The validity of this permit is or may be subject to the approval of other governmental or munic[pa
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In th
event that such approval is necessary, the holder of this permit shall not commence operations here
under until such approval has been obtained in writing. The failure to obtain such other approval wh~
required shall subject this permit to. immediate revocation by the Trustees upon rece.ipt by tf
Trustees. of written notice from such other governmental or municipal authorities of
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to pe~o~s
and property resulting from such operations, By such acceptance, the applicant also agrees to indamni-
fy and save harmless the Town, and its officers, agents and employees from any and all cIaims ~dsing
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit, give consent to the Towr~, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantiatly: '
A. Adversely affect the wetlands of the town.
· B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D, Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildtife and vege-
tation or the natural habitat thereof,
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters°
H. Weaken or undermine the lateral support of other iands in the vicinity.
I, Otherwise adversely affect the health, safety and general welfare of the people of the town,

Re: Wetland Application No. 497 - Nicholas Micciche
Dear Mr. Just:
Tha following action was taken by the Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above matter.
WHEREAS, The Land Use Company on behalf of Nicholas Micziche applied to
the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated January 4, 1987, and
WHEREAS said application was referred to the Southold TQwn
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on March 26, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that The Land Use Company on behalf of Nicholas Micciche BE AND HEREBY IS
GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:Construct a 3' x 30'
catwalk leading to a 3' x 16' ramp leading to a 5' x 40' float dock. Property
is located on Oak Street, Cutchogue. '

Nicholae Micciche
This permit will expire on March 26, 1988 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit hy the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
THE FOLLOWING FEES ARE NOW DUE AND PAYABLE. UPON REMITTANCE YOUR PERMIT

The following recommendations were made at the regular meeting of the
Southold Town Conservation Advisory,:held March 20, 1987:
No. 489 - Geddes Parsons - Approval with stipulations as per letter from
John Thatcher of Fishers Island.
No. 490 - Sal Prato - Recommend approval.
No. 491 - Nick Tsouris - Recommend approval but suggest that applicant
-- work with the Southold Town Kenney's Beach Erosion
Committee.
No, 492 - Ralph Levy - Approve application but suggest permit be withheld
unti possible violations have been rectified,
(Upon inspection of property it was discovered that
a 4" diameter hose was being used to drmn water from
driveway into the creek, also there is a deck being
constructed but no permit is displayed. In addition
there are questions as to whether the dock on premises:
has been issued a permit.)
