Box 1179 JUN - 5 2009 ?• Southold,NY 11971 ; r _ So!�'ho!d Tce n Re: Alan Cardinale,James Creek,Mattituck Board of Trusiees _ Dear Mr. King: As you surely recall, last year we asked the Board to review the stake-out of an alternative community dock design for the captioned subdivision, which consisted of two separate dock structures, each extending approximately 45 feet seaward of apparent low water or one-third the width of the canal. Based on concerns the Board had both over the creation of two physically separate dock structures and the extent of their intrusion into the waterway, Mr. Cardinale and I met with you, Mark Terry, and Lori Hulse to determine whether the dock could be reconfigured as a single dock structure with less intrusion into the waterway. The attached plan represents the alternative design we discussed at that meeting, i.e., a fixed "L"-shaped catwalk with two ramp-and-float assemblies extending approximately 37 feet seaward of low water or just over one-fourth (27%) the width of the canal. This plan thus represents a reduction in the previously designed dock's seaward intrusion into the waterway by 8 feet. This is as close as the floats can be located to the shoreline without extending into waters shallower than 30 inches at low tide, which as you know would not be approvable by the New York State Department of Environmental Conservation. So that the Board may inspect this revised configuration, we have arranged for the proposed dock location to be staked out in accordance with the attached drawing prior to your 10 June 2009 field inspections. To that end, please consider this letter and accompanying check for $50 a formal request that the Board inspect the site on that date. As I also understand from my recent discussion with you that we will need to resubmit a new application for the dock facility supported by an LWRP application, I think it will behoove the Board to first revisit the prior petition informally so that the Board members in office for the original application can make the newer Board members aware of what transpired during the public hearings held on the application in 2005. To that end, Mr. Cardinale would like the:matter-placeL-on=your_Manch--work::session=agenda and in anticipation of that meeting would like you to review the attached dock plan, which we designed after and in response to the lengthy discussions we had with the Board and several surrounding property owners who expressed certain objections to the originally submitted "E"-shaped dock facility in 2005. As I recall, you and Al Krupski supported this design and believed it would assuage any legitimate community concerns but also felt it was inappropriate to continue reviewing the application until the Planning Board had committed itself to approving the proposed subdivision and creating the lots the dock is intended to serve. In response to one concern you recalled the Board having in our recent discussion, please be advised that access to the communal dock facility would be provided over the property "housing"the dock by a right-of-way guaranteed to the homeowner's association. Therefore, access to the dock could never be legally precluded by a single property owner. Another boat was coming from village marine and it was difficult navigating past one another. Village marine is a very busy marina with lots of boating traffic. James Creek is a very active waterway. Besides the obvious concern for the disturbance to the area'wetlands, I would have more sympathy and understanding for the project if it were reduced in sire and if it were for the benefit of an owner's personal use,rather than some } commercial enterprise. We can still confirm the width of the canal and have the site staked for inspection in August, but if they would prefer the idea of this alternative,we can try to have the revised configuration staked out instead. The current plan subdivides the land into several parcels for houses, with the community dock going off one of these lots. Would it be possible for the dock to go off of a right of way or park and playground area that is created for this subdivision, as opposed to that being part of one person's private land?
