The alterations and additions to the dwelling roof must include the proper leaders and gutters and drains. 2. A dewatering drywell for the "as-built" pool shall be submitted and approved. 3. The applicant must comply with requirements of Chapter 236 of the Town's Storm Water Management Code 4. SCTM# 1000-137-4-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action INCONSISTENT with Policies 4 and 6 of LWRP and therefore INCONSISTENT with the LWRP. The structures are located within a FEMA flood zone AE base flood elevation 6'. It is unknown if the first floor elevation of the dwelling complies with FEMA standards. If the dwelling does not comply with the standards the threat of property loss from flooding is high due to the close proximity to the waterbody. There is no ability to relocate the structure out of the AE flood zone. The as built, large, deck, pool and other structures did not benefit from Board of Trustees review or a Wetlands Permit. The deck is setback 6.6' from the bulkhead and all structures are extremely close to the wetlands/waterbody. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 2, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards, The LWRP Coordinator issued his recommendation dated July 19, 2017, Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is the coordinator's recommendation that the proposed action is INCONSISTENT with the following LWRP policy standards and therefore is INCONSISTENT with the LWRP: Policy 1 —The front yard, rear yard and lot coverage does not enhance community character and does not foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location and minimizes adverse effects of development. Policy 4.IA—Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The coordinator warns the possibility of property loss because structures are located within a FEMA Flood Zone AE base flood elevation six(6)feet. Policy 6.3 — Protect and restore tidal and freshwater wetlands. The coordinator cautions that structures are extremely close to the wetlands/waterbody and indicates that a dewatering drywell for the as-built pool is not shown in the plans. The swimming pool has the benefit of area variance 3283 dated November 1, 1984 allowing the swimming pool in a side yard location and certificate of occupancy z 15424 dated November 25, 1986. The applicant further has the benefit of a trustees wetland permit number 7509 dated March 23, 2011 granting an existing dwelling, deck (without shed), in ground swimming pool with the condition drywells are installed to contain roof run-off in accordance with Chapter 236-Stormwater Management of the Town Code, and as depicted on the survey stamped approved on March 23, 2011. The existing permitted structures and the trustees wetland permit therefore bring the project into consistency with the LWRP and make the project consistent with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 8,080 square foot parcel in the Residential R-40 Zoning District. The parcel measures 100.00 feet along the northerly property line fronting Stillwater Avenue, measures 84.55 feet along the easterly property line, measures 100.28 feet along the southerly property line adjacent to Eugene's Creek, and measures 77.05 feet along the westerly property line. The existing single family home consists of a one and one-half story frame dwelling with an attached garage and attached side yard deck with an in ground swimming pool with fencing and large green hedges blocking sight to the pool and decking from neighbors on the northerly and easterly portions of the property (front and side) on the survey prepared by Alphonse Pesce,Jr.,L.S.updated on March 30,2017. BASIS OF APPLICATION: Request for Use Variances under Article XXII, Section 280-116B and Article XXIII, Section 280-124 and the Building Inspector's April 10, 2017, Amended June 9, 2017 Notice of Disapproval based on the application for a permit to construct additions and alterations and to legalize an"as built"deck addition to an existing single family dwelling, at: 1) located less than the code required minimum front yard setback of 35 feet,2) located less than the code required minimum rear setback of 35 feet, 3) Iocated less than the code required minimum side yard setback of 10 feet, 4) more than the code permitted maximum lot coverage of 20% at 5705 Stillwater Avenue,(Adjacent to Eugene's Creek), Cutchogue,N.Y. SCTM#1000-137-4-4. RELIEF REQUESTED: The applicant requests area variances to alter the one and one-half story frame dwelling to a two story frame dwelling by adding a dormer over the 2nd floor garage and adding a covered porch over an existing brick and concrete platform, and to legalize an existing "as built" deck which surrounds an existing in ground swimming pool as shown on the updated survey dated March 30, 2017 prepared by Alphonse Pesce, Jr., L.S. The requested additions and alterations will result in a front yard setback of 18.2 feet, a rear yard setback of 16.8 feet,a side yard setback of 6.8 feet and lot coverage of 29.7%. ADDITIONAL INFORMATION: Notices to owners of adjacent parcels were mailed as required and no comments were received. A prior decision by this Board,Appeal No. 3283, dated November 1, 1984 granted an area variance to place an in-ground swimming pool in the front yard. According to the current owners,the decking from the residence side yard that surrounds the pool already existed when they purchased the property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August,3,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: aTown DSEP Southol Page 3,August 17,2017 #7072,Landers Family Trust SCTM No. 1000-137-4-4 1. Town Law§267-b(3)(b)(1). Grant of the variances will not produce and undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of a mixture of single and two story year round and seasonal houses. The front and side yard where the- pool and deck are located are surrounded by mature plantings and a fence, and are not able to be seen from the front and side of the property. The addition over the garage will enable the continuation and redesign of the existing roof to accommodate the interior design of the second floor. 2, Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the area variance. The "as built" deck already existed. The addition and alterations will afford the owners the space they request in order for their family to enjoy their residence. As previously mentioned the Board approved the in-ground swimming pool in the front yard in a November 1, 1984 decision. The applicant will seek additional approval by the Town's Board of Trustees for distance of the "as- built"structures to the bulkhead. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematical substantial,representing 484 relief from the code for front yard setback, 52% for rear yard setback, 32% for side yard setback and 48.5% from the code for lot coverage. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions of the neighborhood as long as the applicant complies with requirements of Chapter 236 of the Town's Storm Water Management Code and the Board of Trustee regulations and recommendations set forth in Trustee permit conditions. 5. Town Law 067-b(3)(b)(5) The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge;of the limitations on the use of the parcel under the zoning code in effect prior to or at the time of the purchase. 6. Town Law 276-b Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the alterations and additions to the residence and the legalization of the "as built" deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried, to GRANT the area variances as applied for, and shown on the survey prepared by Alphonse Pesce, Jr. L.S., last updated March 30,2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The alterations and additions to the dwelling roof must include the proper leaders and gutters and drains. 2.
