THIS AGREEMENT , made the - of August, 2017, between Virginia M.
Durett, residing at 36 Yarmouth Court, Scotch Plains, New Jersey 07076 (hereinafter
"Durett"), Party of the First Part, and Teresa R. Salas, residing at 2241 Arthur Street,
Merrick, New York 11566 (hereinafter"S alas"), Party of the Second Part.
WHEREAS, the Party of the First Part is the owner in fee simple of certain real
property known as and by 26420 Main Road, Cutchogue,New York 11935, designated as
District 1000, Section 109.00, Block 04.001, Lot 006.000, on the Tax Map of the County
of Suffolk, State of New York, and as more particularly described on Schedule "A"
attached hereto and made a part hereof(hereinafter Parcel "X'); and
WHEREAS, the Party of the Second Part is the owner in fee simple of certain
real property known as and by 26350 Main Road, Cutchogue, New York 11935,
designated as District 1000, Section 109.00, Block 04.00, Lot 005.000, on the Tax Map
of the County of Suffolk, State of New York and as more particularly described on
Schedule "B"attached hereto and made a part hereof(hereinafter Parcel"B"); and
WHEREAS, Parcel"A" adjoins Parcel `B"; and
WHEREAS, a survey of Parcel "A" has been prepared by John C. Ehlers, land
surveyor, originally dated June 13, 2005 (last dated August 3, 2005) (hereinafter "the
Survey"), a copy of which is attached as Exhibit "I". Said survey shows, among other
things, a bordered gravel driveway which runs along or nearby the westerly property line
of Parcel "A", and the easterly property line of Parcel "B", but is situate up to 1.8'
(irregular) inside Parcel"A"; and
WHEREAS, the parties desire to fix and definitely establish the boundary line
between the two parcels mentioned above respectively owned by them without resort to
litigation.
WITNESSETH
NOW, THEREFORE, be it resolved that in consideration of the mutual
promises and conveyances herein contained, and for other good and valuable
consideration, the receipt of which is hereby acknowledged, the parties hereto for
themselves and their heirs, legal representatives, successors and assigns, covenant and
agree as follows:
1. That irrespective of the presently existing placement of the common boundary
line between Parcel "A" and Parcel "B", the common boundary line between the two,
subject parcels shall be deemed to be the westerly boundary of the property owned by the
Party of the First Part and easterly boundary of the property owned by the Party of the
Second Part , said common boundary line being described by the boldened, highlighted
metes and bounds description as shown and set forth in the following overall property
description of Parcel "A"herein, as follows:
"All that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in Cutchogue, Town of Southold,
County of Suffolk and State of New York, more particularly bounded and described as
follows:
BEGINNING at a monument on the southerly side of Main Road (S.R. 25) where
the same is intersected by the westerly boundary line of land now or formerly of Gary
Theinert and Susan Theinert, said point being distant 207.75 feet westerly from a
monument at the corner formed by the intersection of the westerly side of a Right of Way
and the southerly side of Main Road;
RUNNING THENCE from said point or place of beginning along said land,
South 01 degrees 35 minutes 20 seconds West, 227.52 feet to a monument and land now
or formerly of North Fork Country Club;
THENCE along said last mentioned land, North 87 degrees 17 minutes 10
seconds West 80.00 feet to land now or formerly of Patricia J. Monahan and Thomas J.
Monahan:
THENCE along said last mentioned land, North 01 degrees 35 minutes 20
seconds East, 196.37 feet to the southerly side of Main Road;
THENCE along the southerly side of Main Road,North 71 degrees 17 minutes 30
seconds East, 85.28 feet to the monument at the point or place of beginning."
Said common boundary line between Parcels "A" and "B", is further depicted,
described and set forth on the Survey, attached hereto as Exhibit "I").
2. And the party of the First Part does hereby remise, release and quitclaim unto
the Party of the Second Part, her successors and assigns, all of her right, title and interest
in and to any land lying to the west of the said boundary line so established, and the Part
of the Second Part does hereby remise, release and quitclaim unto the Party of the First
Part, her successors and assigns, all of her right, title and interest in and to any of the land
lying to the east of the said boundary line so established, and
3. The Parties further agree and acknowledge that any use by the Party of the
Second Part, her heirs, legal representatives, successors and assigns, of any portion of
Parcel "A" lying easterly of the boundary line as established herein, is permissive and not
hostile to or with any claim of right against the Party of the First Part, her heirs, legal
representatives, successors and assigns.
