THURSDAY SEPTEMBER 21, 2017
A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was
held at the Southold Town Hall Annex, Capitol One Bank Building, First Floor Conference
Room, 54375 Main Road at Youngs Avenue, Southold on Thursday September 21, 2017
commencing at 4:00 P.M.
Present were:

Call to Order at 4:10 P.M. by Chairperson Weisman.
4:12 p.m. WORK SESSION:
Training—,Agricultural and Markets Law with Town Attorney William Duffy.
5:09 p.m. Motion was offered by Chairperson Weisman, seconded by Member Planamento to
enter into Executive Session for Attorney/Client advice.Vote of the Board: Ayes: All. This
Resolution was duly adopted (5-0).

exit Executive Session.Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0).
5:29 P.M. Motion was offered by Chairperson Weisman, seconded by Member Planamento to
take a short recess.Vote of the Board: Ayes: All. This Resolution was duly adopted(5-0).
5:32 P.M. Motion was offered by Chairperson Weisman, seconded by Member Planamento to
reconvene the Public Hearings. Vote of the Board: Ayes: All. This Resolution was duly
adopted (5-0).

C. Discussed October Draft Assignments—Change in assignments.
D. Discussed Training Hofstra University on September 25, 2017. Chairperson
Weisman and Members Goehringer; Planamento and Acampora to attend.
POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS
BERNADETTE STRACHAN, THE ESTATE OF STUART STRACHAN AND
KENNETH STRACHAN. JR. #7078 — (Add. from September 7, 2017) Request for a
Variance under Article III, Section 280-14 and the Building Inspector's March 24,
2017, Notice of Disapproval based on a proposed subdivision application to legalize two
unrecognized nonconforming lots; at: 1) proposed residential lots having less than the
required 200,000 sq. ft. in area; at: 310 Narrow River Road, (Adj. to Orient Harbor)
Orient, NY. SCTM#1000-27-4-9.4 & 1000-27-4-9.5. BOARD RESOLUTION: Motion
was offered by Chairperson Weisman, seconded by Member Goehringer to adjourn to
October 5, 2017. Vote of the Board:Ayes: All. This Resolution was duly adopted (5-0).
LISA AND CHARLES HOWARD #7083 — (Adjourn from September 7, 2017) Request
for a Variance under Article III, Section 280-15, Article IV, Section 280-19, and the
Building Inspector's April 26, 2017, Notice of Disapproval based on an application for a
permit to construct an accessory in-ground swimming pool and a one story frame
accessory pool house, at: 1) proposed in-ground swimming pool located in other than
the code required rear yard; 2) proposed one story accessory pool house located in other
than the code required rear yard; at: 455 North View Drive, Orient, NY. SCTM#1000-
13-1-9.2. BOARD RESOLUTION: Motion was offered by Chairperson Weisman,
seconded by Member Goehringer to close the public hearing reserving decision. Vote of
the Board:Ayes: All. This Resolution was duly adopted (5-0).

DILIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with
agenda items, and commenced deliberations on the following applications. The original
determinations of each of the following applications as decided are filed with the Southold
Town Clerk:
SPORTS EAST PRIVATE MEMBERSHIP CLUB—PAUL PAWLOWSKI#7091- (Adjourned
from August 3, 2017) Request for an interpretation, pursuant to Article XXVI, § 280-146D of
the Town Code, in response to the Building Inspector's April 26, 2017 Notice of Disapproval
that the proposed use, as applied for, is not a permitted use in the R-80 Zoning District
pursuant to the Zoning Board of Appeals Code Interpretation#6976; located, at: 9300 NYS
Route 25, Mattituck, NY. SCTM# 1000-122-7-9. BOARD RESOLUTION: Motion was offered
by Chairperson Weisman, seconded by Member Acampora that upheld the Building
Department Notice of Disapproval stating this does not meet the definition of a membership
club. "The use as proposed by sports east does not meet the definition of a`club, membership
or country or golf rather; the proposed use meets the definition of a "recreational facility,
commercial." Vote of the Board:Ayes: All. This Resolution was duly adopted (4-0). Member
Goehringer recused himself.

RESOLUTIONS:
A. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by
Member Goehringer, to authorize advertising of hearings for the next Regular Meeting
to be held October 5, 2017 at 8:30 AM. Vote of the Board: Ayes: All. This Resolution
was duly adopted (5-0).
B. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded
by Member Goehringer to approve minutes from September 7, 2017, Regular Meeting.
Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0). ,
There being no other business properly coming before the Board at this time, Member Dantes
declared the meeting adjourned. The meeting was adjourned at 6:50 P.M.
