Nos. 7-2016; 9- 2016. 10-01-2016 § 17-12 COMMUNITY PRESERVATION FUND § 17-13 moneys realized under this article's two-percent real estate transfer tax, which is also authorized by Town Law § 64-e and Article 31-D of the New York Tax Law. B. It is the purpose of this article to establish and create the Southold Community Preservation Project Plan to,help guide the Town's efforts to preserve open spaces and natural, scenic and historic places and to implement the requirements of Town Law § 64-e and Article 31-D of the New York Tax Law. § 17-13. Community preservation project plan adopted. [Amended 2-4-2003 by L.L. No. 2-2003; 4-12-2005 by L.L. No. 5-2005; 1-31-2006 by L.L. No. 2-2006; 9-9-2008 by L.L. No. 11-2008; 9-23-2008 by L.L.No. 13-2008; 8-23-2016 by L.L. No. 9-20161 A. For the reasons set forth in § 17-12 hereof, the Town Board of the Town of Southold hereby approves and adopts the Community Preservation Project Plan prepared by the Town's Planning Department, the Land Preservation Committee, the Peconic Land Trust and Central Data Processing and presented to the Town Board on August 4, 1998, during the work session portion of the Town Board meeting, said plan being intended to constitute the Southold Community Preservation Project Plan which is required by § 64-e of the New York Town Law and Article 1 of Chapter 17 of the Southold Town Code. B. The Town Board of the Town of Southold hereby approves and adopts the January 2003 update to the Community Preservation Project Plan prepared by the Land Preservation Department and Central Data Processing Department and presented to the Town Board on January 21, 2003, during the work session portion of the Town Board meeting. The 1998 List of Eligible Parcels shall be replaced by the January 2003 List of Eligible Parcels presented to the Town Board during the January 21, 2003, work session. C. The Town Board of the Town of Southold hereby approves and adopts the March 2005 update to the Community Preservation Project Plan, which adds certain parcels in the Great Pond Wetland and Dune Area in Southold to the List of Eligible Parcels. The January 2003 List of Eligible Parcels shall be revised as of March 29, 2005, to include the identified Great Pond Wetland and Dune Area Parcels. D. The Town Board of the Town of Southold hereby approves and adopts the January 2006 update to the Community Preservation Project Plan, which adds 194 parcels, totaling approximately 355 acres, to the List of Eligible Parcels. In addition, the existing List of Eligible Parcels has been revised to delete parcels which have been preserved using various preservation methods, to delete parcels which have been developed, and to correct, where applicable, Suffolk County Tax Map numbers for parcels included on the existing List of Eligible Parcels. E. The Town Board of the Town of Southold hereby approves and adopts the August/September 2008 update to the Community Preservation Project Plan which adds five parcels totaling approximately 24.07 acres to the List of Eligible Parcels. In addition, the existing List of Eligible Parcels has been revised to delete parcels which have been preserved using various preservation methods and to correct, where applicable, Suffolk County Tax Map numbers for parcels included on the existing List of Eligible Parcels. The text of the plan adopted by the Town Board in 1998 (plan dated July 1998) shall remain as adopted in 1998, with an updated September 2008 Executive Summary and 17:7 10-01-2016 § 17-13 SOUTHOLD CODE § 17-16 updated cover pages. The January 17, 2006, List of Eligible Parcels shall be replaced with the August/September 2008 List of Eligible Parcels. F. The Town Board of the Town of Southold hereby approves and adopts the July 2016 update to the Community Preservation Project Plan, which is inclusive of the List of Eligible Parcels. In addition, the Community Preservation Project Plan incorporates additional goals of addressing and maintaining the preservation of waterways and water quality as authorized by Chapter 551 of the Laws of 2015. The July 2016 update shall supersede all previously adopted and amended plans. § 17-13.1. Community Preservation Fund Management and Stewardship Plan adopted. [Added 3-24-2009 by L.L. No. 5-2009; amended 3-25-2014 by L.L. No. 5-2014; 3-10-2015 by L.L. No. 2-20151 The Town Board of the Town of Southold hereby approves and adopts the Town of Southold Community Preservation Management and Stewardship Plan 2015 for real property interests acquired by use of moneys from the Town of Southold Community Preservation Fund, prepared by the Land Preservation Coordinator, presented to the Town Board during the Work Session of February 24, 2015 and intended to be the management and stewardship plan required by § 64-e (6) of the New York State Town Law. § 17-14. Severability. If any clause, sentence, paragraph, section or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. § 17-15. When effective. This article shall take effect immediately upon filing with the Secretary of State as provided by law. ARTICLE III Community Preservation Fund Advisory Board [Adopted 8-25-1998 by L.L. No. 13-19981 § 17-16. Community Preservation Fund Advisory Board established; purpose; membership. A. The Town of Southold Community Preservation Fund Advisory Board is hereby established. B. The purpose of the Advisory Board is to review and make recommendations on proposed acquisitions of interests in real property using moneys from the Community Preservation Fund. 17:8 10-01-2016 § 17-16 COMMUNITY PRESERVATION FUND § 17-17 C. The Advisory Board shall act in an advisory capacity to the Town Board. D. The Advisory Board shall consist of seven members who shall be legal residents of the Town and who shall serve without compensation. No member of the Town Board shall serve on the Advisory Board. E. A majority of the members appointed shall have demonstrated experience with conservation or land preservation activities. In addition, at least one member of the Advisory Board shall be an active farmer. F. The Town Board hereby appoints the members of the Land Preservation Committee as the members of the Advisory Board. Appointees to the Land Preservation Committee shall serve concurrently as members of the Community Preservation Fund Advisory Board. § 17-17. Severability. If any clause, sentence, paragraph, section, or part of this article shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered. 17:8.1 10-01 -2016 § 280-25 ZONING § 280-26 GOVERNMENT LIAISON OFFICER — The Government Liaison Officer or other employee of the Town as designated by the Town Board who is responsible for the development, implementation and coordination of the housing registry and affordable housing initiatives for the Town of Southold. [Added 5-3-2016 by L.L. No. 4-2016; amended 8-23-2016 by L.L. No. 7-20161 HEAD OF HOUSEHOLD — The adult member of the family who is the head of the household for purposes of determining income eligibility and rent. HOUSEHOLD— The family and live-in aide, if applicable. MODERATE-INCOME FAMILY — A family registered with the Town of Southold Housing Registry whose aggregate annual income, including the total of all current annual income of all family members (excluding the earnings of working family members under age 18) from any source whatsoever at the time of application for the purchase or lease of an affordable housing unit or the purchase of an unimproved affordable lot, does not exceed 120% of the HUD median income for the County of Suffolk. MODERATE-INCOME FAMILY DWELLING UNIT — A dwelling unit reserved for rent or sale to a moderate-income family and for which the maximum monthly rent (excluding utilities) or the maximum initial sales price does not exceed the maximum rent or maximum sales price set forth in § 280-30D hereof. MODERATE-INCOME FAMILY UNIMPROVED LOT — An unimproved lot reserved for sale to a moderate-income family and for which the maximum initial sales price does not exceed the maximum sales price set forth in § 280-30D hereof. Said "unimproved lot" shall mean a vacant parcel of real property designated as a lot on a filed map, inclusive of all utilities brought to the property line. NET WORTH — The net worth of an applicant shall include all liquid assets less debt. Liquid assets shall not include sheltered assets, trusts, individual retirement accounts (IRAs), 401ks and all other federally recognized tax-deferred vehicles. PERMANENT FIXED IMPROVEMENT— An improvement to a lot or a moderate-income family dwelling unit which cannot be removed and which provides value to the property above and beyond repairs done to maintain the property in good condition. A permanent fixed improvement must be approved in advance of construction or installation in writing by the Government Liaison Officer. [Amended 5-3-2016 by L.L. No. 4-2016; 8-23-2016 by L.L. No. 7-20161 PRIMARY RESIDENCE— The address listed on a person's federal income tax return. SPECIAL PROJECTS COORDINATOR — The employee of the Town who is responsible for the development, implementation and coordination of the housing registry and affordable housing initiatives for the Town of Southold. § 280-26. Applicability. [Amended 8-23-2016 by L.L. No. 7-20161 AHD Districts shall be established by the Town Board on parcels of land that have been identified through the accepted principles of Smart Growth planning as being appropriate and 280:43 10-01-2016 § 280-26 SOUTHOLD CODE § 280-27 desirable locations for affordable housing. Such locations include, but are not limited to: land within Hamlet Locus Zones, as may be determined by the Town Board; land within walking distance of services, shops, schools, and public transportation; land that adjoins existing centers of business and residential development (as opposed to land adjoining farm and open fields); and other locations where the project has been shown to meet a demonstrable need. AHD Districts shall be designated by Town Board resolution after a public hearing thereon, upon 10 days' notice thereof by publication in the official Town newspapers. § 280-27. Use regulations. [Amended 8-26-2014 by L.L. No. 10-2014; 5-3-2016 by L.L. No. 4-20161 In the AHD District, no building or premises shall be used and no building or part of a building shall be erected or altered which is arranged, intended or designed to be used, in whole or in part, for any use except the following: A. Permitted uses. (1) Owner-occupied moderate-income family dwelling unit ("MIFDU"), in accordance with the following requirements: (a) An owner-occupied MIFDU shall not be leased, except one time for up to a two-year term, subject to the written approval of the Government Liaison Officer. (b) Owner-occupied MIFDUs may either be attached or detached, or any combination thereof. (2) Tenant-occupied MIFDU, in accordance with the following requirements: (a) A tenant-occupied MIFDU must be leased for a term of not less than one year. (b) Tenant-occupied MIFDUs may either be attached or detached, or any combination thereof. B. Accessory uses. (1) Accessory uses as set forth in and regulated by § 280-13C(1), (2), (3), (4), (6) and (7) of this chapter. (2) Accessory apartments are permitted only within owner-occupied MIFDUs, subject to the written approval of the Government Liaison Officer, the issuance of a rental permit in accordance with § 280-13D and the following conditions: (a) The accessory apartment shall be located within the MIFDU. (b) Only one accessory apartment shall be permitted in a MIFDU. (c) The owner shall occupy either the principal dwelling or the accessory apartment as the owner's primary residence. 280:44 10-01-2016 § 280-27 ZONING § 280-28 (d) The accessory apartment shall only be occupied by an eligible family or individual as defined by § 280-30C. (e) The term of the lease for an accessory apartment shall be at least one year. (f) The accessory apartment shall be at least 350 square feet and shall not exceed a square footage equal to one half of the total square footage of the MIFDU. (g) The accessory apartment shall have only one bathroom. (h) A minimum of one off-street parking space shall be provided. (i) Not more than 50% of the dwelling units in an approved affordable housing district shall have accessory apartments. § 280-28. Bulk, area and parking regulations. [Amended 8-26-2014 by L.L. No. 10-2014; 8-23-2016 by L.L. No. 7-2016] A. Notwithstanding the bulk schedule set forth in Subsection A of this section, there shall be no more than 24 dwelling units on any one site. 280:45 10-01-2016 § 280-28 SOUTHOLD CODE § 280-29 C. Authority to amend requirements and specifications. (1) The Planning Board shall have the authority to reduce or amend yard setback requirements, lot dimension requirements, parking requirements, and highway specifications. In making this decision, the Planning Board shall take into consideration the benefit to the applicant, as weighed against the detriment to the health, safety and welfare of the neighborhood or community. In making such determination, the Planning Board shall also consider: (a) Whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the amendments; (b) Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than the sought variance; (c) Whether the variance is substantial; (d) Whether the proposed variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and (e) Whether the alleged difficulty was self-created, which shall be relevant to the decision but shall not necessarily preclude the proposed amendment or variance. (2) This provision supersedes and amends New York State Town Law §§ 267, 267-a, 267-b and 267-c insofar as these sections give such authority to the Zoning Board of Appeals. Any amendment to highway specifications shall meet with the approval of the Highway Superintendent. § 280-29. Application procedure. A. Application and fees. The application for rezoning shall be filed with the Town Clerk, in a form approved by the Town Board and available in the office of the Town Clerk. Fees applicable to the AHD zoning application shall be set by resolution of the Town Board. [Amended 8-26-2014 by L.L. No. 10-2014] B. Application procedure. The procedure for approval of any future development in a proposed AHD District shall involve a three-stage review process as follows: [Amended 8-26-2014 by L.L. No. 10-20141 (1) Approval by the Town Board of a preliminary development concept plan. (2) Approval of the final, detailed subdivision plat or site plan by the Planning Board. In an AHD zone, § 280-137A(5) is inapplicable, and the allowable density of MIFDUs shall be determined by the following yield calculation: (a) Buildable land (square feet) divided by the minimum land area per dwelling unit=number of MIFDUs. i 280:46 10-01-2016 § 280-29 ZONING § 280-29 (3) The zoning classification by the Town Board of a specific parcel or parcels of land for development in accordance with that plan.* *NOTE: The Town shall, in all instances, process Subsection B(2) and (3) above concurrently so as to enable the municipality to utilize a single SEQRA process and conduct a coordinated review of the entire application. C. Referral to Planning Board. Upon the receipt of a properly completed application for the establishment of a new AHD District, one copy of the application shall be referred to the Planning Board for its review and report, and one copy shall be referred to the Suffolk County Planning Commission for its review and recommendation, if required by the provisions of the Suffolk County Charter. Within 60 days from the date of the Planning Board meeting at which such referral is received, the Planning Board shall report its recommendations to the Town Board. No action shall be taken by the Town Board until receipt of the Planning Board report or the expiration of the Planning Board review period, whichever first occurs. Said review period may be extended by mutual consent of the Planning Board and the applicant. D. Planning Board report. The Planning Board, in its report to the Town Board, may recommend either approval of the application for the establishment of the AHD District, with or without modifications, or disapproval of said application. In the event that the Planning Board recommends disapproval of said application, it shall state in its report the reasons for such disapproval. In preparing its report and recommendations, the Planning Board shall give consideration to the Town Comprehensive Plan, the existing and permitted land uses in the area, the relationship of the proposed design and location of buildings on the site, traffic circulation, both on and off the site, the adequacy and availability of community facilities and utilities, including public water and public sewer systems, to service the proposed development, compliance of the proposed development with the standards and requirements of this article, the then-current need for such housing and such other factors as may be related to the purposes of this article. E. Town Board public hearing. Within 45 days from the date of the Town Board's receipt of the Planning Board's report and recommendation or the expiration of the Planning Board review period, whichever first occurs, the Town Board shall hold a public hearing on the matter of establishing an AHD District on the property described in the application. Such hearing shall be held upon the same notice as required by law for amendments to the Town Zoning Map and/or Zoning Code. F. Town Board action. (1) Within 45 days after the date of the close of the public hearing, the Town Board shall act either to approve, approve with modifications or disapprove the preliminary development concept plan and the approval or disapproval of the establishment of the AHD District applied for. Approval or approval with modifications shall be deemed as authority for the applicant to proceed with the detailed design of the proposed development in accordance with such concept plan and the procedures and requirements of this article. A copy of the Town Board's determination shall be filed with the Planning Board and a copy mailed to the 280:46.1 10-01-2016 § 280-29 SOUTHOLD CODE § 280-29 applicant. A copy shall also be filed in the Town Clerk's office. If such determination approves the establishment of a new AHD District, the Town Clerk shall cause the Official Zoning Map to be amended accordingly. (2) Revocation; extension.
