Lanos PROPERTY LOCATION: 460 Horton Avenue,Mattituck,NY 11952 SCTM: 1000-141-2-7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 6, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,416 square feet residential parcel located in the R40 zone and measuring 100 feet along Horton Avenue with the eastern lot line shared by a residence measuring 120 feet to the southern lot line shared by another residence measuring 100 feet to the western lot line shared with an unimproved residential lot measuring 100 feet. The lot is'improved with a single-story ranch house with wood deck and a small frame shed located in the rear-yard as shown on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC and dated March 1, 2017. BASIS OF APPLICATION: Request for a Variance under Article III, Section 280-15 and the Building Inspector's April 13, 2017, Notice of Disapproval based on an application for a permit to construct an accessory garage, at: 1) located in other than the code required rear yard; at: 460 Horton Avenue,Mattituck, SCTM#1000-141-2-7. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage measuring 12 feet by 20 feet with a ridge height of 14 feet in a side yard, where the Code requires accessory structures to be located in the rear yard. ADDITIONAL INFORMATION: No immediate neighbors or Town residents spoke at the public hearing in support of or against this application. Patricia Moore, Esq represented the applicant and indicated that given lot constraints including the location of an existing driveway, complaint shed and access to side or kitchen door, the proposed side yard location is the only feasible place to locate the proposed addition and that attaching the structure to the residence would cause the loss of a side window limiting natural light and ventilation to the house. She Page 2, September 21, 2017 #7081, Lanos SCTM No. 1000-141-2-7 further added that the proposed structure would have electricity for interior/exterior lighting and gutters and leaders for storm water management. The proposed accessory structure is to be located 5.5 feet from the side lot line at the closest point and will have a front yard setback of 45.4 feet which is greater than the front yard setback of the principal dwelling. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 7, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds.the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Horton Avenue is a quiet residential street running parallel to the north of County Route 48 (CR48), also known as North Road, a major Town artery. It is accessed to the west by Shirley Road and to the east by Westphalia Avenue which services this residential neighborhood of modest single-family homes of varying lot size, setbacks, age, style and design. The proposed non-conforming side yard location of the accessory garage is not characteristic of this neighborhood, although many residences have detached accessory garages, including the neighbor immediately to the east. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. While the applicant could attach the garage to the residence it would cause unnecessary hardship in the loss of a side window, limiting natural light and ventilation to the house. Moreover, locating the accessory garage in a compliant rear-yard on the east side of the lot would require the driveway to be relocated and would encumber access to the kitchen side door located on the west side of the residence. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, there is an existing driveway facilitating access to the residence's kitchen and the .proposed accessory structure will have a front yard set-back greater than the existing house. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Kenneth M. Woychuk, Land Surveying, PLLC, and dated March 1, 2017 Page 3, September 21, 2017 #7081, Lanos SCTM No. 1000-141-2-7 Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties, if granted because: The applicant has a modest house with no garage. The garage is proposed close to the kitchen entrance, at the end of the existing driveway. Most of the homes on Horton Lane have detached garages. Due to the existing location and angle of the house the proposed garage is in the side yard of the house. 2. The benefit sought by the applicant CAN NOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: If the garage was attached, the side yard setback would be non-conforming. The owner is getting older and needs to have access to the garage in winter. The garage is most convenient and functional in the side yard. 3. The amount of relief requested is not substantial because: The setback to the side yard is 5.5 feet which allows for access around the property and the easterly setback is 23.G which allows emergency vehicles to pass easily. 4.
