That the said Board will be notified by the Permittee of the completion of the work authorized. 9. No right to trespass or interfere with riparian rights. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: PREVITE INVESTMENT TRUST 1570 BROADWATERS ROAD, CUTCHOGUE SCTM# 1,000-104-9-7 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 16, 2017 regarding the above matter: WHEREAS, En-Consultants on behalf of PREVITE INVESTMENT TRUST applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 14, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3, 9.3 and 9.4 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the construction and operation standards of the dock will meet the requirements of Chapter 275-11, proposed dock is within pier line and size of structure is similar to other docks in area; the use of thru-flow decking on catwalk; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 16, 2017, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of PREVITE INVESTMENT TRUST to construct a fixed timber dock with water and electricity, consisting of a 4'x8' landward ramp leading to a 4'x124' fixed elevated catwalk with open-grate decking; a 3'x14' hinged ramp; and a 6'x20' floating dock secured by two (2) 8" diameter pilings; with the condition that the construction and operation standards meet the requirements of Chapter 275-11; and as depicted on the site plan prepared by En-Consultants, dated July 11, 2017, and stamped approved on August 16, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that,the proposed action'is INCONSISTENT with the LWRP policies and therefore INCONSISTENT with the LWRP. The property has access to Broadwaters Cove via the waterfront location and opportunity for a mooring. -11 Policy 6. Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. The most common contaminant associated with docks is wood preservatives impregnated into the wood used to prolong the life of a dock. Three trace metals; arsenic, chromium and copper are the most common. These three metals have the greatest potential to increase in estuarine environments from docks (Sanger and Holland 2002). As the proposed dock would be located well inside the pier line set by these two adjoining dock structures,its construction would cause no adverse impacts on navigation or"fragmentation of ecological communities" along the developed shoreline. In fact,creating a fixed point of access for boating and other water activities should allow for recovery of wetland vegetation in the area where dinghies, canoes,and kayaks are currently dragged into the water. Due to the extensive vegetated wetland areas to the north and south,this shoreline area does not invite public pedestrian pass and repass along the shoreline,but such access would be maintained around the dock just landward of the tidal wetland area if necessary.
