That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Pennittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be:Wade to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if,in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. This is incorrect since It does not have staggered floor levels, but it is rather a bi-level with a basemen below HTWL in a flood zone with no egress window. 2- the project does not mention a sauna/washroom attachment to the house 16'x 9.5' occupying 124 square feet. 3- The cesspool location indicated by the owner has not been defined or approved by the Department of Health. A small one pool septic system was placed on the south side less than 100' from the MHWM of Orient bay. At the end of 1970 Walter Meier sold the house to Benjamin Sokobin. After taking possession Mister Sokobin added over a period of 20 years the following addition to the property. 1-First he buried the entrance to the garage located underneath the house. A new 7'x25' deck was build facing Harbor rd. Installed two 5' french sliding glass doors on the facade for entrance to the deck and increased the size of 4 side windows. 2-Next a 11'x9' attached sunroom was build on the east side. 3-An in-ground 12'x32' fiberglass prefab swimming-pool surrounded by a 1500 sgft wooden deck was installed. During one winter when the pool was empty, it was lifted by the high tide. 4-A sauna and washroom have been build on the east side of the building, 5-Extended the backyard deck by 6' x 25'wide. No Southold-town , wetland or DEC permits where ever posted for these improvements. We, as the direct neighbor with a common border never received a notification or have been informed, of any alteration or constructions on this property. Frequently the marsh floods onto the yards on our block. We fear building more structures on her small lot and increasing the lot coverage could increase flooding for the rest of the block.We are particularly concerned about bringing in a lot of fill to that property. —The soil is very sandy and the water table is high and we fear that additional pollution could drain quickly into the marsh and bay. —There has been a dramatic of loss of biodiversity along the beach.Thirty years ago, eel grass flourished. Now there is much less life in the water. Crabs, eels, and most aquatic life have gone, except for occasional schools of fish. Even the clams,from what was a major clamming site for Orient, have disappeared. Please consider the following: 1. The site plan indicates a Note which states "Existing Cesspool Location by Owner". The location shown is seaward of the CEHA line and it is within 20' of the Rock Revetment and Timber Bulk-heading that protects the property from Orient Harbor. In addition, this Cesspool would almost assuredly be in direct contact with ground water given the grade elevation and distance to tidal wetlands. Therefore it is strongly recommended that a new Sanitary System, which meets all current SCDHS requirements for residential construction, be mandatory for this project. 2. A retaining wall has been proposed for the property line along the Town Road known as King Street. Ware necessary, the removal of existing Asphalt Pavement must be Saw Cut in a straight line prior to excavation for the new retaining wall. (Weep holes will not be permitted in this Retaining Wall) 3. The Existing LP Tanks located along the property line of King Street must be relocated to a minimum of ten (10') feet away from the property line. These tanks must be properly anchored to meet code and this re-installation should be coordinated with the Building Department for additional requirements. 4. "Porous Pavers" have been indicated for the new Pool Surround. The detail for construction appears to be tenuous and difficult to construct without a solid base. The permeability of this design will require-certification by the Project Engineer after the installation is complete. RELIEF REQUESTED: The applicant requests variances to construct an accessory garage that will result in a front yard setback of+/- 10 feet and +/-28 feet where code requires a 35 foot front yard setback. The proposed construction will result in lot coverage of 27.8%where code limits lot coverage to 20%. The applicant proposes to construct a five foot tall fence in the front yard where code permits four feet. AMENDED APPLICATION: During the hearing,the applicant was asked to bring the plan into more conformity with the code. The applicant on April 27,2016(date)submitted a site plan removing the wood decking around the existing pool and replacing it with an on grade patio. This results in proposed lot coverage at 23.2%.The applicant also amended the site plan to show a code conforming garage size of 660 square feet and the proposed accessory garage drawings to show a conforming height of 18 feet, thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: Several neighbors testified that they opposed the proposed construction. A signed petition was presented in opposition of the proposed construction. The applicant presented a trustees permit that permitted the applicant to do work on the"as-built"bulkhead. The applicant has a ZBA variance to construct a 5' high fence around the"as-built"swimming pool. The proposed fence will surround the front yard of the property and not just the swimming pool. The applicant testified that she will be installing plantings in order to have additional screening around the pool area. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 7,2016,February 4,2016,and April 7,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variance(s) for the front yard setback and lot coverage will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of small non-conforming lots improved with single-family homes. Other accessory garages and structures exist in this neighborhood,and the proposed accessory garage is code conforming in size, height and the front yard location on the subject waterfront property. The proposed 5' high fence will produce an undesirable change in the character of the neighborhood since nonconforming fence heights in front yards is not typical in the neighborhood. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has a small water front lot and is burdened by two front yards; therefore any proposed accessory garage will require the benefit of an area variance. The existing lot coverage is already non-conforming; but the applicant -is not proposing significant additional nonconformance due to the removal of an existing pool deck. The benefit of a 5 foot tall fence can be achieved by building a code conforming 4 foot tall fence and using landscape plantings to create the visual privacy the applicant desires to achieve. 3. Town Law 5267-b(3)(b)(3). The variance(s) granted herein for the +/- 10 foot and +/- 28 foot front yard setback for the proposed accessory garage are mathematically substantial,representing 72% relief and 20%%relief from the code. However,the proposed location for the garage places it at the greatest possible distance from Orient Harbor and the applicant agreed that the garage ridge will run East to West and will be no higher than the code conforming maximum height of 18 feet so as to mitigate the visual impact of the garage from Harbor Road. The variance granted for lot coverage is mathematically substantial representing 16% relief from the code. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law&267-b. Grant of relief as amended for the garage's front yard setbacks and the total lot coverage is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of the relief as requested for the proposed 5 foot high fence is not minimum action necessary and adequate to enable the applicant to enjoy the benefit of fencing while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
