Mattituck,NY SCTM No. 1000-144-2-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 14, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 13,940 sq. ft. parcel located in the R-40 Zoning District. -The property measures 100.00 feet to the westerly property line along Sigsbee Road, 140.00 feet to the northerly properly line, 100.00 feet to the easterly property line and 140.00 feet to the southerly property line. The parcel is improved with a one story frame dwelling and a detached accessory garage as shown on a site plan prepared by Mark Schwartz, Architect, dated April 19, 2017. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's May 8, 2017 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling, at: 1) less than the code required minimum front yard setback of 35 feet; at: 1305 Sigsbee Road, Mattitupk, SCTM#1000-144-2-6. RELIEF'REQUESTED: The applicant requests a variance to construct a covered porch on the front of the dwelling having 96 sq. ft. in area with a non-conforming front yard setback of 33.8 feet and a one story extension on the northerly side of the dwelling having 510 sq. ft. in area, which would create a non-conforming front yard setback of 31.8 feet where the code requires a 35 foot minimum setback. ADDITIONAL INFORMATION: The subject subdivision was created many years before zoning, around 1926, and most single lots are one quarter acre-in size or less. The majority of the subdivision is built out, with the exception of a few single lots which are merged with improved homes. Page 2, September 21, 2017 #7087, Peck and Corbett SCTM No. 1000-144-2-6 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Sigsbee Road is improved with 63 homes with varied front yard setbacks and non-conforming lot sizes and lot widths. The subject parcel is twice the size of many of the existing lots in the immediate neighborhood. 2. Town Law &267-b(30)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant could conceivably move the proposed one story addition further toward the rear of the home and reduce the depth of the proposed front porch to a depth of 4 to 5 feet; however, the applicant's representative described difficulty in reconfiguring the alterations when reviewing that options because of the existing floor plan and layout of the home and the need for a porch depth that is functional. 3. Town Law §267-b(3)(b)(3). The variance granted herein for the proposed one story addition is mathematically substantial, representing 9.4 % relief from the code. The variance granted for the proposed front porch addition is not substantial representing 3.4 % relief from the code. However, these variances are mitigated by the many non- conforming front yard setbacks on Sigsbee Road and the fact that the Board of Appeals granted a front yard setback of 24 feet for a covered porch addition in April of 2016 (Appeal No. 6935) for a residence at 1330 Sigsbee Road which is almost directly across the street from the subject property. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The overall objective of the Zoning Board is to grant the smallest variance possible. 6. Town Law X267-b. Grant of the requested relief isthe minimum action necessary and adequate to enable the applicant to enjoy the benefit of 96 sq. ft. covered porch and a 510 sq. ft. single story addition to the dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dantes, and duly carried, to GRANT the variances as applied for, and shown on the site plan prepared by Mark Schwartz, Architect, dated April 17, 2017. Page 3, September 21, 2017 #7087, Peck and Corbett SCTM No. 1000-144-2-6 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. In your letter you explain that during constructing additions and alterations that were previously approved by variance relief,the existing floor joists and girder structure was not level, so the owners thought that an upgrade made sense. Your letter further explains that the owners did not realize that demolishing the frame structure would create any issue. We reviewed your letter and the Zoning Board of Appeals determinations No. 7087, dated September 21, 2017. The applicant was granted relief for less than the code required front yard setbacks from the property line for additions and alteration to an existing single family dwelling. No demolition of entire structures was proposed or anticipated. Moreover,a demolition of an entire structure is not considered an alteration. It is the Building Department's assessment that once a structure is demolished, the corresponding certificate of occupancy will be extinguished, a notice of disapproval shall issue, and an area variance will be required to rebuild. This decision is consistent with other determinations we have issued to applicants having identical circumstances. As a result,the proposed change is not de minimus in nature. Should you wish to pursue the rebuilding of a single family dwelling, you will need additional variance relief with a new application and a public hearing. The Owners felt that since the existing 2" x 6" floor joists and 3-2" x 6" girder structure was not level that un upgrade made sense. They did not realize that demolishing the existing wood frame structure would create any issue at all. I had no knowledge they were planning to demolish,or that it actually was demolished,until I got the call from Owners after they received the Stop Work Order. They have added an area way for an egress window in the basement. Other than that,the perimeter and the proposed plans and elevations will match the ZBA approved plans.
