TOGETHER with the grantors ' right, title and interest, if any,, to and
in the abutting lands south of the premises hereinabove described and
below ordinary high water mark and/or under the waters of Great
Peconic Bay.
TOGETHER with an easement, if any, to use the waters of Hall's Creek
for all ordinary purposes of ingress and egress over the same from
Gre at Peconic Bay, to the premises herein described.
SUBJECT to an easement of ingress and egress reserved by the grantors
over a certain 50 foot right-of-way to and from New Suffolk Avenue and
the northerly terminus of a 20 foot right-of-way and the northerly
boundary of lands now of Witschi, formerly of H. Alvin Smith and �-
Dorothy R. Smith. Said 50 foot right-of-way is more particularly
bounded and described as follows:
BEGINNING at a concrete monument set at the southeast corner of the
said 50 foot right-of-way;
running thence from said point of beginning South 43 degrees 36 minutes
00 seconds West 52.53 feet along the northerly line of lands of Witschi
to the southwest corner of the said 50 foot right-of-way;
running thence along the westerly side of said 50 foot right-of-way the
following two (2) courses and distances :
(1) North 28 degrees 33 minutes 30 seconds West 626.34 feet; and
(2) North 8 degrees 37 minutes 00 seconds West 936.28 feet to the
northwest corner of said 50 foot right-of-way and the southerly side of
New Suffolk Avenue;
running thence along the southerly side of New Suffolk Avenue, 51.59
feet to the northeast corner of said 50 foot right-of-way;
running thence along the easterly side of said 50 foot right-of-way the
following two (2) courses and distances
(1) South 8 degrees 37 minutes 00 seconds East 914.76 feet; and
(2) South 28 degrees 33 minutes 30 seconds East 601.45 feet to the
monument at the point or place of BEGINNING.
SUBJECT to an easement over the premises herein described with respect
to overhead utility lines for- electric power, telephone and cablevision
lines, location of which is shown on map of Otto Van Tuyl & Son, L.S.,
dated March 20, 1951, and survey by Van Tuyl & Son, dated July 31, 1972.
Said easement is subject to the right of the grantees, their heirs,
executors, administrators, successors and assigns, to relocate the ease-
ment herein described, provided electric power, telephone and cable-
vision services continue to be available without any interruption, and
without cost and expense, to the grantors, their heirs, executors, ' ad-
ministrators, successors and assigns. Grantees, their heirs., executors,
administrators, successors and assigns, to provide proper easements and
agreements for same in such form and within such time as may be required
by the Long Island Lighting Company, New York Telephone Company and-
Long Island Cablevision Corporation, their successors or assigns . This
paragraph and its provisions shall survive the closing of title and
shall be fully enforceable by action at law and/or equity by the
grantors, their heirs,. executors, administrators, successors and assigns.
SUBJECT to a right of way 30 feet in width, the southerly line of which
is bounded and described. as follows : BEGINNING at a concrete monument .
placed as a bound at the, northwest corner of lands of Martin Suter and
running North .74 degrees 53 minutes 40 seconds East a distance of

and thence running North 43 degrees 36 minutes 00 seconds East 114. 12
feet to a concrete monument placed as a bound at the southerly terminus
of the easterly. line of a 50 foot right-of-way heretofore described.
Grantors shall be given the right, if any., as and when the need arises
to secure potable water for premises retained and owned by the grantors
along any utility easement and/or right-of-way in the premises herein
conveyed.

This conveyance in behalf of H. ALVIN SMITH & COMPANY, INC. is made
with the unanimous consent in writing of all the stockholders.
BEING AND INTENDED to be the same premises conveyed to Martin Suter,
as to a' one-half undivided interest, as recorded in deed in Liber 3205,
page 327, and 'BEING AND INTENDED to be the same premises conveyed to
H. 'Alvin Smith & Company, Inc. , as to a one-half undivided interest,
as recorded in deed in Liber 7577, page 505.
