Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. Following up on that catastrophic loss issue. Is that going anywhere? SUPERVISOR RUSSELL: Yes, there is. What's the status now? MR. DUNN: Inaudible. SUPERVISOR RUSSELL: Yes, it is. MR. DUNN: Okay, that satisfies me. SUPERVISOR RUSSELL: We did. TOWN ATTORNEY DUFFY: Code committee. SUPERVISOR RUSSELL: We still have code committee issues to work out, but there are drafts, so it is moving. Southold Town Board Regular Meeting June 20, 2017 page 28 MR. DUNN: Okay, I would imagine over the last few weeks some of you would have gotten emails or calls regarding beach parking and beach issues. SUPERVISOR RUSSELL: Yes. MR. DUNN: It's getting crazy. Last summer, we spoke about RV's. I am going to go down a list of a couple of things. Last summer we spoke about RV's and you said that wouldn't happen anymore. That same guy is driving around with a sticker on. In addition, we now have one from California and last Sunday, not this past one, the previous one, I drove by Town Beach and there was an RV set up there with picnic tables and 20 or 30 folks. Now, if you guys want to allow that, you will do it against my opinion but that's your choice. But if you don't stop this, it's going to become a nightmare. I mean, do we want RV's in there or not? SUPERVISOR RUSSELL: Let me just say, if you see the RV's there, you don't see them for long which is why you see them at parking lots at King Kullen and other locations. We are doing the best we can to make them recognize that they shouldn't be there. MR. DUNN: But why are we selling them stickers? SUPERVISOR RUSSELL: What's that? MR. DUNN: Why are we selling them stickers? SUPERVISOR RUSSELL: That's an issue I will defer, that's a good question. MR. DUNN: The one that I spoke of from California, he could have (inaudible) because it's a pickup truck with a pickup camper. SUPERVISOR RUSSELL: Right. MR. DUNN: So legally that's a pickup truck. It's a Ford F 150 which many of us might drive. But it's a camper, it's functioning as a camper. The other one is a 40 foot long camper. And we all knew of this one last year and we spoke about it, it's got a new sticker. I saw it. SUPERVISOR RUSSELL: Look, the issue of the sticker, I understand, we should correct that. if I dropped the ball, that's fine. But I assure you, that camper is not there for long because we have been moving them.... MR. DUNN: They are never anywhere for long. SUPERVISOR RUSSELL: Well, MR. DUNN: I agree with you. You can't be a little broke in the definition of broke. When something is broke, it's broke and unless you fix it, it's going to continue to be broken and that Southold Town Board Regular Meeting June 20, 2017 page 29 segment of our system right now, unless we want to decide that that's fine. I personally think the town would do well do have maybe a few more campgrounds. COUNCILWOMAN DOHERTY: Is it in the code that campers can't park at the beaches during regular beach hours? SUPERVISOR RUSSELL: It's the fact that there's a glitch in the code that they can come in and get a beach sticker as a resident or as, I believe, a guest. COUNCILWOMAN DOHERTY: Yes. So what I am saying, it's not against the code to get a beach pass. MR. DUNN: Inaudible. SUPERVISOR RUSSELL: You can get a guest pass, seasonal guest pass. We need to specify in the code. I don't think campers were ever anticipated, so there was no reference to them. COUNCILWOMAN DOHERTY: As long as they are not staying overnight, they are not breaking the code. MR. DUNN: Things slip through the cracks. There's no question about it. COUNCILMAN GHOSIO: Well, if a family goes, let me just play devils advocate a little bit. A family goes camping and they stay at the campground out in Greenport but they want to go to the beach,the only way to get there........ MR. DUNN: If they don't have a car. COUNCILMAN GHOSIO: Right, if they are not dragging a car behind it, would be with that vehicle. Or if they want to go to the beach on their way out on Sunday and then are on their way home... MR. DUNN: Okay but are we going to leave a big hole in our structure to help that one family or are we going to say to the campgrounds, maybe you should have a shuttle. I mean, the bottom line, certainly at the parking lot by me, there's a lot of large vehicles that use that lot as a turnaround and I understand why. If you go down Mill Lane to any of the private roads and you make a wrong turn, there's no way to make a u-turn but that parking lot, hey, we have got to be human and we have got allow people to do human kinds of things but when somebody brings a camper, what are they doing with all their garbage? You know, I saw at Town Beach at Soundview, this camper, there must have been 12 people there. Even if they did it properly, that's, I think that's an unfair burden that you are allowing on the people who do pay for sanitation removal. I mean, it may seem petty but how big are we going to allow it? Where do you stop it? If it's just these three people, I don't think it's a problem, I can tell you that the person with the 40 footer comes to Mill Lane, they park it next to (inaudible). He does a nice job, he has a dog, you wouldn't know it. The dog is quiet as the day is long. He's neat, he Southold Town Board Regular Meeting June 20, 2017 page 30 doesn't leave any garbage, doesn't make any noise. I mean, if you were going to allow it, this is the perfect candidate to have it for. The question is, do you want to allow it or not? Because where does that go? COUNCILMAN GHOSIO: Well, I would prefer that over the transient .... MR. DUNN: I am sorry? COUNCILMAN GHOSIO: I would prefer that over the transients setting up tents and barbecues on the beach. MR. DUNN: On the beach, oh, certainly. COUNCILMAN GHOSIO: And leaving all their trash behind. MR. DUNN: There was someone out there with a tent today and just so you know, our code clearly says tents are not allowed. They have to be open. You can put a shade tent up, you cannot put enclosed tents on town beaches. That's one issue. The other thing is the people that are parking without permits at all. Now, you can't enforce that from your car. You cannot do it. it is just not humanly possible. You have to get out of your car and look at the front of the car. I don't want to be critical of any individuals but some people don't do that. I mean, I saw the traffic guys, I guess they just started? SUPERVISOR RUSSELL: Yes. MR. DUNN: I guess they are a little more diligent because... SUPERVISOR RUSSELL: That's what they are hired for. MR. DUNN: They are looking for future work and they want to come back, it's a nice job for a college kid. So, they'll be a little better. SUPERVISOR RUSSELL: I just,just so you know, I just met with the Chief a few days ago to talk about this issue, Bill Duffy, myself and the Chief. The TCO's are just up and running. It's just early in the season for them. They are very diligent, in fact, the Chief estimates they can write anywhere between 120 and 150 violations a week is it? TOWN ATTORNEY DUFFY: A day. SUPERVISOR RUSSELL: A day. TOWN ATTORNEY DUFFY: On a weekend. SUPERVISOR RUSSELL: So, it's a big town. They are just getting out there now and they are getting active. Southold Town Board Regular Meeting June 20, 2017 page 31 MR. DUNN: Well, that's good but last Board session you passed a rule May 1St to September 30th I believe... COUNCILMAN GHOSIO: October 30th COUNCILWOMAN DOHERTY: We didn't pass it, we set a public hearing for. MR. DUNN: Well, whatever was done, but anyway, there's an effort. That's my point and well, maybe the big guys have got to do it too. I know it's not high crime but it does have an effect. You know, nobody thought that the wineries were going to lead to anything either but we have a memorial at Depot Lane now for the girls that were killed and for someone that was in here, I listened to Mr. Shipman telling you for four years that this was going to happen before it happened and it did happen. There's a lack of legality or a lack of respect for the law that starts at that point. If we can just park wherever we want, well, why can't we do this and why can't we do that? It just escalates. Last week, there were two arsons on Mill Lane. There is a level of lawlessness that's creeping in. And it starts with petty little things like illegal parking. I mean, the (inaudible) came up with that broken windows concept. It's true and if that's not stopped and these people aren't made to know that you can't do that, it goes on. There are some, specifically by us. There's a lot of people complain about fishing. I can't fault a guy for fishing, and I don't think you can stop them but they have to have a sticker and they can't have a fire and they can't have this, so it means somebody has to go on the beach and say you can't do that and here's a summons for you. And that will stop them. I mean, I looked out my window yesterday morning, Sunday morning and there were 35 people in front of my windows and I can only see to the jetty. On the other side of the jetty, it's doubled again. That's 5:30 in the morning. And that's just not all legal. It's the cars. If the guys want to walk, I fully applaud that. SUPERVISOR RUSSELL: Some of the rules, it's not just needing a sticker, it's whether they should qualify for a sticker at all. The Parks and Recreation Committee is actually undertaking the issue of stickers, passes and all of those things now. I think you are getting a sense from the Board as part of the discussion I am getting a sense, that there are some instances where it should be residents only, period. I would argue that night fishing would be, should be just for residents, period. The fact of the matter is, we have no obligation to provide resource management to people beyond the borders of Southold Town. I know Jill and the Board support creating a residents only standard for the ramps that are through the Town. You know, it's not easy to pass the law, we have to think about the enforcement and all of that. But those are the types of issues we are discussing now. MR. DUNN: I am fine with that, if you want to go there. I mean, the residents are the people that pay for these things, the residents are the people that should be able to use it, and, but the residents have to be respectful, too. SUPERVISOR RUSSELL: That's true. Southold Town Board Regular Meeting June 20, 2017 page 32 COUNCILWOMAN DOHERTY: Yes. I mean, this is a small thing but at the last budget, we asked the Chief to add another TCO. And he did in his budget this year, so we have one more TCO this year. I know it's small but you know, we can only do what we can.... MR. DUNN: It might be time to start thinking about a jeep and or some kind of beach vehicle. SUPERVISOR RUSSELL: We had the quads out just over a week ago, we had the quads out. They did a sweep of a large area. I think they were going to work out east next. But they were the mid-side of town. They, the bay constables coordinated with police officers and coordinated with guys on quads. Officers on quads. They issued quite a few summonses. He knows it's the time of year that we need to step up enforcement on the beaches. I am trying to recall, he set it up in the geographic quadrants. I don't remember the first section, the first reach that they did but I can get the information for you. But it is all part of a plan, to go throughout the community, throughout the beaches to step up enforcement because we know what's been happening over the past few years. But he had the quads, he had the bay constable. A coordinated effort. MR. DUNN: I talked to you about this, and having discussed this, the garbage issue. People that think they have got some kind of right to put their garbage and it's not only weekend people. SUPERVISOR RUSSELL: It's not at all. I agree. Business owners are locking their dumpsters. MR. DUNN: Guess why? SUPERVISOR RUSSELL: Yeah, because of the idiots. MR. DUNN: If someone comes and unloads garbage from their cars and puts it into a public can that they are not supposed to put it in, they are then using that car in the commission of a crime. And that car in fact, can be impounded, can it not? TOWN ATTORNEY DUFFY: I guess technically it could, yes. MR. DUNN: The city does it all the time. They have a serious problem with the dumping issue. They don't even find a garbage can, they dump. You do that twice and believe me, a lot of that will stop. SUPERVISOR RUSSELL: Well, you know, we have a $1,000 minimum fine for that and we have.... MR. DUNN: How many have we given out? SUPERVISOR RUSSELL: Well, that's another thing, if we can write one ticket we would send a message. The difficulty, as you know, is the ability to monitor over 100 road ends with cans. It becomes really difficult. These aren't people that are hanging out for an hour, they are not loitering. They are... Southold Town Board Regular Meeting June 20, 2017 page 33 MR. DUNN: The police can only be where they are, the people who can write those tickets can only be where they are. And I believe, I told you about one experience that I had. two cars, parked head to head, whether they were having a supervisor, whatever meeting they were having, I don't know what people do when they do it so I am not going to accuse them of doing anything wrong, but two cars, two officers that were (inaudible), that guy was known, he was a problem in the community. They are gone now. But they can do this, certainly, can TCO's do that? SUPERVISOR RUSSELL: I don't know that they can. They don't have the authority for that. COUNCILMAN DINIZIO: Code enforcement can. MR. DUNN: Okay, but the TCO's are at the beach more, once the summer comes, they are at the beach more than the regular police. COUNCILMAN DINIZIO: I don't think they can. SUPERVISOR RUSSELL: No, they can't. TCO's are generally trained for two things, traffic control and they go and get training for that and they write what are called S tickets, those are typically tickets that... MR. DUNN: Well, I don't know if you'd want to look into that. like I say, they are at the places where this is more of a problem anyway and I am not saying that Goldsmiths is any different, I am sure Goldsmiths is the same as any town beaches or rec areas, it's probably even worse than some of the rec areas because there's no houses, so that's.... SUPERVISOR RUSSELL: Just regarding the garbage, we agree, lord knows it's been a discussion for some time and I don't think it's a discussion that the town isn't addressing because we don't want to, we've been trying to find a solution, with over 100 or so cans out there, some in very remote locations. We are trying to develop an enforcement component, it's been very difficult and that might be an instance where a police officer should have done it, I agree. But almost all other cases, no one is there. MR. DUNN: We can't focus our police department on ... SUPERVISOR RUSSELL: But I would welcome any idea to help us enforce the no littering and the no use of garbage cans. MR. DUNN: Write them tickets, make it a point. SUPERVISOR RUSSELL: I need to catch them. I need a suggestion on how to catch them. Not just write the ticket but how to catch them. And that's proven to be very difficult, we have it at our preserves, we have it at our road ends, we have it at our beaches. It's a town wide plague. That's, we are just trying to manage it. Southold Town Board Regular Meeting June 20, 2017 page 34 COUNCILMAN GHOSIO: You can't legislate good manners. MR. DUNN: No, you can't. COUNCILMAN GHOSIO: If people are going to dump,they are just going to dump. SUPERVISOR RUSSELL: We have got to catch them. We do try. We actually recently on Facebook, a local resident, post a picture of a lady using the dumpster at the IGA and when he tried to confront her, she got confrontational and completely ignored him. Of course, that's a... MR. DUNN: Oh, sure. I have heard some people call me some things I wouldn't repeat here. COUNCILMAN DINIZIO: Well, Bob, you have to catch them in the act. This particular woman was caught on video doing it, her excuse was she is a taxpayer, that was her explanation. That's what she thinks she can do. SUPERVISOR RUSSELL: I am a taxpayer she said, well, you are not a taxpayer of the IGA. You are not paying the IGA tax. COUNCILMAN DINIZIO: I just don't understand that. I go down to the end of my beach every day, I walk up and down those steps. My beach is pristine because I pick it up just about every day and when I look in the garbage cans, we have two now, there's not anything in those garbage cans that would have been on a beach. MR. DUNN: Right. COUNCILMAN DINIZIO: Not a thing. There's newspapers, pizza boxes, none of that stuff belongs. MR. DUNN: There was a lot of noise by me two weeks ago, and it's every year, there's, I don't know if you guys know about it but there's a hidey hole over there and every year for two weeks prior to graduation, the seniors party. And you know, they clean up, so if they leave their stuff in bags and there's a few more bags, I am all for it, that's fine. There's going to be instances that you are going to find things that normally wouldn't go in there but when you go down there and you see things like broken kitchen chairs, things like that, you know... SUPERVISOR RUSSELL: A couple of years ago, we decided to pull back and not put cans in certain locations because we felt like it was a magnet and inviting people and we had at least one instance because it was known to have a can historically and we removed the can, they were just putting the garbage there anyway. Like it was a dumping site not related to the cans. MR. DUNN: Pete used to take more of the cans in and that always used to happen, soon as he did, it would just be a pile of garbage. Okay, I don't want to beat it up. You get the point I am making. Southold Town Board Regular Meeting June 20, 2017 page 35 COUNCILMAN GHOSIO: I am hoping the big belly program, as we get more of those big belly cans, that it would alleviate that because they can handle much more. MR. DUNN: People may find them easier to use. SUPERVISOR RUSSELL: If we can get them at the beaches, it would certainly reduce our need to pick up the garbage but it doesn't address the one thing, that they are doing it at all. so we are still in the garbage business, that we don't want to be in. but let me just tell you two things, first of all, I have campers on for the next work session and also what I will do is I will reach out to the Board and start scheduling for the catastrophic loss. We had draft legislation, the one issue we had was basically the rebuild, can you rebuild to your old standard? Do you have to rebuild to the state standard, fire code and building code standard? MR. DUNN: Building code? SUPERVISOR RUSSELL: Yes. MR. DUNN: I don't see how you couldn't have to build to the new code. SUPERVISOR RUSSELL: But then again, in the legislation, if you have to elevate the new structure to comply with FEMA, is that a new structure or is in a replacement in kind of the old structure? MR. DUNN: Okay. SUPERVISOR RUSSELL: It's a little bit to work out, to finesse there. MR. DUNN: I mean, fire codes and... SUPERVISOR RUSSELL: That we have to comply with. MR. DUNN: Not building with 2x4 floors... SUPERVISOR RUSSELL: That's right but you might have to expand the upstairs because of the ceiling heights. Built in the old days, the new ceiling heights, you may have to elevate the roof line just to comply, so at what point,just to comply with state code and FEMA code does the structure go from to pre-existing, non-conforming, replacement in kind to a new structure? You know, we are trying to allow you, if you've got it, you are allowed to rebuild it... MR. DUNN: Okay. SUPERVISOR RUSSELL: But that's not always practical or the application of that, it's not always practical because of the state building code and FEMA and those other things, so we are working on it, some sticking points but we are working on it. Southold Town Board Regular Meeting June 20, 2017 page 36 MR. DUNN: Okay. COUNCILMAN DINIZIO: Well, in our own code it even says you can't expand a non- conformity. And the problem is that when FEMA says that you have to raise that house because of flooding, the Zoning Board, I can tell you has a problem with now, is that raising the structure? In other words, are you going higher into the non-conforming area? You are expanding your non-conforming and that is a sticking point that that needs to be clearly defined in the code. I have my own opinion on it but can I ask you one thing, because I am not too sure about, what is your objection to the guy with the RV in the parking lot, I am missing something here. MR. DUNN: Anybody that's doing it today... COUNCILMAN DINIZIO: No, I just don't know what... MR. DUNN: It's what they are bringing in the future. COUNCILMAN DINIZIO: Yeah, but what, the guy comes, he parks, he goes to the beach. It's a 40 foot thing, what's the, where is the? MR. DUNN: Well, there's at least one guy I know that lives.... COUNCILMAN DINIZIO: Okay, so is it there overnight? Is that what you are saying? MR. DUNN: At times. COUNCILMAN DINIZIO: Well, then that's a problem. I didn't get that. I got more he was just down there. MR. DUNN: And then there's, to be honest, he tries to be nice, he parks it back in the corner... COUNCILMAN DINIZIO: Yes, but how long is he there? I mean, is it all day and night? MR. DUNN: All day, several days. COUNCILMAN DINIZIO: Oh, okay, so it's an overnight kind of thing. MR. DUNN: I have never seen him overnight. COUNCILMAN DINIZIO: Oh, okay. MR. DUNN: In answer to your question, I think your underlying, I have never seen him overnight. COUNCILMAN DINIZIO: Okay, so he stays all day and then he goes somewhere else. Southold Town Board Regular Meeting June 20, 2017 page 37 MR. DUNN: Stays there all day but you know, there's a house right next to that that someone just paid $975,000 for. And part of what they bought is the view, and part of what their view is a parking lot. I just think it's bad precedent to allow camping or a part of camping in you know, beach parking lots. Aside from the fact, if you are out on a busy weekend, how do you turn that thing around? SUPERVISOR RUSSELL: There is an issue that I will raise too and I agree with Robert, is how many parking spaces are you going to let one singular person gobble up and then.... MR. DUNN: And last year, that was the only one I saw and the only question I had was, do we allow campers to get beach stickers? That was my question then. SUPERVISOR RUSSELL: And there's a reason we don't allow cars with trailers in certain parking spaces, because they take up too much room. MR. DUNN: Right. And now I've seen two with stickers and the third one, and the third one that I saw last week at Town Beach by Soundview had two tables out, two long picnic tables out and it was probably a family who decided somebodies birthday party they were going to have at the beach. Which is fine, but you can't take up three spaces for it and is the town ready to take up the liability if somebody comes in with a canister of 1p gas and maybe park it in the parking lot and are cooking with it, those RV's are notorious for blowing up. I mean, I am not against them, I really think it would be a good idea if the town had more camping available. SUPERVISOR RUSSELL: I do, too. MR. DUNN: But I just don't know that it should be on our beaches. And then what happens, this guy, as I said, really nice, he's got a dog, doesn't make a peep. The only reason I knew he had him was I walked by once and the dog sat there just looking at me and he was a pit bull. But some of them come (inaudible) where do you stop? Come to a beach function and they have a fire, a bon fire. And what do they do with the (inaudible). That's it. Thank you. COUNCILMAN DINIZIO: Thanks, Robert.
