SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 25, and the Suffolk County Department of Planning issued its reply dated July 31, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. SOUTHOLD TOWN OFFICE OF THE ENGINEER: This application was referred to the Town Engineer. In the department's response letter dated October 4, 2017 the Town Engineer reviewed the application determined that the as-built section being reviewed is 112 sq. ft. and would not require stormwater controls on its own. ' PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 14,925 square feet parcel located in the Residential R-40 Zoning District. The parcel measures 100.00 feet along the northerly property line, measures 15.00 feet along the easterly property line fronting a private right of way, measures 100.00 feet along the southerly property line, and measures 150.00 feet along the westerly property line. The parcel is improved with a two story frame dwelling with attached decks to both stories and an attached "as built" addition measuring 14 feet by 8 feet oil burner room that does not meet required front yard setback, all shown of survey prepared by John C. Ehlers L.S. last revised November 15, 2005. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's June 7, 2017,Notice of Disapproval based on an application for a permit to legalize"as-built"additions and alterations to an existing single family dwelling; at: 1) less than the code required minimum front yard setback of 35 feet; at: 490 Windy Point Lane, Southold,NY. SCTM#1000-78-6-11. RELIEF REQUESTED: The applicant requests an area variance for a front yard setback of 20 feet where the code requires a minimum of 35 feet, to legalize an addition to the single family dwelling that houses the oil burner, an oil tank and the hot water heater measuring 14 feet by 8 feet. The proposed increase of the building coverage is 112 Page 2, October 19, 2017 #7092, McGinnis SCTM No 1000-78-6-11 square feet upon a parcel measuring 14,923 square feet as shown on the survey map last updated November 15, 2005 by John C. Ehlers L.S. ADDITIONAL INFORMATION: Public hearing notices were mailed to owners of adjacent parcels as required and no comments were received. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 5, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of a mixture of single and two story year round and seasonal houses in close proximity to Corey Creek. The subject property is accessed via a narrow right of way which also runs along the side of the house creating two from yards. The small attached shed that houses the boiler is on the side of the house along an unpaved right of way that appears to be a driveway and that is used by only a few other property owners. Therefore the attached shed is not visible to most properties in the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the area variance. The "as built" burner room already exists with a non- conforming front yard setback and cannot feasible be moved. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematical substantial, representing 42% relief from the Town Code. However, the applicant is burdened with two front yards and the small attached shed cannot be seen by most other properties 4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions of the neighborhood. The applicant must comply with Chapter 236 of the Towns Storm Water Management Code as conditioned herein. The new oil tank in the attached shed replaced an old rusty oil tank that could have leaked oil onto the property and caused environmental harm to the area. 5. Town Law X267-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel before the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of the purchase. 6. Town Law 276-b Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the alterations and additions to the residence and the legalization of the "as built" Burner room while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried, to Page 3, October 19, 2017 #7092, McGinnis SCTM No 1000-78-6-11 GRANT the variance as applied for, and shown on survey prepared by John C. Ehlers, L.S. last updated November 15, 2005. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The"As-Built"section of this review is 112 Sq. Ft. and would not require stormwater controls on its own. However, due to the fact that this existing residence is in close proximity to Corey Creek, I would recommend a covenant and/or prerequisite be considered by the ZBA to require this entire site to comply with Chapter 236 for Stormwater Management. This stormwater plan would include all existing impervious surfaces as well as the new modifications and/or additions to the site. If this site has pre-existing drainage structures or systems that have not been shown or indicated, they should be certified as to size and location by incorporating them into a Stormwater Plan. This Plan should be submitted to the Building Department which will then be reviewed for compliance by my office. Based on the existing conditions in this general area, I believe that the Towns Stormwater Program and the water quality of Corey Creek would benefit from additional drainage in this area.
