SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 14, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article 111, Section 280- 13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificates of Occupancy z16017, z3869, z7002, z 23870, 4932z, 4218, 4971z, 4164, 14812z, z16016 as a single family dwelling with an accessory building and a private swimming pool. The proposed B&B is for three bedrooms for lodging, and serving of breakfast to six B &B casual, transient roomers. ADDITIONAL INFORMATION: Maple Lane is a private road that is owned and maintained by its residents. The post office does not deliver mail to the street. The applicant's neighbors testified that they do not believe that the applicant lives in the house,that he is not a full time resident, and that he has been renting his home regularly to transient guests without being present to supervise their actives and behavior which has been disruptive and stressful to property owners. There are 14 residential lots on Maple Lane, including the applicant's home. The Board received letters of objection from 13 Maple Lane property owners. At the hearing the applicant was asked if he wished to address these allegations or concerns and he declined to comment. The Board left the hearing open for two weeks to receive additional written comments. On October 16, 2017 the applicant submitted an a mail to the Board in which he stated that he believes that off street parking on his property is adequate, his investment in making improvements to the house and landscaping since he and his wife purchased the property 3 years ago has Page 2, October 19,2017 #7086,Lewis SCTM No. 1000-64-1-24 raised property values on Maple Lane, that he believes operating a B&B will not reduce the property values of his neighbors' homes or adversely impact the street, and that he needs the rental income that operating a B&B will provide until his wife can be in residence full time . APPLICABLE PROVISIONS OF TOWN CODE: §280-142 - No special exception approval shall be granted unless the Zoning Board of Appeals specifically finds and determines the following: A. That the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts. B.That the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located or of permitted or legally established uses in adjacent use districts. C. That the safety, the health, the welfare,the comfort,the convenience or the order of the Town will not be adversely affected by the proposed use and its location. D. That the use will be in harmony with and promote the general purposes and intent of this chapter. E.That the use will be compatible with its surroundings and with the character of the neighborhood and of the community in general,particularly with regard to visibility, scale and overall appearance. F.That all proposed structures, equipment and material shall be readily accessible for fire and police protection. §280-143 MATTERS TO BE CONSIDERED: A. The character of the existing and probable development of uses in the district and the peculiar suitability of such district for the location of any of such permitted uses. B. The conservation of property values and the encouragement of the most appropriate uses of land. C. The effect that the location of the proposed use and the location that entrances and exits may have upon the creation or undue increase of vehicular traffic congestion on public streets, highways or sidewalks to assure the public safety. D. The availability of adequate and proper public or private water supply and facilities for the treatment, removal or discharge of sewage, refuse or other effluent (whether liquid, solid, gaseous or otherwise) that may be caused or created by or as a result of the use. E. Whether the use or the materials incidental thereto or produced thereby may give off obnoxious gases, odors, smoke or soot. F. Whether the use will cause disturbing emissions of electrical discharges, dust, light,vibration or noise. G. Whether the operation in pursuance of the use will cause undue interference with the orderly enjoyment by the public of parking or of recreational facilities, if existing or if proposed by the Town or by other competent governmental agencies. H.The necessity for bituminous-surfaced space for purposes of off-street parking of vehicles incidental to the use and whether such space is reasonably adequate and appropriate and can be furnished by the owner of the plot sought to be used within or adjacent to the plot wherein the use shall be located. I_ Whether a hazard to life, limb or property because of fire, flood, erosion or panic may be created by reason of or as a result of the use or by the structures to be used therefor or by the inaccessibility of the property or structures thereon for the convenient entry and operation of fire and other emergency apparatus or by the undue concentration or assemblage of persons upon such plot. I Whether the use or the structures to be used therefor will cause an overcrowding of land or undue concentration of population. K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably anticipated operation and expansion thereof. L. Whether the use to be operated is unreasonably near to a church, school, theater, recreational area or other place of public assembly. M. Whether adequate buffer yards and screening can and will be provided to protect adjacent properties and land uses from possible detrimental impacts of the proposed use. O. Whether adequate provision can and will be made for the collection and disposal of stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the proposed use will generate. P. Whether the natural characteristics of the site are such that the proposed use may be introduced there without undue disturbance or disruption of important natural features, systems or processes and without risk of pollution to groundwater and surface waters on and off the site. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 5, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Brion Lewis and Leslie Simitch, his wife, the applicant(s) herein, are the owners of the property, 315 Maple Lane, Southold, NY. It is improved with a two story brick house, accessory garage and accessory shed , with private swimming pool, as shown on the survey prepared by Roderick Van Tuyl, PC dated February 18, 1986 and page A-1 of site plan prepared by Andrea Simitch, Architect, dated May 16, 2017 2. The applicant's plans comply with the on-site parking requirements and provide for seven parking spaces,two for the principal single-family use and one (1) for each of the 3 proposed accessory Bed and Breakfast bedrooms. However, some of those parking spaces are in a paved area directly off the street that, when full, will resemble a commercial parking lot which is not characteristic of the neighborhood. Additionally, cars would have to either back into or out of the parking area which could cause potential safety issues on Maple Lane which is very narrow. 3. The applicant does comply with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code. The applicant applied for three B&B bedrooms each with en suite baths on the second floor and one personal bedroom with bath on the first floor. 4. The Accessory Bed and Breakfast, as applied for, is not reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. The applicant's residential district is a small narrow private dead end lane. The road is privately maintained. Testimony at the hearing and in writing explained that there is no formal procedure or association responsible for maintaining the private road. The proposed B & B will prevent the orderly and reasonable use of adjacent properties. The applicant's neighbors testified that the home was previously rented through Airbnb and other short term rental sites, thereby infringing on th quiet enjoyment of their own properties. Website printouts displaying the home on rental sites were submitted to this Board. 5. The Special Exception is accessory to the principal use but it will prevent the orderly and reasonable use of adjacent properties. The applicant testified that he is retired and plans to occupy his Maple Lane home as his principal residence while his wife continues to reside and work elsewhere. However, the applicant's property is on a small private lane about half way to the end of the road. The increased traffic and proposed B&B use of the property will not be in harmony with the quiet, intimate character of this small community. Moreover it will be detrimental to all of the private properties that will be adversely affected by the applicant's transient guests, as explained at the hearing by many of the other Maple Lane property owners, based upon their personal experiences with short term rental tenants of the subject property. Page 4, October 19,2017 #7086,Lewis SCTM No. 1000-64-1-24 6. This accessory use will prevent the orderly and reasonable uses proposed or existing in adjacent use districts. The applicant is proposing to operate a 3 bedroom B & B on a small private lane. The properties fronting on Main Road/ Rt. 25 and to the north of the subject dwelling are the Southold Historical Society and an office building with zoning that differs from the subject property. While both uses have some onsite parking and are generally low impact, the Historical Society holds large public events on a regular basis that impact the Maple Lane community with traffic and parking issues. The addition of frequent transient guests will create a hardship on the other property owners by affecting their sense of safety and well-being, their peace and quiet, and enjoyment of their property. 7. Evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will be adversely affected. Since there is no formal procedure for maintaining the road there is no one responsible for guaranteeing that the road is maintained up to the safety standards of§280-A and no guarantee that emergency services can access the home if guests are in need of assistance. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. Adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. The approval of a B & B will create a hardship on this small private neighborhood and create an undue increase in noise and vehicular traffic congestion on this private road. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Dantes, seconded by Member Acampora, and duly carried to DENY the Special Exception permit for an Accessory Bed and Breakfast as applied for. Thank you for your time and consideration at the initial meeting. At that time, I felt that I did not adequately communicate that I have been a member of the larger Southold community for 20 years and a member of the smaller Maple Lane community for 3 years. I have a deep love for the area and plans for our future are based here. If needed or helpful, we could provide many letters from friends, vendors, previous neighbors and general community members attesting to our character and connection to the North Fork. I was clearly surprised by the position of my neighbors at the meeting. I honestly feel there would be no negative impact to our street in any way. We would most likely be renting the occasional bedroom and, as indicated on the application, three bedrooms at the most. Our parking area is designated and off-street so when we have three guests the cars would have no significant impact on the street or the neighborhood. In fact, our neighbors on either side usually have three cars each and often park them on street, something i have never done Our proposed parking would be more controlled, neater and less impactful their our neighbors' parking is currently. With regard to the discussion that our operating a small, bespoke B&B would lessen property values on the street, I really don't understand this at all. We have already positively impacted neighborhood values by paying more for our house (and taxes) than most on the street. We have carefully restored our home and upgraded landscaping of the front yard so that the curb appeal is greater than it was three years ago. The house looks polished and grand. We do not plan to post a B&B sign on or near the house. This will be a very private, "for those who know about it" situation. Until my wife can join me full time out here, the only way that I can manage to keep the house is to have rental 1 .�®16 income. The idea of operating an exuaisive B&B seems to be the most respoiN _}fie way to achieve this. It provides for maximum oversight and control. I believe that when visiting the house you have each seen that the layout/spaces/general ambience is particularly well suited for this idea. A small B&B is not going to change the complexion of the community. If we are successful we will be introducing new friends to the North Fork, friends who will dine in our restaurants, shop in our stores, and eventually seek to buy their own homes in our beautiful community. In his letter Mr. Lewis states that" our intention is to host occasional guests in an extremely low key manner" He further states that " there will never be on street parking and we will never allow large groups of friends, weddings, parties, or events in our home."While I have no reason to believe that Mr Lewis' intentions are not genuine, intentions are not guarantees Maple Lane is a private road with 16 houses which dead ends on the water. As a result, there is very little traffic and street parking. Our street is peaceful and quiet , with a countryside feel. It's a primary reason why we decided to buy our house eleven years ago. We are concerned that, despite Mr. Lewis' representations, opening a commercial business on Maple Lane could significantly change the nature of our quiet little street. It's not only the increase in the number of cars from people staying at the B&B but also from prospective customers who will drive down our street to" check out"the place before deciding to rent a room. These people will probably park on the street, and certainly will if the driveway is full. In addition to more traffic, there will obviously be many different people who we don't know moving in and out of the B&B. The additional traffic and strangers on the street raise safety and security concerns, particularly for the children who live on Maple Lane, as well as visiting grand kids. Since Maple Lane is a private road, the residents are responsible for its maintenance. Suppose one of the guests at the B&B inures himself/herself on the road, e.g., by tripping or slipping,. Will Mr Lewis' insurance policy cover these claims ? Will the residents of Maple Lane be liable for the damages ? Not knowing the extent of our liability exposure seriously concerns us. While Mr. Lewis may have made the representations in his letter in good faith, there are no real assurances. As a practical matter it will be difficult for us to monitor the types and numbers of people who rent the rooms We do not want to spend our time counting the number of cars in the driveway or checking to see if there are cars parked on the street. And even if we identify violations of applicable town regulations and/or Mr. Lewis' representations, I suspect that our options for remedying the situation could be limited, time consuming and expensive We certainly harbor no ill feelings toward Mr. Lewis who we barely know. Again, Brion wasn't even home when they arrived. Last year he rented to a group of very young adults coming and going and partying all weekend. One weekends he had so many unrelated guests and their guests,cars were all over the place. and I object to the proposed parking plan. The plan proposes a commercial style parking lot along Maple Lane,with two cars next to each other,followed by another row of cars behind them. I do not want a parking lot on Maple Lane, nor do I want a wall of cars parked next to my home. If you grant Brion a variance you will be granting him permission to do exactly what he has been doing for the past several years, illegally. How is the Town going to insure Brion is present at the house when it is rented when he is not present now for most of his guests. Brion does not live on Maple Lane. It is not is primary residence. Maple Lane is maintained exclusively at residents'actual physical effort and/or expense, i.e., paving/patching/plowing. The effort of coordination has been rotated among resident volunteers. My wife and I personally coordinated these efforts for a decade. Suddenly Brion will be inviting the transient public to use it, at any hour, on any day,for his sole financial benefit. 6. Brion's idea is a progression from the time of his purchase,when after doing extensive renovation work he used the property more as a transient rental asset on such on-line sites as Air BnB and My NewPlace. In fact, I have only spoken with Brion maybe a half dozen times since he purchased the house, and only once have I spoken with his wife,whose name I do not know. 7.There are several families with young children, and a similar number with young grandchildren, including those of my wife and I, all of whom can safely enjoy the present quiet of Maple Lane. 8.
