HomeMy WebLinkAboutLP-09/19/2017 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, September 19, 2017 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: Sam McCullough, Chairman Anne Murray Lillian Ball Eric Keil Will Lee Doris McGreevy John Simicich Members Absent: None Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Holly Sanford, Peconic Land Trust Project Manager Tom Foster, Orient resident Commencement:  The meeting began at 7:01 p.m. with seven LPC members present. Committee Minutes and Adoption:  Acceptance of LPC meeting minutes from September 5, 2017 MOTION made by Eric Keil, seconded by Anne Murray, to adopt the 9/5/2017 LPC meeting minutes. Motion carried: 6/0/1 (LPC members Lillian Ball abstained as she did not attend the 9/5/2017 LPC meeting) APPOINTMENT: 7:00 p.m. – Legal Advice from Counsel EXECUTIVE SESSION The LPC Committee entered into Southold Town Attorney William Duffy was unable to attend the LPC meeting as planned. Land Preservation Coordinator Melissa Spiro met with Mr. Duffy prior to LPC meeting and presented information pertaining to legal advice from him. END OF EXECUTIVE SESSION Land Preservation Applications and Inquiries:  SCTM #1000-79.-7-55 (REESE) Inquiry re: Property for sale; Status update Property for sale. Town Board did not refer this property to LPC to pursue.  SCTM #1000-100.-3-12 (KRUPSKI) Inquiry re: Property for sale; Status update Property for sale. Town Board referred this property to LPC to pursue. Town Engineers have recommended that part of the property be pursued to control stormwater run-off issues. Inquiries for Uses or Structures on Preserved Property  SCTM #1000-19.-1-1.4 (Town PDR Cullinane; Current owner: STEVE TENEDIOS) Request for Review from Planning: Site Plan for Tenedios Agricultural Barn Project status update LPC discussed Planning’s request for review of the Site Plan for Tenedios Agricultural Barn. LPC discussed sending comments and requesting additional information in order for the Committee to ensure that the proposed use of the property is in accordance with all terms of the recorded Deed, is consistent with both the agricultural value and the scenic value of the property and does not detract from, or adversely affect the open space and scenic value protected by the development rights purchase and easement. Response to Planning to include: The staking of the proposed building and a scenic view shed analysis to provide information o to assess visual impacts. The Committee discussed the importance of verifying wetland line and flood zone building requirement prior to the analysis. That in order to evaluate whether or not increases to the livestock use on this particular farm o will have adverse impacts to the natural resources protected by the recorded Deed, the applicant should be required to work with a qualified agency, such as NRCS or Suffolk County Soil and Water Conservation District, to develop a livestock best management plan and a detailed plan for the management of animal waste. That all uses must be in accordance with Chapter 70 definition of Agricultural Production. o That the deed contains specific restrictions regarding the use of the 20’ right-of-way to Main o Road and the 20’ right-of-way to Narrow River Road. Land Preservation Coordinator Melissa Spiro to draft response to Planning for LPC review prior to submitting to Planning Board.  SCTM #1000-63.-1-1.11 and 1.12 (Town PDR Hubbard; Current owner: PLT) Request from PLT regarding proposed improvements Land Preservation Coordinator Melissa Spiro gave background information on the Town’s purchase of the development rights easement on this property that included the existing residential home located within the easement area, and the specific details of the recorded Correction Easement that dealt with the existing home. PLT Project Manager Holly Sanford presented PLT’s potential plan to demolish the existing home and replace it, in accordance with the terms of the recorded Correction Easement, with (1) a two story modular home (36’x24.4’) similar in size and appearance to the existing structure, or (2) relocating a 1747 historic building of similar size from a CR48 location in Southold. Public water (SCWA) will be piped in underground from CR48 running along the eastern border of the easement area to the residential site area. PLT will present formal request to LPC when PLT finalizes project. MOTION made by Eric Keil, seconded by Lillian Ball, that Peconic Land Trust’s initial proposals are consistent with the terms of the recorded correction easement.
