In the Matter of the Petition of: TOWN OF SOUTH@WISION TONY GRAZIANO For a Variance to the New York State Uniform Fire Prevention & Building Code PETITION NO. 2016-0372 ------------------------------------------------------- Upon the application of Tony Graziano, filed pursuant to 19 NYCRR 1205 on November 14, 2016, and upon all other papers in this matter, the Department makes the following determination- NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to alterations to an existing one-family dwelling, two stories in height, Type VB construction, approximately 5,000 square feet in area, located at 915 Lakeside Drive,Town of Southold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220, Residential Code of New York State(2010), Section 305.1 &Section R305.1,exception 4, which stipulates that...Habitable rooms, hallways, corridors, bathrooms, toilet rooms and basements shall have a ceiling height of not less than 7 feet The required height shall be measured from the finished floor to the lowest projection from the ceiling... and bathrooms shall have a minimum ceiling height of 6 feet 8 inches over the fixture and at the front clearance area for fixtures as shown in Figure RR307.1. A shower or tub equipped with a showerhead shall have a minimum ceiling height of 6 feet 8 inches above a minimum area 30 inches by 30 inches at the showerhead. [The petitioner requests to relief to permit a bathroom with a ceiling height of approximately 6 feet 4 inch over the front clearance area for a plumbing fixture.] FINDINGS OF FACT 1. A bedroom and a bathroom have been constructed within the gable roof area over the existing garage of an existing dwelling.The ceiling slopes from approximately 6 foot 8 inch to 6 feet 4 inches in height over the toilet. 2. With a portion of the ceiling height of 6 feet 4 inches most persons would be able to use the toilet in a standing position and ample height to use the toilet in the seated position 3. The Petitioner has stated that at this time it would be both physically and financially impracticable to raise the ceiling height or move the toilet in the bathroom. 4. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine NEW2ORK Department STATEOPPONITY. of State Petition No 2016-0372 Page 2 variance under the provisions of 19 NYCRR 1205. CONCLUSIONS OF LAW The proposed variance will not substantially adversely affect the Code's provisions for healthy, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, unnecessary hardship, or would otherwise be unwarranted because such would entail a change so slight as to produce a negligible additional benefit consonant with the purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220 1, Section R305.1 & R305.1 Exception 4, be and hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the alterations, in all other respects, will be compliant with all other applicable provisions of the Residential Code of New York State including the installation of smoke detectors and carbon monoxide detectors as per Section R313 This DECISION is issued under 19 NYCRR 1205.6 unless objected to by the petitioner in a writing received by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. In reviewing your visit with my wife she reminded me that at the time of the prior"final" inspection we had the entire attic area( the room you were in )finished, all of the rough plumping in-place(you now know this )and all of the electrical installed. As I told you, we had always planned to finish the space.We ran out of$$$ (way over budget on the house at the time, surprise-surprise! )The bathroom we are applying now for was in affect a finished closet with plumbing in the floor.The finished wood floor was in.The walls were rocked, taped and ready for prime and paint. HVAC was in-place. The electric was in, including a builders light fixture over where the sink would be and the exhaust fan in. The plan was to the the shower, add the closure, add bathroom fixtures and finish paint. Instant"john"when we had the funds as this was the expensive stuff. This was the case with the entire space. All we added after the fact was the final mill work, paint and replaced builders light fixtures with finished ones. Julie reminds me that even the washer and dryer were in-place at the time of that final inspection. FYI we have a 50 AMP sub panel up there to make the distribution for bath, laundry and HVAC proper and economical. My question is: shouldn't there be a record of the final electrical someplace. If I really don't need it I certainly don't want to go through the hoops. All the other items you list are on the way to being completed.
