SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 9, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD- The application was referred to the Southold Town Planning Board for comments relating to the proposed building addition. The Planning Board, in their memo dated September 28, 2017 stated that the board generally has no objection to the Special Exception and side yard setback relief due to the fact that existing building, and use thereof, received site plan approval in 1985. Moreover, the site is being improved with additional roof cover and will have space to accommodate sanitary, stormwater and parking requirements. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,005 square foot parcel located in a General,Business (B) Zoning District. The parcel measures 150.2 feet along the southerly lot line fronting NYS Route 25, measures 251.08 feet along the westerly lot line, measures 141.5 feet along the northerly lot line abutting Long Island Rail Road tracks, and measures 305.19 feet along the easterly lot line. The property is improved with a one Story Stucco building, a new roof structure over concrete attached to the easterly side of the principal building , a new roof structure over concrete and metal rails attached to the rear side 6f the principal building, a frame shed, a metal container, paver walls, and a sign. All is shown on a survey_prepared by Nathan Taft Corwin last revised October 20, 2016. BASIS OF APPLICATION: Request for a Variance under Article XI, Section 280-49 and the Building Inspector's May 11, 2017, Notice of Disapproval based on an application for a permit to legalize "as-built" additions and alterations to an existing car wash (automobile laundry; at: 1) less than the code required minimum side yard setback of 25 feet; at: 6565 NYS Route 25,Laurel NY. SCTM#1000-125-1-19.5. Page 2,October 19,2017 #7084, Country Car Wash SCTM No. 1000-125-1-19 5 RELIEF REQUESTED: The applicant requests a variance to legalize"as built" construction to the westerly side of the principal structure measuring 16 feet from the side yard property line where the code requires a minimum distance of 25 feet ADDITIONAL INFORMATION: The applicant testified that the New York Department of Environmental Conservation required the car wash to install a water recycling system. In order for the system to operate efficiently the applicant installed it on the west side of the building. The applicant built an enclosure over the system to protect it from the elements and this enclosure is what is creating the non-conforming side yard setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 5, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject business is surrounded by primarily commercial and business operations. The applicant was required to install the water recycling system in order to protect the neighborhood's ground water. The as built addition built to shelter a water recycling system will not produce an undesirable change since the side yard has a large berm and mature landscape screening that shields the addition from view of the adjacent property and a legal fence that shields the view from Main Road/NYS Route 25. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could install the water recycling system and cover in a code conforming location. However, this would require the applicant to pump the water further away from the washing system and the system would not function as effectively or efficiently. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 46%relief from the code. However, the non-conformity was created by the New York State Department of Conservation's (NYSDEC) regulation and the need for the equipment to function efficiently by being in close proximity to the other mechanical systems used in the car wash.. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and obtain an updated site plan approval from the Planning Board. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. However the applicant could not foresee what environmental regulations would take effect and how he would best be able to meet the environmental regulations. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a shelter to house a required water recycling system while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, October 19,2017 #7084, Country Car Wash SCTM No. 1000-125-1-19.5 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin, III, L.S., last revised October 20, 2016, and the architectural plans (pages key and 1 thru 4) prepared by James Deerkoski, P.E., and Nancy Dwyer Design Consultant, dated April 7,2017. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Vote of the Board: Ayes:Members Weisman (Chairperson), Dantes, Planamento, and Acampora. (Member Goehringer absent) This Resolution was duly adopted (4-0). Wilcenski, Chairman Members of the Planning Board Date: September 28, 2017 Re: Request for Comments for Roman Watroba (Country Car Wash) SCTM#1000-125.-1-19.5 ZBA #7084 SC The Planning Board received your request for comments regarding the above- referenced Special Exception Application for an automobile laundry and a deficient side yard setback. The subject property is 0.9 acres in the General Business "B" Zoning District. An amended Site Plan Application was reviewed by the Planning Board and the Board generally has no objection to the Special Exception and side yard setback due to the fact that the existing building and use thereof received Site Plan approval in 1985, the site is being improved with additional roof cover on a parcel of just less than one acre which has space to accommodate sanitary, storm water and parking requirements. Ey Please be advised that the Planning Board currently has not endorsed a Site Plan for this proposal and reserves the right to make any necessary changes to the Site Plan after reviewing all proposals thoroughly. Thank you for this opportunity to provide comments. If you should have any questions or require additional information, please do not hesitate to contact the Planning Office. (Please be sure to research before completing this question or call'our officefor assistance) REASONS FOR APPEAL (Please be specific, additional sheets may be used with preparer s signature notarized): 1.An undesirable change•will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: The attached shed addition is located behind a fence and the foot print is minimal. There is equipment on this side of our building which has always been there, and always been exposed and visible. This new structure encloses it,making it less intrusive to the surrounding area. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Due to the use of the building and how it functions as a drive thru, the only area where cars do not travel is this west side of the structure, therefore this is the only space we can utilize for the fixed RECEpVE® equipment and storage we need. MAY 3.The amount of relief requested is not substantial because: ZONING BOARD OFAPPEqLS The footprint of this attached shed is 200 sq.ft.,taking up less then.5%of our property area. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The equipment located on this side of the structure has always been here, therefore we are not changing the impact or conditions of the area at all;perhaps minimizing it by enclosing everything. 5.Has the alleged difficulty been self-created? Yes,or{ }No Why: Are there any Covenants or Restrictions concerning this land? VfNo { } Yes(please furnish a copy) This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community. / Signature of Applicant or Authorized Agent (Agent must submit written Authorization from Owner) Swo o before me this y of 20 Not Publ CYNTHIA M.CUSATI Notary Public,State of New York No.01CU6100501 isopiestCoemsinESuffolk County APPLICANT'S PROJECT DESCRIPTION APPLICANT: Watroba-Country Car Wash DATE PREPARED: 12-13-2016 1.For Demolition of Existing Building Areas RECEIVED , ' Please describe areas being removed: 2017 F APPMM II.New Construction Areas(New Dwelling or New Additions/Extensions): Dimensions of first floor extension: 8 x 25 feet Dimensions of new second floor: Dimensions of floor above second level: Height(from finished ground to top of ridge): 15 feet Is basement or lowest floor area being constructed? If yes, please provide height(above ground) measured from natural existing grade to first floor: IH.Proposed Construction Description(Alterations or Structural Changes) (Attach extra sheet if necessary). SCTM No. 1000-125.00-01.00-019.005 looms Dear Madam Chairperson: In connection with the above referenced matter, please be advised that we represent the child,Tisha Watroba. Today, we.learned aeon October 19,.2017 the oard-granted a variance for an."as built''structure an ,a special exception. approval, the applicant pusued amended site plan approval t r anning Board. The applicant obtained amended site, plan. approval on January 8,2019,but the inspection condition prior to,issuance of a certificate of occupancy was never accomplished. At that time,Mr. Watroba was struggling with a heart condition and anemia causing his death on February 24,2020. The daughter,Tisha Watroba, believed that her father recived all approvals and was issued a certifcate.ofoccupancy. We received a title report, which alerted us to the fact that it was not. A copy of the variance and special exception approvals are.attached. Given the circumstances, we respectfully request that the Board grant an extension of the time to obtain a certificate of occupancy up to June 30,2024. Hopefully,it will give us sufficient time to obtain a certificate of occupancy, and sell the property. Thank you for your time and consideration. Very •uly yours lWf - WIL.L.I<AM C. G GINS
