I Last week, we received a letter from the Department of the Army, US Army Corps of Engineers with a permit application containing plans for a proposed dock at 675 Hill Road. As such, I'have sent the US Army Corps of Engineers a formal letter of objection, which I am attaching here for the Southold Trustees. As the owner of 575 Hill Road, Southold - the property bordering on the east side and adjacent to 675 Hill Road - I strongly urge the Department of the Army to deny the proposed dock application in its current form. Specifically, I am responding your letter dated November 8, 2017 regarding the request for Department of the Army authorization, likely through a Letter of Permission, to construct an approximately 4-foot wide by 24-foot-long fixed pier supported by approximately ten 6-inch diameter timber piles; leading to a 3-foot-wide by 15-foot-long ramp; and a 5-foot-wide by 24-foot-long perpendicularly oriented float resting on chocks supported by four 8-inch-diameter piles. Your letter states that the purpose of the proposed structure is intended to provide water access and mooring for recreational water vessel. Our reasons for opposing the dock permit application at 675 Hill Road in Southold include: 1 r 1. The proposed dock permit violates numerous principles of the Coastal Zone Management Act: We do respect that people consider private residential docks a normal and characteristic part of the coastal landscape in Suffolk County and a benefit of waterfront property ownership. However, this dock permit application highlights the very reason why Suffolk County needs strong water and wetlands permitting zoning rules and regulations. As you are aware, the Coastal Zone Management Act demands better aquatic management that ensures that permits given to new docks do not harm the environment and do not adversely affect other uses of the aquatic environment. Dock permit applications must make sense in the context of the surrounding area and ensure the protection of natural resources, including wetlands, floodplains, fish and wildlife and their habitat. 2. Prior Knowledge of Environmental Degradation Exists: We do not believe that the dock structure can be separated from environmental concerns and disagree that the permit application request at 675 Hill Road is "minor in nature". Further, we believe that the impact of the dock as currently designed will further damage the valuable and vulnerable wetlands the dock would be located on. The owners of 675 Hill Road, LLC are fully aware that they are requesting a permit to build a large dock situated at the interface between land and water on deteriorating and erosion-prone wetlands. Google Earth images (see samples provided in the appendix of this letter) clearly show that the shoreline and wetlands located at the subject property have dramatically degraded and eroded. Despite this, in 2017, we attended several public hearings at the Town of Southold where Suffolk Environmental Consulting, on behalf of Glenn Heidtmann, the owner of 675 Hill Road, LLC applied for a wetlands permit to construct a large dock without offering any plans on how they intend to remediate the degradation of these sensitive wetlands or mitigate against further environmental damage. The Board of Trustees in the Town of Southold have postponed the wetlands permit approval-due to environmental concerns. 3. Dock Construction Impact: Public trust and riparian rights only allow waterside property owners access to the water—the use of public waterways for a dock is a privilege, not a "right of ownership". All docks should be scaled appropriately to the size of the property they are located on. There is no "absolute right" to build a dock for a large boat irrespective of how that impacts neighbors or the environment. 4. Scale, Context and Placement Matters: 675 Hill Road is an irregularly shaped parcel of land that narrows at its southern base facing Jockey Creek. The proposed dock looks to be the same size as docks located on properties on Jockey creek that have much larger frontage on the water without the shoreline erosion issues occurring at 675 Hill Road. Therefore the proposed dock seems designed to accommodate a large boat which brings an increased expectation for all-tide access, meaning that dock structures must have heavier construction and be larger in size and length. D E u E � V E� D JAN 1 6 2018 2 Southold Town Board of Ti ust^es Mooring a large boat in an area where the water is shallower than in surrounding areas due to the shoreline erosion of the bank will bring unintended consequences. For example, activities during dock construction can easily destroy plants fragile plants that are already at risk due to the soil erosion either above the tide line or below by pulling them from the substrate or destroying their root system. Damage could also result from materials used in constructing the dock and scouring or resuspension of sediments around the proposed pilings and floats. Given that the wetlands located at 675 Hill Road are already fragile due to the shoreline erosion on the property, we believe that an outsized dock will negatively impact aquatic water quality. 5. Concerns about Secondary Effects from the Dock Construction: There is considerable evidence that in shallow waters, docks shade and alter patterns of water-flow. The area where the proposed dock is to be located at 675 Hill Road provides important habitat for local wildlife, migratory birds and fishing for protected Ospreys. Mooring a large boat in the shallower waters at 675 Hill Road could create "Prop dredging" and scouring, leading to the development of a specialized form of sediment. Prop dredging has proved to lead to the loss of seagrasses in the vicinity of a dock - either through physical disruption of the vegetation or though burial by sediments. Additionally, beyond shallow areas, a large portion of the proposed dock at 675 Hill Road is in the intertidal zone. Beyond prop dredging, running a motorized boat through shallow waters produces two distinct types of wake: 1) the surface bow wake that can lead to erosion of the already eroding shoreline and, 2) a pressure wave formed beneath the boat hull that can impact the bottom sediments. In fragile, damaged wetlands at 675 Hill Road, large boat propellers could further directly damage submerged aquatic vegetation in shallow waters, the impact of which may take years to heal. Damage to the plants and their rhizome system often leads to both reduced habitat and destabilized sediments. 6. New Pilings and Floating Dock at 675 Hill Road will Impact Sediments and Sedimentation. The permit application states that the proposed dock would be supported by pilings and floats. The pilings would go into sea grass beds and would have both an immediate impact, as well as cause long-term changes such as depopulating grasses. As you are no doubt aware, once grass areas are depopulated, the presence of pilings may lessen chances of regrowth. Beal, Schmit, and Williams (1999) suggest that changes in seagrass communities in the vicinity of pilings may be caused by the modification of currents, sediment deposition, attraction of bioturbators, and leaching from chemically treated wood. Other environmental concerns we have about the proposed oversized dock at 675 Hill Road on an already fragile, eroded wetland ecosystem include: • Impacts from shading, including accelerated soil erosion beneath structures passing over S. alterniflora at the edge of the tidal wetlands. • Destruction of vegetated marshes and tidal seagrasses during construction, • Alteration of bottom topography and sediment characteristics • Contaminants leaching from treated wood materials and from fuel spills. 8. Shallow Water: It is well documented that Pile-supported docks may cause changes to sediments and habitats in the vicinity of the dock structure. This may occur through erosion, increased sedimentation, or resuspension and movement of specific particulate sizes or types. Observational evidence indicates that changes in sediments occur when floats settle on the bottom at low tide. This is particularly concerning at 675 Hill Road; because the shallow waters caused by the shoreline erosion mean that the water depths - especially at low tide - may not be appropriate for the large float. As the floats rise they create a suction bring with it sediments. As wave action lifts and lowers the float, sediment is "pumped" into resuspension. Additionally wave refraction in a downward direction may also re-suspend some sediments. Structures such as piles placed in moving water have also been shown to have the capability to disrupt the water's flow. Piles for example may cause increased flow rates immediately around the structure. These modifications in the flow of water may produce scour and erosion or increased deposition of sediments depending on the conditions and structure. Either of these may affect shellfish or wildlife habitats. Negative impacts from the proposed dock at 675 Hill Road that will potentially impact us include: • Altering currents in the vicinity of the dock due to pilings disrupting flow or inducing scour in the immediate vicinity of the piling • Disrupting sediments during piling installation, • Suspension of sediments as floats or boats attached to docks touch or approach bottom at low tides and lift sediments as they rise with the tide ("pumping") • Properties within 100 feet to 150 feet could be subjected to wrack algae accumulation, sand deposition and shellfish population changes." In summary, the proposed dock at 675 Hill Road will harm the aquatic wetlands and adversely affect other uses of the aquatic environment. Allowing the addition of a large dock supported by pilings and floats in an area that already has significant environmental damage caused by shoreline erosion seems irresponsible at best, and intentionally negligent at worse. D E "(31 E � V E 11D JAN 1 6 2018 4 Southold Town Board of Trustees The proposed dock and the consequential negative environmental impact cannot be uncoupled in an area that is alreadv so severely compromised by shoreline erosion. Wetlands, seagrasses, sediment and aquatic wildlife would be severely compromised by the addition of the dock if the plans for building it do not include environmental mitigation strategies. For the reasons outlined above, I am strongly opposed to the dock permit application and sincerely hope you will consider the impacts to the surrounding environment including property values from continued beach erosion that is creeping ever east wards when you evaluate the application and ultimately make a decision on this extremely important matter. I request the Department of the Army deny the application and am happy to discuss this application further. Although the proposed dock was designed to be in compliance with the Trustees' "1/3 Rule" concerning extension of docks into waterways, the Board requested this office to explore the feasibility of shortening the overall length of the dock by five feet (5.0'). It was discussed that this office would reach out to the New York State Department of Environmental Conservation (NYSDEC) in order to determine whether this shortening of the dock would be approvable by the NYSDEC in that this would result in the floating dock being partially located in less than 2.5' of water depth during low tide. Consequently,- we reached out to the NYSDEC analyst for this project, Mr. Matthew Penski, and have finally received his feedback towards shortening the proposed dock, which does not sound promising. Attached is his e-mail from this morning indicating same. Hammarth/ 2 Accordingly, please allow for the issuance of our originally applied-for design in that any shortening of this structure would result in non-compliance with at least the NYSDEC. Although the proposed dock was designed to be in compliance with the Trustees' "1/3 Rule" concerning extension of docks into waterways, the Board requested this office to explore the feasibility of shortening the overall length of the dock by five feet (5.0'). It was discussed ' that this office would reach out to the New York State Department of Environmental Conservation (NYSDEC) in order to determine whether this shortening of the dock would be approvable by the NYSDEC in that this would result in the floating dock being partially Iocated in less than 2.5' of water depth during low tide. Consequently, we reached out to the NYSDEC analyst for this project, Mr. Matthew Penski, and have finally received his feedback towards shortening the proposed dock, which does not sound promising. Attached is his e-mail from this morning indicating same. The impediment to navigation of the waterway could be large, narrowing the navigable channel and causing a potential safety risk. The channel appears to be along the northern shoreline where the dock is proposed. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities, See above comment. [5] Whether the dock will cause degradation of surface water quality and natural resources, (11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and X121 Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold.
