NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Provisions of the Amended Code of the Town of Southold,
a Regular Meeting and the following public hearings will be held by
the Southold Town Zoning Board of Appeals at the Town Hall, Main

to go before their board again.
On motion made by Mr. Gordon, seconded by Mr. Latham, it was
RESOLVED to approve change of right-of-way for resubdivided
lots 10, ll, 12 and 13 of "Mao.of Captain Kidd Estates", map dated
January 21, 1980 and amended March 6, 1980, subject to the following:
1. The users of the right-of-way having the legal right to
do so.
2. Receipt of three additional copies~of the map.
3. The right-of-way being improved to the specifications of
the Planning Board Inspector.
Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham
The meeting was recessed at 10:55 a.m. After this time, the Board
went over the map of Fishers Island Estates prior to meeting with
Mr. Jausen Noyes, President of FIDC0. Mr. Wall took the Board on
several inspections. The first was a proposed subdivision of nine
acres into three lots on property of the Estate of Zabahonski. There
was a question as to who owns Crescent Avenue and this will be
researched. An inspection was made of the property to be subdivided
by Mr. Valentini into two lots also on Crescent Avenue. The Board
investigated the finished building of three units at the Golf Course
which building was to house help. The Board reviewed several
properties belonging to the Rutherfords but were unsure as to exactly
which property will be subdivided.
The Board reconvened at 1:50 p.m. with Mr. James Wall in attendance.

An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no response in the alloted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has
indicated that soil conditions for individual sewage
disposal systems are acceptable; however, based on data
from recent construction in the area, the potable
groundwater supply in the area is limited both in quantity
and quality. This Department would normally request a
test well prior to approval.
The project will meet all the requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

ZONING BOARD OF APPEALS
After investigation and inspection, the Board finds that
the applicants are requesting approval of a re-subdivision of
two lots, which apparently were divided by probate of will of
Edna B. McNulty, before zoning was adopted in the Town of
Southold, to the applicants herein. The applicants have sub-
mitted for the record Variance Search showing the chain of
title of the subject premises certified by the Title Guarantee
Company March 18, 1980. The reason for this request for a
change of the yard lines is the lots presently have only
approximately 50~foot road frontage, and to build a house to
meet the sideyard restrictions of the zoning ordinance would
be impractical and cause the dwellings to be considerably
close unnecessarily. The Board does agree with the ~easoning
of the applicants.
The Board finds that the circumstances present in this
case are unique, and that strict application of the ordinance
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a variance in this
case will not change the character of the neighborhood and
will observe the spirit of the zoning ordinance.
On motion by Mr. Grigonis, seconded by Mr. Tuthill, it
