BASIS OF APPLICATION: Zoning Code Section 280-116A.3, based on the Building Inspector's October 11, 2007 Notice of Disapproval, amended January 17, 2008, concerning a proposed relocation of a dwelling and new additions and alterations adjacent to the Long Island Sound. ZONING CHAPTER 280 OF TOWN CODE (formerly Chapter 100)- Zoning Code Section 280.116 A.2 states that all buildings and structures located on lots adjacent to the sound shall be set back no less than 100 feet from the ordinary high watermark of said sound. LWRP DETERMINATION: The applicant is requesting a variance to relocate an existing single-family dwelling landward and to construct an addition to be located 80' from the wetlands boundary for an as-built porch and deck set back less than 75 feet from the bulkhead. Pursuant to the procedures under Chapter 268, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards, a letter was issued by LWRP on January 9, 2008 with recommendations related to inconsistencies for construction at less than 100 feet from the wetland line. Chapter 275-3 requires a minimum of 100 feet, and compliance with Trustee regulations and recommendations set forth in Trustee Permit Conditions. In addition, a minimum setback requirement of 100 feet measured from the top of the bank adjacent to the Long Island Sound,is required under Chapter 280. Recommendations under LWRP to mitigate these concerns are addressed in a January 25, 2008 letter issued by the Suffolk County Soil and Page 2—February 7, 2008 ZBA#6109—Missy Diack CTM 58-2-11 Water District, part of the record under ZBA#6109 and received by the applicant's agent. Recommendations include proposed non-turf plantings, placement of hay bales during construction, and permanent installation of gutters and downspouts running into storm- water basins. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 24, 2008, at which time written and oral evidence were presented. The proposed deck located seaward of the bulkhead is vulnerable and would create a dangerous situation during storm surges as a projectile or floating debris Past aerial photo analysis shows high water frequently at the bulkhead in this section of dynamic and exposed shoreline. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed deck seaward of the Coastal Erosion Hazard Area (CEHA) line is on the beach and a diagram showing construction has not been provided. All development is prohibited on a beach pursuant § 111-12 unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities on a beach may include open timber piles or other similar open work supports with a top surface area of less than 200 square feet. Therefore, the deck, as proposed, is prohibited on the beach pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS. § 111-12. Beach area. D. All development is prohibited on beaches unless specifically provided for by this chapter. § 111-6. Definitions. UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter include but are not limited to elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purposes of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar open work supports with a top surface area of less than 200 square feet or which are removed in the fall of each year; normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program; planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes; routine agricultural operations, including cultivation or harvesting; and the implementation of practices recommended in a soil and water conservation plan as defined in § 3, Subsection (12), of the Soil and Water Conservation Districts Law; provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure.
