That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as lcng as the said Permittee wishes to maintain the sX-ucture or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if,in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to dee navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this hermit. 9. That the said Board wili be notified by the Pernuttee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: JAMES & LINDA GEMMILL 6004 INDIAN NECK ROAD, PECONIC SCTM# 1000-98-5-18 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 16, 2017 regarding the above matter: WHEREAS, En-Consultants on behalf of JAMES & LINDA GEMMILL applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 14, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the.LWRP Coordinator recommended that the existing as-built 11'x19.7' section of deck to remain, be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 16, 2017, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of the JAMES & LINDA GEMMILL to remove existing wood deck and covered porch from south/waterside of existing single-family, one-story dwelling; remove brick walks on west side of dwelling, and construct a 1,005sq.ft. one-story addition, 704sq.ft. of covered porches over masonry patios with steps, and new cellar entrance; install a drainage system consisting of gutters, leaders and drywells to the entire dwelling; remove existing 16'x20' wood deck from top of bank and construct a 10'x16' on- grade masonry patio landward of top of bank; replace existing embankment stairway and landings with new stairway consisting of a 4'x14' landing, 4'x6' steps, 4'x4' middle landing, and 4'x11' steps to an 11'x20' section of existing deck, and 8'x12' shed behind bulkhead to remain; remove 11'x16' section of existing deck behind bulkhead; replace and relocate existing 4'x6' steps to beach; establish and perpetually maintain a 10' wide non-turf buffer landward of top of bank; and to remove and replace existing sanitary system located beyond Trustee jurisdiction; all as depicted on the survey prepared by Peconic Surveyors, P.C., dated June 29, 2017, and stamped approved on August 16, 2017. The adjacent embankment,which is stable,well vegetated,and protected at its toe by a permitted bulkhead(see Wetlands Permit No 7593),will be further enhanced by the establishment of a 10'wide buffer along the top of the bank,which will help to capture and absorb surface water runoff before it reaches the bank,thus helping to mitigate erosion and serving as a sink for potential contaminants(e g,lawn fertilizers and pesticides)before they reach the surface waters of the bay Also proposed is the removal of the 16'x 20'deck overhanging the top of the bank,which is to be replaced with a smaller on-grade patio landward of the proposed buffer,and the substantial reduction in the size of the deck belund the bulkhead through the removal of the 11'x 16'section located adjacent to the property line. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP ADDENDUM FOR JAMES & LINDA GEMMILL 6004 INDIAN NECK LANE PECONIC,NY SCTM#1000-98-5-18 LWRP Policy 5 & Policy 6: The proposed project will be consistent with Policies 5 and 6 due to the project design and incorporated mitigation measures designed to a)protect and enhance water quality and supply (groundwater and surface waters); and b)protect and restore the quality and function of the surrounding ecosystem. Although situated less than 100 feet from the beach and bank and thus located partially within Chapter 275 jurisdiction, the existing dwelling and proposed additions/renovations are located more than 100 feet from the wetlands boundary, i.e., the high water line of Little Peconic Bay. And there will be no reduction of the existing wetland setbacks, as the proposed waterside porches are proposed no closer to the bay than the existing waterside porch and deck to be removed; and the dwelling addition would remain in line with the seaward limit of the existing dwelling. The adjacent embankment, which is stable, well vegetated, and protected at its toe by a permitted bulkhead (see Wetlands Permit No. 7593), will be further enhanced by the establishment of a 10' wide buffer along the top of the bank, which will help to capture and absorb surface water runoff before it reaches the bank, thus helping to mitigate erosion and serving as a sink for potential contaminants (e.g., lawn fertilizers and pesticides)before they reach the surface waters of the bay. Also proposed is the removal of the 16' x 20' deck overhanging the top of the bank, which is to be replaced with a smaller on-grade patio landward of the proposed buffer, and the substantial reduction in the size of the existing deck located behind the bulkhead through the removal of the 11' x 16' section located adjacent to the property line. Site drainage will be improved through installation of a drainage system of leaders, gutters, and drywells to collect and recharge roof runoff; and on-site septic treatment will be improved through installation of an upgraded sanitary system located outside Chapter 275 jurisdiction. Finally, a project limiting siltation fence would be set in place to control and contain site disturbance during construction. See attached narrative jointly addressing Policy 5 and Policy 6.
