For reference, the property is owned by Grace Burr Hawkins. I have three concerns with regard to building a house on this lot. • The lot is close to a large wetland area at the end of the cove. Darby Cove is a very protected area and full of wildlife that use these wetlands. Aren't these wetlands protected by D.E.0 regulations for a reason?Past experiences and science have established guidelines to protect fragile areas. Should they be ignored in this case? • The site plan calls for a house to be built around 35 feet from the water. This, I feel is much too close to the delicate shoreline. When I was growing up in the 1950's there was a road that followed the shoreline. Now the road is washed away as the high tide covers it right up to the embankment. Human activity does have an adverse effect on the shoreline. This is a small, fragile area. A much larger setback is required. • I also have concerns about installing a septic system in conflict with limits set by prior experience and research. Is there enough distance from the cove so that there will not be an impact on the cove ecosystem? We presently have only a five homes on the cove. Will this be the additional load that will break the proverbial "camel's back" and send the cove ecosystem into decline? My family and I have lived on the Peninsula and Darby Cove since the early 50's and enjoy this pristine environment. We value the wildlife that uses its wetlands. We expect that current federal, state, and town guidelines and rules will be followed. We are very much against a new building being erected so close the wetlands and the coastline. For reference,the property is owned by Grace Burr Hawkins. The lots in question are a wildlife refuge of the first quality. Osprey, owls, ducks, egrets, kingfisher, song birds and many small mammals make their home on this land amid the majestic stand of oak, ash, cherry and maple trees. In addition, it is an outstanding example of how the glaciers carved out the landscape on Fishers Island leaving moraines, boulders and ridges. I urge you to consider the applicable government regulations that oversee the construction of buildings on a unique wetland such as this. Additionally I appeal to you to reflect on the possible degradation of Darbies Cove due to the construction activities and the placement of a septic system on the property. The Town of Southold has a world class reputation as a place where protection of the environment is a priority, I ask that you to continue this legacy. I request that you visit this location before you make a decision. Hike through the woods and camp out overnight like I did as a boy. This location is an irreplaceable natural heritage of the island and should be left pristine for future generations to enjoy and appreciate. I i AUG 2 1 2006 Public Hearing: August 23,2006 TSod',o;d iccp, Dear Board Members: I am writing to request you to consider leaving the above waterfront lots situated on Darbies Cove,Fishers Island in it's natural state. The escalating value of Island real estate has resulted in properties being considered as investment opportunities. Seasonal owners are renting their homes when not in use for long and short term rentals. This has the effect of increasing the overall seasonal population. The goal of the Fishers Island Growth flan outlined by the Fishers Island Civic Association is guiding development that adversely impacts the overall infrastructure and fragile environment of the island. Concerned stewards of the island are making a conscious effort to maintain a residential community with little or no seasonal tourism in order to protect the island's natural environment. Fishers Island consists of mainly summer residents with only a small year round population. Most of this nine mile long, half mile wide island is preserved in its natural state. In winter, Osprey nests are a more common sight then people. Protected bays and freshwater ponds make Fishers Island a favorite stop for migratory birds, seals inhabit the rock-lined beaches. Unlike the rest of Suffolk County Fishers Island is a haven for hikers. Construction would harm the rural nature of Peninsula Road. Lots 71 -74 are located on a dirt road with limited parking. Clearing of this property, construction vehicles and parking would impact this area. Building permits have been denied in the past for Peninsula Rd by the Town of Southold. Please visit this site to see the varied wildlife using Darbies Cove as their home and nesting place. Any additional boat dock construction at this site would impact the bird and marine life. MCGREEVY: Also in consideration on your part by moving the cesspool out of our jurisdiction it has to be 5 concern the fresh water to move it that far over. TRUSTEE KING: I had measured where we located it and it 6 was 100 feet from either way. TRUSTEE BERGEN: Correct. 7 MR. JUST: Because it's getting squeezed in a little bit of a triangle there. 8 TRUSTEE BERGEN: The LWRP review found it inconsistent in that the structure setback is 48 feet from the wetlands and 9 there is a minimum of 100 called for in the code and I think, and, again, I'm talking about, I think we tried to address 10 inconsistency by moving the leaching pools, the septic system out of the, over 100 feet out so it s outside of our 11 jurisdiction. I don't know that it's possible to move the entire residence another 60 feet, so. 12 if there are no other comments from the board I make a motion to close the public hearing. 13 TRUSTEE KING: Second. I'll make a motion to approve the application of NOL, LLC 15 for a wetland Permit to construct a single-family dwelling with the condition that there is new surveys produced to show 16 the movement of the septic system to outside our jurisdiction, the addition of the accessory structures or buildings as 17 as-built, and then hay bales, staked hay bales around three sides of the property, as we discussed. And the new plan will 18 also show the buffer that you referred to that will be around all the waterfront, including the freshwater wetlands. 19 Do I have a second? I realize the concerns of the CAC, the trustees and I just received yesterday a number of letters 2 that were faxed over by adjacentproperty owners. I asked the board to put this on hold for one month just 3 so we could explore alternative uses for the property, a little more than -- I just want to see what she could do with 4 the property and the concerns are valid that everyone has, for the most part. You know, I have no problems what they say. I 5 agree them. If we can put this on to September, no longer, and just 6 come back. TRUSTEE KING: Surprisingly, CAC recommended approval ; 7 recommends approval of the application, however they urge scrutiny to the location of the sanitary field. when I 8 measured, the furthest I could get the sanitary system away was 70 feet. 9 MR. JUST: It's a very, very small parcel . TRUSTEE KING: which is very, very troubling to me. The 10 whole, the piece of property is really -- that's a tough one. MR. JUST: Again, we want to look at some alternative use 11 of the property TRUSTEE KING: I think that's a good idea. I'll make a 12 motion we table the application. The slope of this line segment is 23 degrees,far less than the natural angle of repose.................................................................................................................9 II i s Introduction The following Coastal Assessment Report was prepared for Ms. Grace Burr Hawkins in support of her request for permit to construct a small dwelling along Peninsula Road, fronting Darby Cove on Fishers Island, New York(Darby Cove is the official geographic name used to identify the protected body of water south and east of West Harbor). Ms. Hawkins owns four lots adjacent to Peninsula Road (Lots 71-74), of which Lots 71 and 72 contain the footprint for the proposed structure. Residential development on the island is regulated by the local community, the Town of Southold, and the State of New York. The purpose of the report is to describe and evaluate Ms. Hawkins' property relative to adjacent natural resources and to determine if the site meets regulatory standards for development along the coast. Physical Setting Fishers Island is located at the eastern end of Long Island Sound, approximately 3 miles from the coast of Connecticut and 12 miles northeast of Orient Point in Southold, New York. The island is within the Town of Southold (Figure 1). It is approximately 5 square miles, extending almost 7 miles in length and averaging three quarters of a mile in width. Fishers Island Sound is located between the north side of the island and mainland Connecticut and the southern side is exposed to Block Island Sound. Regional map showing Fishers Island in relation to Long Island and Connecticut. 1 The island has a small year-round population of close to 300 people and a much larger seasonal ' residential resort community that reaches over 2000 during peak summer weekends. Most seasonal residents own property on the island and there is very little traditional tourism such as weekly rentals and day trips. The island has been divided into approximately 1000 building lots and about half of them have been developed (Town of Southold, 2004). The majority of residential development has occurred on the western end of the island. The western section also contains limited commercial, retail, recreational, and institutional land uses such as a public school, an inn and local bar, a seasonal general store, a small airfield, and a golf course. The island is only accessible by plane or boat. Regular ferry service is available between Silver Eel Cove and New London, Connecticut (Town of Southold, 2004). Fishers Island is underlain by the same crystalline Appalachian rocks that have formed the Connecticut coastline. Long Island Sound is a lowland area that was initially shaped by coastal plain rivers and has subsequently been modified by glaciations (Lewis and DiGiacomo-Cohen, 2000). The last North American glaciation reached Connecticut about 26,000 years ago and began to wane in Long Island Sound about 21,000 years ago. The southernmost position of this continental glacier is marked by the terminal moraine that exists along the middle of Long Island to the southwest of Fishers Island. A terminal moraine is the pile of glacial debris that is --; left at the margin of a glacier as it melts. Glacial debris consists of unconsolidated sediments such as sand,gravel, and boulders that are either derived from the region or have been carried there by southward moving ice. As the Wisconsinan continental glacier receded from its terminal position, it paused several times and deposited recessional moraines in Long Island Sound. Most of Fishers Island, as well as Plum Island and the northernmost part of Long Island, were formed as the Harbor Hill-Roanoke Point-Fishers Island recessional moraine. This elevated land formation dammed meltwater from the glacier and formed glacial Lake Connecticut on the north side of the moraine. The glacial lake expanded and eventually became the size and depth of modern Long Island Sound (Lewis and DiGiacomo-Cohen, 2000). The topography of Fishers Island is highly irregular(Figure 2). Some topographic features have a linear northeast-southwest trend similar to that of the whole island, whereas other features occur as isolated hills (Fuller, 1905). In some areas, elevations are broken and the topography consists of small isolated knobs alongside basin-like depressions. The broader linear elevation trends on the island appear to belong to older topography that had been exposed to subaerial erosion. Areas of irregular topography are composed of Wisconsinan morainal sediments and are covered by a thin layer of glacial till (Fuller, 1905). The composition of surface till varies depending on the origin of the morainal sediments. Till derived from the island is sandy and buff colored with few boulders. Till that is derived from mainland materials has a grayish color and is composed of clay and granitic fragments and often contains large erratic boulders. Site Assessment The Hawkins property was visited on January 9, 2009 between 9 and 11 AM to document site conditions. The property is located on the western side of Darby Cove, a small inlet in the 1 southeastern part of West Harbor(Figure 2). Winds on the day of the site visit averaged about 10 knots from the north-northwest,with gusts reaching 24 knots(Figure 3). Although waves in i 2 Fishers Island Sound and Block Island Sound ranged from about 2 to 4 ft, surface water in Darby Cove was calm. Tide was falling throughout the site visit. The property is composed of four lots located east of Peninsula Road (Figure 4). Each lot abuts the road and cove tidal wetlands and is approximately one-tenth of an acre. The elevation of the road abutting the property edge is approximately 21 ft (relative to the National Geodetic Vertical Datum of 1929 [NGVD]). In this area, NGVD is about 0.9 ft higher than mean lower low water(MLLW). The property gently slopes from the road to the location of the proposed 800 square foot house in Lots 71 and 72. Ground elevation at the proposed house location is between 17 and 18 ft. The surface gradient becomes noticeably steeper between the 13 and 14 ft contours and continues at this gradient to the 4 ft contour. A small scarp exists at this location, marking the edge of the tidal wetland (Appendix A, Photos 8-11 and 14-16). Vegetation is growing on the scarp and on the gently sloping tidal wetland to the waters edge (Photos 12, 13, and 17). Recent orthophotography and historical shoreline data were analyzed relative to the Hawkins property. Orthophotographs are available from the New York State Geographic Information Systems Clearinghouse (http://www.nysgis.state.ny.us). Most recent orthophotography were collected between March and May, 2007. The May 2, 1948 high-water shoreline was mapped from aerial photography collected and interpreted by U.S. Coast and Geodetic Survey personnel (Figure 6). A high-resolution scan of Topographic Sheet T-9086 was georeferenced in ArcGIS and the shoreline was compiled by on-screen digitizing. The 1948 shoreline was superimposed on the 2007 orthophotography to illustrate the relationship between the historical high-water shoreline and 2007 shoreline position (Figure 7). This map indicates that for the west side of Darby Cove, the 1948 shoreline is slightly landward of current shoreline position. Furthermore, tidal wetland type as designated by the New York State Department of Environmental Conservation (DEC) illustrates that tidal wetlands fronting the Hawkins property are classified primarily as Intertidal Marsh (3000 IM; Figure 8). As shown, the boundary between tidal wetlands and upland glacial deposits in front of the Hawkins property has been stable for at least the past 60 years. Regulatory Considerations Coastal Erosion Hazard Regulations The New York State Department of Environmental Conservation (DEC) created the Coastal Erosion Control Permit Program to implement the Coastal Erosion Hazard Statute set forth in Article 34 of the Environmental Conservation Law (DEC, 1988). One of the main goals of this policy is "promoting and preserving the natural protective features such as dunes and bluffs, beaches and nearshore areas of coastal regions". The policy aims to reach this goal by "restricting and prohibiting activities, development or actions in natural protective feature areas to prevent and reduce erosion and place new construction or structures a safe distance from areas of active erosion and impacts of storms". Pursuant to the statute, the DEC identified and mapped coastal erosion hazard areas throughout New York and provided these maps to coastal communities for regulatory purposes. When the DEC mapped coastal erosion hazard areas for Fishers Island, Darby Cove was mapped outside of the coastal erosion hazard zone, meaning that property within the cove is not subject to this statute. As such, the property also is not subject to Chapter 111 (Coastal Erosion Hazard Areas) restrictions as adopted by the Town of Southold in October 1991 (L.L. No. 24-1991). 7 i I ' I I Tidal Wetland Regulations i In 1973,Article 25 of the Environmental Conservation Law set forth land use regulations under Part 661 of the Tidal Wetlands Act (DEC, 2009) with the expressed purpose of allowing only "those uses of tidal wetlands and areas adjacent thereto that are compatible with the preservation, protection and enhancement of the present and potential values of tidal wetlands". DEC identified and mapped tidal wetlands in 1974, illustrating that Intermediate Marsh (3000 IM) and High Marsh (4000 HM) are present adjacent to the Hawkins property (DEC, 2009; Figure 8). Photos 12, 13, 17, and 22 in Appendix A provide the best ground view of tidal wetlands fronting the property,and Photos 11, 15, and 16 best illustrate the landward limit of tidal inundation. Property inland of tidal wetlands is composed of upland glacial deposits classified as Adjacent Areas (5000 AA) by DEC. According to Part 661 (DEC, 2009), the DEC jurisdictional boundary for Adjacent Areas to DEC _i defined tidal wetlands is "to the elevation contour of 10 feet above mean sea level, except when such contour crosses the seaward face of a bluff or cliff, or crosses a hill on which the slope equals or exceeds the natural angle of repose of the soil,then to the topographic crest of such bluff, cliff, or hill". As shown on the Hawkins property site plan (Figure 4) completed by CME Associates Engineering, Land Surveying&Architecture, all proposed work is being conducted landward and above 10 feet mean sea level. The 10-ft contour does not cross the seaward face of a bluff or cliff, but it does cross an upland glacial hill. As such, a topographic profile was constructed I_ for the hill fronting the proposed structure (Figure 9)to evaluate surface slope relative to the natural angle of repose of the soil. The steepest part of the profile was identified as the surface between the 14-ft and 3.5-ft contours. The horizontal distance between these contours is 25 feet, so the natural slope is 1:2.38 (2.38 ft of horizontal change for every 1 ft of vertical change). This means that the steepest slope on the upland glacial deposit at this location is 23 degrees. Because the natural angle of repose of unconsolidated glacial sediment is 36 degrees (Strahler, 1971), Ms. Hawkins' property landward of the 10-ft elevation contour is outside DEC jurisdiction. However, according to Chapter 275 regulations adopted by the Town of Southold in February 2004(LL. No. 6-2004), a permit for proposed activities is required from the Town when the proposed residence is within 100 ft of a wetland boundary. The edge of the proposed structure located closest to tidal wetlands is approximately 65 feet from the DEC tidal wetland classification boundary(Figure 8)at an average elevation of about 18 ft. Specifically, wetland regulation § 275-11 A.(3) requires that new and remodeled homes cannot be situated or modified such that they project closer to the wetland boundary than homes on either side of the subject lot. Figure 8 illustrates clearly that the home south of Lot 71 is approximately 40 feet closer to the DEC mapped wetland boundary than the proposed location of the Hawkins structure. No home exists on the lot adjacent to northern boundary of Lot 74. Furthermore, wetland regulation § 275-12 (Standards for issuance of permit) states that issuance of a permit to perform operations may be authorized if it is determined that such operations will not substantially: A. Adversely affect the wetlands of the Town; B. Cause damage from erosion, turbidity or siltation; C. Cause saltwater intrusion into the fresh water resources of the Town; D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof; E. Increase the danger of flood and storm-tide damage; F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the Town; G. Change the course of any channel or the natural movement or flow of any waters; H. Weaken or undermine the lateral support of other lands in the vicinity; I. Otherwise adversely affect the health, safety and general welfare of the people of the Town; J. Adversely affect the aesthetic value of the wetland and adjacent areas. Based on site observations and a review of the Site Plan developed and stamped by CME for Grace Burr Hawkins, it is my professional opinion that none of the conditions stated in items A through J will result from clearing and construction associated with Ms. Hawkins proposed actions on her property. 9 Final Observations Town of Southold concerns about development on Fishers Island are presented in its Local Waterfront Revitalization Program report. This report describes the Fishers Island Growth Plan created by the Fishers Island Growth Plan Committee and sponsored by the Fishers Island Civic Association. The Fishers Island Growth Plan, developed in 1988 and updated in 1994, outlined eight assumptions that intended to protect the island's environment and community character. Growth Plan Assumptions relevant to the proposed development of the Hawkins property are: • efforts must be made to slow the growth of the seasonal population; • the island should remain a residential community; and • the natural environment must be unequivocally protected. The proposed structure will be used by Ms. Hawkins, a property owner on the island since the early 1970s, and will not increase tourism. Our site assessment has determined that the proposed house construction will have no effect on natural tidal wetlands. Finally, the proposed structure is relatively small and should not significantly increase property values across the island, making it difficult for the year-round population to afford housing (a point of concern expressed in the Town of Southold Local Waterfront Revitalization Program Report). As part of my review of the Town's LWRP Consistency Form Section C, I offer the following comments regarding the Local Waterfront Revitalization Policies and this proposed project: Policy 1. I believe that this project is consistent with this policy because the project will not result in a negative impact upon the desired development pattern of the Town of Southold nor shall it result in the loss of the community and landscape pattern of the Town of Southold. Policy 2. I believe that this project is consistent with this policy because the project shall not have any impacts upon the preservation and retention of historic resources, or any archeological resources nor the Coastal Culture of the Long Island Sound. Policy 3. 1 do not believe that this policy is applicable to the project since the project will not have an impact on any scenic resource of the Town of Southold. Policy 4. I feel that the project is consistent with this policy for a number of reasons. I feel that the proposed project is consistent with this policy for a number of reasons. The project does not involve any direct or indirect discharges that would cause any negative impacts upon water quality standards. There shall be no increase or decrease in the pH, the dissolved oxygen or nutrients in the waterway and there should be no increase in noxious odors at the project site. There shall be no increase in negative health impacts such as pathogens, chemical contaminants or toxicity nor shall there be any negative aesthetic factors involved with the project. As part of the project a continuous line of staked hay bales and filter fabric shall be installed "seaward" of the limit of construction prior to the commencement of construction activities and maintained throughout the period of construction activities. The project does not involve watershed development or the quantity or quality of potable water. Policy 6. I feel that the project is consistent with this policy. The project as proposed shall have no impact upon the ecological quality in the Town of Southold. There shall be no negative impacts upon the adjacent area of freshwater by the destruction of habitat or significant impairment to the tolerance range of any species of fish or wildlife. As stated in the previous section the applicant shall also create a non-disturbed buffer area of native vegetation. This will create an additional buffer to the adjacent wetlands that does not currently exist. The project should have no impact upon any vulnerable fish, wildlife, plant species or rare ecological communities. Policy 7. I do not feel that this policy is applicable to this project since the project does not involve any atmospheric deposition of pollutants. Policy 8. I believe that the project is consistent with this policy. The project shall involve the disposal of solid waste, debris from the demolished dwelling, which shall be removed from the project site as part of the project. There are no hazardous waste or toxic pollutants involved with the project. Policy 9. I do not feel that this policy is applicable to this project. The proposed project shall have no impact upon adequate physical public access to coastal resources, shall not impact any public visual access to any lands or waters, involve the public interest in and use of lands and waters held in public trust or to public access of such areas.
