Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., January 23, 2008:
WHEREAS, En-Consultants, Inc. on behalf of MARTIN REGINE applied to the Southold
Town Trustees for a Transfer of and an Amendment to Wetland Permit #4367 under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated December 20,2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Southold Town Board of Trustees APPROVE the Transfer of
Permit #4367 from Peter McHugh to Martin Regine, and,
BE IT FURTHER
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #4367 for the in-place replacement of the existing stairs using untreated
materials for the decks/platforms, and as depicted on the plans prepared by En-
Consultants, Inc. dated December 17, 2007.
This is not a determination from any other agency.

MARTIN REGINE requests an Amendment to Permit #4367 for the inkind/inplace replacement
of the existing stairs and decks/platforms. Located: 675 Hillcrest Drive North, Orient.
SCTM#13-2-S.l9
The proposed action has been reviewed to Chapter 26S, Waterfront Consistency Review ofthe
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit".

Attached please find an L WRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to
reconstruct (in-kindlin-place) an existing and previously permitted bluff access stairway.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code ~268-
SeA) and the corresponding definitions of "action" and "minor action" by ~286-3, the submission

The following action was taken by the Board of Town Trustees
during its regular meeting held on August 25,1994 regarding the
above matter:
WHEREAS, Fairweather Brow~ Architects on behalf of PETER MC
HUGH applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold,
application dated July 14, 1994
WHEREAS, said application was referred to the Southotd Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on August 25, 1994 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in guestion and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WH~, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
~SOLVED, that the Board of Trustees approves the application of
PETER MC HUGH to construct a 4' X 4' deck, 8- 4' X 6' stairs,

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS the Wetland Application of McHUGH, PETER 13-2=8.19 to
construct stairs with decks, from top of bluff to beach, on piles as per
submitted plans.
The Council recommends approval provided all decks are a minimum of It'
above the ground and all exposed areas be planted with American Beachgrass.

Moved by Allan Connell, seconded by Robert Keith, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL OF THE BULKHEAD; APPROVAL OF THE DOCK of the Wetland
Application of HECKER, LEWIS 127-6-3 to remove and replace (in kind/in
place) 62 +/- I.f. of timber bulkhead and construct two (2) 10' returns at
ends. Remove and replace (in kind/in place) 15' x 18' timber dock. Dock to
remain a minimum of 4' above grade supporting Spartina alterniflora fringe in
front of bulkhead.
The CAC disapproves the bulkhead and recommend stabilizing vegetatively
following recommendations which can be obtained from Soll Conservation. The
Council suggests the applicant remove the bulkhead north of the dock and plant
spartina. The bulkhead south of the dock should not be removed or repaired
but allowed to fail naturally.
Council recommends approval of the dock. Vote of Council: Ayes: All

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of NICOCOS AR^lAN 52-1-7 to
attach a 30' x 30' wooden deck and construct a 60' bulkhead.
The Council disapproves the deck because it is too large. The CAC
suggests the Trustees require applicant to removed the section which extends
past the Coastal Erosion Hazard line. The applicant should have obtained a
permit prior to building the deck.
The CAC disapproves the bulkhead because no need is shown.

Protection Structure do hereby agree to a 30 year maintenance
program for a structure commonly known as a b~uff stairs
of 120 feet as shown on the attaqhed
feet of length
licensed survey of the as-built structure.
It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which.involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the structure could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including pr?~e~ed, rare .or threatened
