SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 31, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community'impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTSMESCRIPTION: The subject property is a 30,312.5 square feet irregularly shaped parcel in the RO Zoning District a measuring 160.00 feet along Love Lane to a mitered corner at Middle Road (County Route 48, aka North Road) measuring 35.77 feet to frontage on Middle Road measuring 160.00 feet to an eastern lost line of 125.00 feet shared with a commercial neighbor then running 60.00 feet west and 60.00 feet south and finally 12.00 feet west shared with a mixed-use residential neighbor. The property is improved with a 2-story frame residence including covered front and rear porches, side stoop and frame barn. A frame garage, appearing on the survey, has since been removed by the applicant as represented on the survey prepared by Paul Barylski, Land Surveying and last revised April 14, 2017. BASIS OF APPLICATION: Request for a Special Exception per Town Code, pursuant to Article VIII, Section 280-38 B(3), the applicant is requesting permission to convert an existing two story single family dwelling into a professional office with second floor apartments, located at: 870 Love Lane, Mattituck,NY. SCTM#1000-140-2-17. RELIEF REQUESTED: The applicant proposes to convert a two-story, single-family residence into professional office space with a one bedroom apartment above. Page 2,October 19,2017 #7096 Special Exeption,Racanelli SCTM No. 1000-140-2-17 ADDITIONAL INFORMATION: Donald G. Feiler, AIA, represented the applicant during the public hearing and outlined the proposed changes to the residential structure and site in order to convert it from a residence to professional office space with an apartment above. He also added that there is an application pending with the Town Planning Board for Site Plan Review. Heard simultaneously to this application, but to be responded to separately is ZBA file#7097 regarding a request for a variance for a less than code required front yard setback. The applicant/owner also spoke at the public hearing and expressed his interest to preserve the existing structure through an adaptive reuse and to also establish a single apartment upstairs. He added that he demolished the existing garage as it was badly neglected and will in the future make repairs to the barn on site. Two immediate neighbors spoke about increased commercial traffic on Love Lane; one of which was in favor of this application. The other resident made no comment for or against the application. No other member of the public or immediate neighbors or merchants spoke for or against this application. A memorandum from Town of Southold Planning Board, dated September 28, 2017, is included in this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 5,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: According to the provisions of Residential Office(RO)Zoning District,the proposed Special Exception meets the following conditions for apartments permitted over business and professional offices as regulated by § 280-45C(4)(a)through (f), inclusive: (a) The Building Department issuing an accessory apartment permit. The habitable floor area of each apartment shall be at least 350 square feet. (c) There shall be no more than three apartments created or maintained in any single structure. Each apartment shall have at least one off-street parking space. Le)Construction and/or remodeling of an existing structure to create an accessory apartment shall not trigger the need for site plan approval set forth specifically in § 280-127 and Article XXIV in general unless such construction or remodeling results in an increase of the foundation size of the structure. (�f The apartment(s) shall not comprise more than 40% of the principal building. The Board has reviewed the General Standards governing Special Exception uses set forth in Section 280-142 and finds: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. Properties developed on Love Lane and in the general area represent a variety of uses ranging from retail and banking to markets and restaurants. There are several other structures which are converted residences to professional office space with an apartment above. B. That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the requested use is located or of permitted or legally established uses in adjacent use districts. The conversion of the residence to Page 3, October 19,2017 #7096 Special Exeption,Racanelli SCTM No. 1000-140-2-17 professional office space with an apartment above will not impede neighbor uses, several of which benefit from the same zoning and use. C. That the safety, the health, the welfare, the comfort, the convenience or the order of the town will not be adversely affected by the proposed use and its location. Love Lane consists of mixed zoning with several buildings offering retail/professional office space below residences or apartments. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. The reuse and conversion of the residence into professional office space along with the second-floor apartment is in keeping with the Comprehensive Plan which identified the need for housing in the Love Lane/Mattituck Hamlet center. E. That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general, particularly with regard to visibility, scale and overall appearance. The existing structure was built prior to zoning and the applicant proposes no changes to the structure with the exception of adding a handicap accessible ramp to the north side of the structure and enclosing an existing front porch. F. That all proposed structures, equipment and material shall be readily accessible for fire and police protection. G. That the proposal shall comply with the requirements of Chapter 236, Stormwater Management BOARD RESOLUTION: In considering all of the above factors, motion was offered by Member Planamento, seconded by Member Dantes, and duly carried to GRANT, a Special Exception, as applied for, and shown on the Survey prepared by Paul Barylski Land Surveying and last revised April 14, 2017 and the Architectural Drawings prepared by Donald G. Feiler, AIA and last revised July 5, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Special Exception Permit granted herein may involve a change in occupancy or a change in use or a change within a classification of the occupancy. Therefore, as a condition of approval,the applicant must contact the Building Department to make the determination whether or not a Building Permit is required and that changes will be NYS Code compliant. 2. Pursuant to Section 280-141(C) "a special exception approval shall be valid for a period of six months but may be extended for one additional six-month period by the Zoning Board of Appeals within the requirement of new public notice of hearing.A continuing or permanent land use authorized by a special exception approval,which use is undertaken or begun during the period of validity of such approval, shall thereafter be deemed a lawful use..." 3. The applicant must obtain site plan approval from the Planning Board. Failure to do so will render this Special Exception Permit null and void.
