At scheduled Town Board meetings, the attending public is encouraged to briefly
address the Town Board relating to agenda resolutions prior to their enactment; the public will
also be given time at the conclusion of the regularly scheduled business agenda to address the
Board on any given topic.

The proposed Local Law entitled, “A Local Law to Amend the Town of Southold Water Supply
Plan Map to Griffing Street, Cutchogue, New York” SCTM# 1000-102.00-05.00-009.004 reads

LOCAL LAW NO. 2017
A Local Law entitled, “A Local Law to Amend the Town of Southold Water Supply Plan Map to
a Portion of Griffing Street, Cutchogue, New York”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Section 1. Legislative Intent.
This Local Law proposes to amend the Town of Southold Water Supply Plan Map to
include the extension of a waterline to 260 Griffing Street, Cutchogue, SCTM #1000-102-5-9.4.
Historically, the Water Supply Plan Map reflects the physical changes in the water supply
network since 2000. The property owner, William J. Baxter, Jr., has represented to the Town
that he wishes to include accessory apartments in the standard subdivision. In order for the
Suffolk County Board of Health to allow this all lots in the subdivision must be serviced by
public water. The extension of the transmission main is intended to supply the Baxter

subdivision and is not intended to result in additional pressure in the area.
Section 2. Enactment.
Based on the goals of the Suffolk County Water Authority and Suffolk County
Department of Health Services to provide safe drinking water to the Baxter subdivision, and
upon our consideration of the recommendations of the Town Planning Department, and the
public comments taken at the public hearing, we hereby amend the Town of Southold Water
Supply Plan Map to include the extension of a water line to 280 Griffing Street, Cutchogue.
Section 3.
The Southold Water Supply Plan Map as adopted by Resolution No. 31 on June 20, 2000
by the Town Board, and most recently amended by Resolution No. 2017-403, is hereby amended
to reflect the extension of a water line to the Baxter subdivision, Cutchogue.

BE IT ENACTED
by the Town Board of the Town of Southold as follows:
I. Purpose.
In order to continue to protect the natural state of the shorelines and wetlands within the Town of
Southold, it is the purpose of these amendments to provide herein for a strengthened system of
local licensing of marine contractors in order to more fully protect homeowners and responsible
marine contractors alike.
II.
Chapter 275 of the Code of the Town of Southold is hereby amended as follows:
§ 275-2. Definitions; word usage.
COASTAL CONSTRUCTION - The repair, modification, re-construction or new construction of
structures including but not limited to bulkheads, docks, floats, jetties, groins, catwalks,
stairways, decks, revetments, any erosion or water control device. Included in this definition is
landscape design, landscape architecture, the installation or maintenance of lawns, hedges, trees
and other plantings or structural elements such as patios, decks, retaining walls, in-ground
irrigation systems, or other work in and around wetland areas which requires a permit pursuant to
this Chapter entitled Wetlands and Shorelines or Chapter 111 Coastal Erosion Hazard Areas of
the Town Code.
COASTAL CONTRACTOR - A person who carries out, engages in, undertakes or holds himself
out to others as performing or available to perform coastal construction.
§ 275-3(a) Licensing of Coastal Contractors.
A. Commencing January 1, 2018 it shall be unlawful for any person to engage in coastal
construction in the Town of Southold without first obtaining a license from the
Southold Town Clerk’s Office in accordance with the provisions of this Chapter. Such
license or a copy thereof shall be available at all of the contractor’s work sites and shall
be produced to any official having jurisdiction upon demand. Licenses for coastal
contractors are non-transferable.
B. Exceptions.
No license shall be required for the following:
(1) An individual who engages in coastal construction on their own residential
property. This exception shall not apply to corporations, limited liability
companies or other unincorporated business entities.
(2) An individual who performs labor or services for a licensed coastal contractor for
wages or salary.
(3) An architect, professional engineer, land surveyor or any other person who is
required by state or Town law to attain standards of competency or experience as
a prerequisite to engaging in such craft or profession and who is acting

exclusively within the scope of the craft or profession for which he is currently
licensed.
(4) Any municipality or government agency.
C. Fees.
(1) The fee for a coastal contractor’s license shall be set by the Town Board, and
shall be paid upon the filing of each application. A license issued hereunder shall
be for a period of one year from the date of issuance thereof.
D. Insurance required.
A coastal contractor shall have a certificate of insurance and workers compensation
insurance covering liability upon applying for a coastal contractor’s license and shall
maintain such policy during the period the license is in effect. In addition to the above
coastal contractors must provide proof of an issued Suffolk County Contractors license
where applicable. Failure to maintain said coverage will provide grounds for
revocation of the license pursuant to § 275-3a(E).
E. Acknowledgement of Town Law Compliance
All applicants for a coastal contractors license shall be required to read, review and
provide an acknowledgement that they are on affirmative notice of Chapters 111 and
275 of the Town Code and agree to abide by the requirements set forth therein. They
must further acknowledge that failure to do so may result in the revocation of the
coastal contractors license.
F. Revocation of license.
(1) Licenses issued under the provisions of this chapter may be revoked by resolution
of the Board of Trustees upon notice and hearing before the Board of Trustees.
(2) Licenses may be revoked for failure of contractors to abide by the terms and
conditions of Trustee Permits and/or violations of Section 275 of the Town Code.
(3) Notice of the hearing before the Board of Trustees for revocation of a license
shall be given in writing, setting forth the grounds of the complaint and the time
and place of hearing.
(4) Grounds for a hearing shall be a conviction for a violation of section 275-5 or
275-11 of the Town Code
(5) Such notice shall be sent by certified mailing to the address provided in the
application for the license on file in the Town Clerk’s Office, or, in the
alternative, to the license holder’s last known address. Such notice must be
mailed at least five days prior to the date of the hearing.
(6) At the conclusion of said hearing, the Board of Trustees may, at their discretion,
suspend or revoke the license or take no action.
(7) In the event of two or more suspensions the Trustees may move to permanently
bar the holder from license eligibility.
(8) In addition to the revocation hearing, a violation of the provisions of this chapter
may be separately maintained in the Town Justice Court in accordance with §
275-16.
§ 275-16. Compliance requirements; penalties for offenses.
B For each offense against any of the provisions of this chapter or any regulations made
pursuant thereto, or failure to comply with a written notice or order of any Director of
Code Enforcement, Zoning Inspector, or Bay Constable within the time fixed for

compliance therewith, the owner, occupant, builder, architect, contractor or their
agents or any other person who commits, takes part or assists in the commission of
any such offense or who shall fail to comply with a written order or notice of the
Director of Code Enforcement, Zoning Inspector, or Bay Constable shall be subject to
the following fine schedule. Each day on which such violation occurs may constitute
a separate, additional offense.\[Amended 12-18-2007 by L.L. No. 23-2007; 3-23-2010

(1)
Failure to obtain a permit. Any person conducting operations within the
jurisdiction of the Trustees without first obtaining a permit according to the
procedures outlined in this chapter shall be subject to a fine of not less than
$1,000 and not more than $4,000 $6,000 or a term of imprisonment of not less
than 15 days nor more than six months, or both.
(2)
Failure to comply with the terms of a permit.
(a)
Any person failing to comply with the terms of a permit shall be subject to
a fine of not less than $500 $1,000 and not more than $4,000 $6,000. For
each subsequent offense, the violator shall be guilty of a misdemeanor
punishable by a fine not less than $1,000 $2,000 nor more than $7,500
$10,000 or a term of imprisonment of not less than 15 days nor more than
six months, or both.
(b)
Any person failing to comply with posting the permit and/or the
requirement for supporting plans to be available for immediate inspection

pursuant to § shall be subject to a fine of not more than $1,000.
(3)
Failure to heed a stop-work order. Any person conducting operations in direct
contradiction to the terms of a stop-work order shall be subject to a fine of not less
than $1,000 and not more than $4,000 $6,000. For each subsequent offense, the
violator shall be guilty of a misdemeanor punishable by a fine not less than
$1,000 $2,000 nor more than $7,500 $10,000 or a term of imprisonment of not
less than 15 days nor more than six months, or both.
(4)
Restoration. In lieu or in addition to these punishments, any offender may be
punished by being ordered to restore the affected wetland to its condition prior to
the offense. Any such order shall specify a reasonable time for the completion of
such restoration, which shall be effected under the supervision of the approving
authority. The Trustees reserve the right to require specific replanting and
restoration methods including specific survivability and success criteria.
(5)
Failure to comply with a restoration plan. Any person failing to comply with the

terms of a mandated restoration plan as detailed in Subsection of this section
within the proscribed period of time for completion shall be guilty of an offense
and subject to a fine of not less than $1,000 and not more than $4,000 $6,000.
(6) For the offense of conducting or engaging in any coastal construction project or
business without having first obtained a license, or while his license is suspended
or revoked, a violator shall be subject to a fine of not more than $5,000 for the
first offense and not more than $10,000 for each subsequent offense.
(6)
(7) Mitigation. When on-site wetlands restoration and creation may be unfeasible due
to technical or other constraints, other mitigative measures, such as off-site
wetland restoration or creation, may be required.

(7) (8) Other offenses. For an offense against any of the provisions of this Chapter not
specifically designated above, a violator shall be subject to a fine of not more than
$1,000.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV.EFFECTIVE DATE
This Local Law shall take effect January 1, 2018 after filing with the Secretary of State as
provided by law.

Chapter 189. Parking
Article I. Parking at Beaches
§ 189-3. Parking permits.

Parking permits for parking vehicles in the parking areas designated in § of this article
shall be issued as follows:
A. Resident parking permit.
(1) A resident parking permit shall be issued by the Town Clerk or a person
designated by him to all persons who are qualified residents of the Town
of Southold. Persons applying for a resident parking permit shall be
requested to sign an application in affidavit form and submit for inspection
the following as proof of residence: \[Amended 5-25-1971; 3-25-1975 by
L.L. No. 1-1975; 7-14-1987 by L.L. No. 11-1987\]
(a) A valid tax receipt stub for the current year for any taxable real
property within the Town of Southold assessed in the name of the
applicant.
(b) A valid motor vehicle registration in the name of the applicant and
to an address located within the Town of Southold or to an address
corresponding to the address of a validated tax receipt stub for the
current tax year for any taxable real property within the Town of
Southold affixed to the application.
(c) Such other proof of residence as is satisfactory to the Town Clerk.
(2) The Town Clerk or a person designated by the Town Clerk shall inspect
such application to determine that the applicant is a qualified resident of
the Town. Upon approval of the application, a resident parking permit
shall be issued and inscribed with the vehicle license registration number.
Such permit shall not be transferred to any other vehicle. \[Amended

(3) Resident parking permits for motor vehicles shall be permanently
affixed to the right side of the front bumper of such vehicle and shall

(4) The fee for the issuance of a resident parking permit shall be such fee as
shall be prescribed by a resolution of the Southold Town Board.\[Added

B. Lessee parking permit.
(1) A lessee parking permit shall be issued by the Town Clerk or a person
designated by him to all persons who lease or rent property within the

Town of Southold but do not qualify as residents as defined in §
hereof. Persons applying for a lessee parking permit shall present an
application in affidavit form, signed by the lessee and the owner of the
property, setting forth:
(a) The location of the leased or rented property.
(b) The persons occupying the same.
(c) The term of such tenancy.
(2) Upon a determination by the Town Clerk or person designated by him that
the applicant is entitled to a lessee parking permit and upon the payment
of the permit fee, such permit shall be issued and inscribed with the
vehicle license registration number and shall be affixed to the vehicle in
189-3A(3)
the same manner as provided in § hereof.
(3) The fee for the issuance of a lessee parking permit shall be such fee as
shall be prescribed by resolution of the Southold Town Board.
C. Hotel-motel parking permits.
(1) Hotel-motel parking permits shall be issued by the Town Clerk or a person
designated by him to the owners or their designated managers of hotels,
motels, rooming or boarding houses and trailer parks, for use by the
paying guests temporarily residing therein. Persons applying for a
hotel-motel parking permit shall present an application to the Town Clerk
in affidavit form, signed by the applicant, setting forth:
(a) The number of rental units available at the applicant's premises.
(b) The number of permits applied for.
(c) The designated business name, if any, of the premises applied for.
(2) Upon a determination by the Town Clerk or a person designated by him
that the applicant is entitled to such permits and upon payment of the
required permit fee, permits shall be issued; provided, however, that the
number of permits issued shall not exceed the number of rental units
available at the premises applied for. Such permits shall be inscribed with
the name of the applicant or the designated business name of the
applicant's premises and shall be used only by paying guests occupying
the premises for which such permits are issued.
(3) Hotel-motel parking permits shall be transferable and shall be displayed
on the dashboard on the passenger side of the vehicle. The owner or
manager to whom such permits are issued shall make no charge for the use
of such permits by such guests, but may require a deposit to ensure return

(4) The fee for the issuance of a hotel-motel parking permit shall be such fee
as shall be prescribed by resolution of the Southold Town Board.
D. One-day nonresident permits.
(1) One-day nonresident parking permits may be issued for the parking of
and
vehicles on the parking areas at Southold Town Beach, Norman E.
Klipp Marine Park and New Suffolk Beach to any person by the attendant
on duty at such parking areas or by the Town Clerk. \[Amended 5-9-1972;

(2) Such permit shall be valid only for the day on which the same is issued.
Any permit not fully filled in shall be invalid. \[Amended 4-14-1998 by

(3) The fee for the issuance of a one-day nonresident parking permit shall be
such fee as shall be prescribed by resolution of the Southold Town Board.
E. Guest permits.
\[Added 12-28-1982 by L.L. No. 9-1982\]
(1) Guest parking permits shall be issued by the Town Clerk or a person
designated by the Town Clerk to all persons who are qualified residents of
189-3A o
the Town of Southold, as defined in § heref, for use by guests
temporarily residing in the dwelling of such resident. A resident applying
for a guest parking permit shall present an application in affidavit form,
signed by the applicant, setting forth the following:
(a) The location of the property to be occupied by the guests.
(b) The names and permanent addresses of the guests.
(c) The length of time of the guest occupancy.
(2) Upon a determination by the Town Clerk or person designated by the
Town Clerk that the applicant is entitled to a guest parking permit and
upon the payment of the permit fee, such permit shall be issued and
inscribed with the vehicle license registration number and shall be affixed
to the vehicle in the same manner as provided in § 189-3A(3) hereof.
(3) The fee for the issuance of a guest parking permit shall be such fee as shall
be prescribed by a resolution of the Southold Town Board.
F. Nonresident seasonal beach parking permit. Beach parking permits for
nonresidents for the period January 1 through December 31 may be issued by the
Town Clerk of the Town of Southold upon application therefor at a sum
prescribed by resolution of the Southold Town Board, which annual sum shall
include both the vehicle and boat trailer. \[Added 7-14-1987 by L.L. No. 11-1987;

G. Trailer Permit.

1. A Trailer Permit shall be required for any trailer used to launch a boat at
the boat ramp or road end locations set forth in section 189-2 B or C.
2. A Trailer permit shall be required at all times to park a trailer in any of the
parking areas designated in sections 189-2 A, B, or C.
3. A Trailer Permit shall be issued by the Town Clerk or a person designated
by him to all persons who are qualified residents of the Town of Southold.
Persons applying for a Trailer Permit shall be required to meet the same
requirements set forth in section 189-3 A.
4. A trailer Permit shall be affixed to the tongue of the trailer.
5. The fee for a Trailer Permit shall be set from time by time by resolution of
the Town Board.
H, Commercial Boat Hauler/Launcher Permit. Any business engaged in the
launching of transporting and/or launching boats shall be required to obtain a
Commercial Boat Hauler Permit.
1. A Commercial Boat Hauler/Launcher Permit shall only be issued by the
Town Clerk or a person designated by him to an individual or corporate
entity engaged in the business of transporting and/or launching boats
with a principle place of business located in the Town of Southold.
2. The fee for a Commercial Boat Hauler/Launcher Permit shall be set from
time by time by resolution of the Town Board.

G.. Night fishing parking permit. For the purpose of ensuring fishermen and shell
fishermen parking access to the beaches, creeks and waters within the Town of
Southold when such parking access is normally closed (10:00 p.m. to 6:00 a.m.),

(1) Night fishing parking permit. A night fishing parking permit shall be
issued by the Town Clerk or a person designated by the Town Clerk to all
persons who hold a resident, lessee or guest parking permit.
(2) Any motor vehicle having a night fishing parking permit shall be deemed

not to be in violation of § or § where both the night
fishing permit and the resident, lessee or guest parking permit are properly
displayed.
(3) The following rules and regulations apply:
(a) At the time a motor vehicle with a night fishing permit is parked at
a location during a time in which parking is normally prohibited by
189-2G 189-3G
§ and § , the occupants of the vehicle must have
fishing equipment and be actively engaged in fishing. The permit
is nontransferable and valid only for vehicles bearing the license
plate number on the permit.
(b) Fees. There shall be no annual fee for night fishing permits.
(c) Duration of permits. All night fishing permits provided for in this
section shall expire at the same time as the resident, lessee or guest
parking permit.

(4) Other regulations. Persons using parking areas pursuant to the provisions
of this section shall comply with all other laws, ordinances, rules,
regulations and restrictions thereto
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV.EFFECTIVE DATE
This Local Law shall take effect January 1, 2018 after filing with the Secretary of State as
provided by law.

BE IT ENACTED
by the Town Board of the Town of Southold as follows:
I. Purpose.
To amend Chapter 245 to remove the ten year time limit on the Cold War Veterans property tax
exemption as recently authorized by the New York State Code.
II.
Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
§ 245-17
Definitions
COLD WAR VETERAN - A person, male or female, who served on active duty for a period of
more than 365 days in the United States armed forces, during the time period from September 2,
1945 to December 26, 1991, was discharged or released therefrom under honorable conditions
and has been awarded the Cold War recognition certificate as authorized under Public Law 105-
85, the 1998 National Defense Authorization Act.
§ 245-18
Exemption granted.
A. Qualifying residential real property shall be exempt from taxation to the extent of 15% of
the assessed value of such property; provided, however, that such exemption shall not
exceed $54,000 or the product of $54,000 multiplied by the latest state equalization or the
latest class ratio, whichever is less.
B. In addition to the exemption provided by Subsection A of this section, where the Cold
War veteran received a compensation rating from the United States Department of
Veterans Affairs or from the United States Department of Defense because of a
service-connected disability, qualifying residential real property shall be exempt from
taxation to the extent of the product of the assessed value of such property multiplied by
50% of the Cold War veteran disability rating; provided, however, that such exemption
shall not exceed $180,000 or the product of $180,000 by the latest state equalization rate
or the latest class ratio, whichever is less.
C. If a Cold War veteran receives the exemption under Article VI of this Chapter, the Cold
War veteran shall not be eligible to receive the exemption under this section.
D. The exemption provided by Subsection A of this section shall be granted for a period of
10 years. The commencement of such ten-year period shall be governed pursuant to this
subsection. Where a qualified owner owns qualifying residential real property on the
effective date of this section, such ten-year period shall be measured from the assessment
roll prepared pursuant to the first taxable status date occurring on or after the effective
date of this section. Where a qualified owner does not own qualifying residential real

property on the effective date of this section, such ten-year period shall be measured from
the assessment roll prepared pursuant to the first taxable status date occurring at least 60
days after the date of purchase of qualifying residential real property; provided, however,
that should the veteran apply for and be granted an exemption on the assessment roll
prepared pursuant to a taxable status date occurring within 60 days after the date of
purchase of residential real property, such ten-year period shall be measured from the
first assessment roll in which the exemption occurs. If, before the expiration of such
ten-year period, such exempt property is sold and replaced with other residential real
property, such exemption may be granted pursuant to this subsection for the unexpired
portion of the ten-year exemption period.
D. E. Application for exemption shall be made by the owner, or all of the owners, of the
property on a form prescribed by the state board. The owner or owners shall file the
completed form in the Assessor's Office on or before the first appropriate taxable status
date. The owner or owners of the property shall not be required to refile each year.
Applicants shall refile on or before the appropriate taxable status date. Applicants that
have previously filed and received a Cold War Veterans Exemption with a pending
expiration date shall not be required to file and the Exemption shall renew automatically
without an expiration date. Any applicant convicted of willfully making any false
statement in the application for such exemption shall be subject to the penalties
prescribed in the Penal Law.
E. F. The exemption allowable under this article may be extended to taxation of school
districts if the governing body of the school district in which the property is located
adopts a resolution providing such exemption as provided in § 458-b(2)(d)(i). Any such
resolution shall be provided to the Town of Southold Assessors’ Office on or before
March 1 for the assessment roll issued within the year.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
