The decision whether to issue a permit will be:based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments.- All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general. environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards,floodplain values, land use,navigation,shoreline erosion and accretion,recreation,water supply and conservation,water quality, energy needs, safety, food and fiber production, mineral needs,considerations of property ownership and,in general,the needs and welfare of the people. Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect any Federally-endangered or threatened species.or their critical habitat. However; pursuant.to Section 7 of the Endangered Species Act (16;U.S.C. 1531), the District Engineer is consulting with the appropriate Federal agency to determine the presence of and potential impacts to listed.species in the project area or their critical habitat. The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act(Public Law 104-267), requires all Federal agencies.to consult with the National Oceanic and Atmospheric Administration Fisheries Service(NOAA/FS) on all actions, or proposed actions, permitted, funded, or undertaken by the agency, that may adversely affect Essential Fish Habitat(EFH). The proposed construction work,fully described in the enclosed Work Description, could cause minimum disruption of habitat for various life stages of some EFH- designated species as a result of a minor short-term temporary increase in turbidity during construction. However,the New York District has made the preliminary determination that the site- specific minor adverse effects are not likely to be substantial because it is expected that fish populations would avoid the small area of minor disturbance. Further consultation with NOAA/FS regarding EFH impacts and conservation recommendations is being conducted and will be concluded priorto the final decision on this permit•application. Based upon a reviewof the latest published version of the National Register of Historic Places, there are no known sites eligible for;or included in,the Register within the permit area. Presently unknown archeological,scientific,prehistorical,or historical data may be lost,by work accomplished under the required permit. Review of activities pursuant to Section 404 of the Clean Water Act will include application of the guidelines promulgated by the Administrator, U.S. Environmental Protection Agency, under authority of Section 404 (b) of the.Clean Water Act and the permit applicant will obtain a water quality certificate or waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior to a permit application decision. A previous DA permit (NAN-1977-00209) for a 10-years maintenance dredging of the Unnamed Canal with upland placement of all resultant dredged material was issued to E.K.Holland on May 2, 1978 and expired on May 2, 1988. The proposed rectangular dredging area is approximately 30-feet-wide by 350-feet-long and extends to a maximum depth of.-4-feet below the plane of Mean Low Water(MLW):in the Horseshoe Cove . section of the inlet and-4-feet below the plane of MLW for the Unnamed Canal section of the inlet. The applicant,plans to conduct a total three (3)dredging events within the 10-years maintenance period. Each dreding event is estimated to result in no more than approximately 350 cubic yards of material. All work would be accomplished by clamshell dredge located on an upland area,with the dredged material transported via clamshell dredge to the upland placement area located east of Horseshoe Cove Inlet. All resultant dredge material will be retained behind hay bales and silt fencing to prevent return to the waterway and the adjacent tidal wetlands.The duration of each dredge and placement.event is estimated to be approximately 4-weeks-long. The applicant has stated that they have avoided, minimized, and mitigated for potential impacts proposed to the maximum extent practicable by limiting the dredging area to the minimum area . required for safe and reasonable navigation between Unnamed Canal and Great Peconic Bay. Any potential impacts would be temporary and would be offset.by implementing best management practices associated with the proposed use of a clamshell bucket. The use of a clamshell bucket would provide the least obtrusive method possible for sediment removal and transport for this project, - effectively localizing turbidity, in addition to'turbidity curtains, and minimizing to the greatest extent possible any potential adverse effects to the aquatic environment. Box 2003 Bridgehampton, NY 11932-2003 RE: CHARLES LOMANGINO TRUST 1035 MEADOW BEACH LANE, 602 MEADOW BEACH ROAD & LOWLAND ROAD, CUTCHOGUE SCTM# 1000-111-10-1.1, 1.2 & 2 Dear Mr. Anderson: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 18, 2017 regarding the above matter: WHEREAS, Suffolk Environmental on behalf of CHARLES LOMANGINO TRUST applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 12, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2017, at which time all interested persons were given an opportunity to be heard, and, z WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of CHARLES LOMANGINO TRUST for a Ten Year Maintenance Permit to restore the navigability of a man-made channel in a lagoon located contiguous to applicant's properties by maintenance dredging the channel within an area measuring 30.0' wide by 350.0' long, dredging up to a depth of-4.0' below mean low low water, extending from the northern entrance to the southern terminus, resulting in 350 cubic years of dredge spoils; dredging will utilize a typical closed-bucket dredge, mounted on a crane; the resultant spoil will be placed on lands owned by the applicant along the eastern shoreline of the channel and contained by placement of hay bales and siltation fencing around its perimeter; with the condition that a silt curtain be utilized during construction to control turbidity, and that within six (6) month's time the silt fence/hay bales be removed and the area be revegetated with a planting of American Beach Grass at the standard densities; and as depicted on the site plan prepared by Suffolk Environmental Consulting, Inc., dated July 24, 2017, and stamped approved on October 18, 2017. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of$50.00 per inspection. (See attached schedule.) Dredgings to Remain On-Site/Within Wetland Dredge material approved to remain on-site and/or within the NYSDEC Tidal Wetlands jurisdiction shall be retained so as not to enter any water body, tidal wetlands, or protected buffer areas. Off-site, upland disposal of dredged material beyond NYSDEC Tidal Wetland jurisdiction requires the additional guidance of the Division of Materials Management (631) 444-0375 and is not covered by this permit. 5. Restrict Spillage, Use Closed Bucket During the dredging operation, the permittee and his contractor shall prevent spillage of sediment during excavation and haulage. Dredging shall be accomplished with a clam shell or other closed bucket equipment. 6. Leave a Uniform Bottom Elevation All dredging shall be conducted so as to leave a uniform bottom elevation free of mounds or holes. 7. Prohibition Period for Fish, Shellfish, Birds To protect spawning finfish, shellfish and nesting shorebirds, including threatened and/or endangered species, no regulated activities may occur between April 1 and September 30, inclusive, of any calendar year. 8. Grade Channel Side Slopes All side slopes of the dredge channel will have a maximum of 1:3 slope. 9. No Dredging near Tidal Wetland No dredging shall occur within 15 linear feet of the seaward edge of the vegetated tidal wetland. 10. Inspect Diked Disposal Area Before dredging begins, the permittee and contractor shall inspect the diked disposal area to confirm that it is structurally sound and ready, with sufficient area to contain the dredged material. Any necessary repair to the diked area must be completed before dredging begins. 11. Return Water Discharge Return water discharge from the disposal site outfall shall not scour the shoreline or disturb tidal wetland vegetation. 12. Dredging Once Per Year Dredging shall be undertaken no more than once in any calendar year unless specifically authorized by the department. 13. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 15. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. Conformance With Plans All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or applicant's agent as part of the permit application. State Not Liable for Damage The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage.
