' of the wetland boundary requires a permit from this office. Permit Modifications, Suspensions and Revocations,by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions,relevant technology or applicable law or regulations since the issuance of the existing permit; e: noncompliance with previously issued permit conditions, orders of-the commissioner,any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. SCTM# 1000-118-2-16.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review oqK� Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested. B. Use vegetative non-structural measures to manage flooding and erosion hazards. The rate of erosion does not look severe enough to warrant eliminating the natural shoreline, properly designed and installed vegetation in conjunction with coir logs or similar treatment have proved effective in controlling erosion in lower energy areas. C. Enhance existing natural protective features and processes, and use non-structural measures which have a reasonable probability of managing erosion Maintaining the qualities of the natural shoreline is recommended. D. Use hard structural erosion protection measures for control of erosion only where: 4 2. Vegetative approaches to controlling erosion are not effective. A Wetlands Permit was not found and the applicant states that Biologs and vegetation were used in the past to control erosion. When were the Biologs and vegetation installed? 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. Hard structures are not the only practical design. Coir logs with vegetation are recommended for consideration. 6. Practical vegetative methods have been included in the project design and implementation. Vegetative methods are not proposed in the current design. 4.2 Protect and restore natural protective features. Natural protective geologic features provide valuable protection and should be protected, restored and enhanced. Destruction or degradation of these features should be discouraged or prohibited.
