Upon application for NORMAN J. MURRAY, by Wickham, Wickham and
Bressler, P.C., Main Road, Mattituck, NY for a Variance to the Zoning
Ordinance, Article III, Section 100-31 for permission to divide Lots
37 through 40 of Laurel Park Subdivision into two separate substandard
lots located at the east side of Oakwood Road, Laurel, NY; County Tax
Map Parcel No. 1000-127-8-8.
The board made the following findings and determination:
By this appeal, apPlicant seeks permission to divide a 2.05-
acre parcel into two lots, Parcels 1 and 2 containing approximately
56,000 sq. ft. and 33,200 sq. ft. in area, and 200' and 120' road
frontage, respectively. Parcel 1 is improved with a two-story,
one-family, framed house with porch; Parcel 2 is improved with a
one-family, one-story framed house with small porch. The premises
in question are known as Lots 37, 38, 39 and 40 of "Laurel Park"
Subdivision Map #212, dated October 5, 1925 and were conveyed to
the applicant January 4, 1941.
For the record it is noted that applicant has received
approvals from the Southold Town Planning Board dated November 7,
1983 and from the N.Y.S. Department of Environmental Conservation,
Permit #10-82-0143 as amended October 13, 1983 for the two-lot
division.
In considering this appeal, the board determines: (1) that
the practical difficulties have been shown and are sufficient to
warrant the granting of the application as noted below; (2) that
the relief as noted below is not substantial in relation to the
requirements of the zoning code; (3) that the circumstances are
unique; (4) that the relief as approved will be in harmony with
and promote the general purposes of zoning of the protection and
promotion of the public health, safety and welfare; (5) that the
interests of justice would be served by approving the application
as noted below. In allowing the relief requested, it is the
opinion of the board that no change will be made of the property

RESOLVED, that Appeal No. 3007, application for NORMAN J.
MURRAY for approval of insufficient area and/or width of two
parcels as shown on the survey map revised September 6, 1983,
by Roderick VanTuyl, P.C., BE AND HEREBY IS APPROVED, SUBJECT
TO THE FOLLOWING CONDITIONS:
1. Ail new construction shall comply with sideyard set-
back requirements of the zoning code;
2. Each dwelling shall have a minimum of 850 sq. ft.
living area, pursuant to Article III, Section 100-31, Bulk
Schedule of the Zoning Code.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance is requested for the reason that applicant
wishes to divide a 2.05 acre parcel into 6wa lots with insufficient
area, width and ~ideyard, as shown on attached map by Roderick Van
dated August 19, 1983 and revised September 6,

REASON FOR APPEAL - Continued
1 STRICT APPLICATION OF THE ORDINANCE would produce practicaldlfficultlesorunneces-
sam HARDSHIP be~au~ the parcel is considerably larger than the other
properties in the neighborhood, and contains a house on each of the
nwa proposed lots. The proposed division would result in nwa lots
which are of comparable size no the surrounding area, or larger.
Applicant would experience hardship trying to sell two houses on
one lot which is three or four times the size of many nearby lots.
The division line between the two lots was chosen to include the
garden with the northerly lot and to bring the boundary midway between
the two houses.

are on lots containing frontage of 80 feet or less, except for one lot
of 92 feet on Peconic Bay Blvd.; and because this lot contains three to

contains two houses which have been there for many years.
3 Tine Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OE THE DISTRICT because houses are already built on both of the
parcels, and because the proposed lots would be at least in proportion
no the size of those in the neighborhood. The attached tax map shows
many 80 foot lots,.most of which have houses on them. I understand
that the two lots immediately across the street, shown as 17.1 and
17.2 on the attached tax map, were split several years ago.

The board members are awaiting responses from the Suffolk County
Department of Planning pursuant to Sections 1323, et seq. of the
Suffolk County Charter. A portion of the subject premises is located
within 500 feet of the bay.
PENDING APPEALS NO. 3109 and 3110. CUTCHOGUE FREE LIBRARY.
Mr. Lessard advised the board that the library is planning a change
for the main entrance at the west side rather than the east side
as applied, and new plans should be filed soon. Mr. Lessard was
asked to advise the library that the board must make a decision at
the October 27, 1983 meeting and if they plan to withdraw the pend-
ing appeals, they should do so before that date.
The board members tentatively agreed to field inspect on
Saturday, October 22, 1983.

The subject application as filed on June 21, 1982 was a variance ~
for approval of insufficient area and width of three proposed
parcels at the east side of North Oakwood Road, Laurel, and
referred to as Lots 40, 39, 38 and 37 of "Laurel Park" MaD 212.~
On September 20, 1982, the Planning Board requested that ~he
subdivision be reduced to a two-lot prOposal. Pursuant to
a telephone called during December 1982, the Z.B.A. was asked
to hold this matter in abeyance until May 1983, or so, bY
Abigail A. Wickham, Esq. On October 11, 1983, the Z.B.A.
received an amended application and amended surveys for the
two-lot proposal pursuant to the Planning Board's request.
It is the consensus of this board that the attorney for
~Mr. Murray be informed that once the Planning Board has made ~

Hr. Murray:
Your recent request to modify the above permit has been
reviewed pursuant to 6NYCRR, Part 621, It has been determined
that the proposed modifications ~rlll not substantially change
the scope of the permitted actions or the existing permit
conditions.
Therefore, the permit is amended to authorize: the sub-
division of 2.+ acre parcel into two seperate lots, rather than
the originally permitted three lots. The new Parcel. 1 (northern
most lot) to be 56,000 square feet. The new Parcel 2 (southern
most lot) to have an area of 33,200 square feet. This letter
of ammendment is to be in accordance with supplied plans (survey
of Roderick Van Tuyl for Norman Murray, revised September 6, 1983).
This letter is an amendment to the original permit and as
such, shall be posted at the Job site.
All other terms and conditions remain as written in the
original permit.

REASON FOR APPEAL , Continued .
1. STRICT APPLICATION OF THE ORDINANCE would produce procticoldifficulties orunneces-
sary HARDSHIP b~au~ the parcel is considerably larger th~n' the other
properties in the neighborhood, and contains a house on each of the
two proposed lots. The proposed division would result in two lots
which are of comparable size to the surrounding area, or larger.
Applicant would experience har~hip trying to sell two houses on
one 16~ which is three or four times the size of many nearby lots.
The division'line between the two lots was chosen to include the
garden with the northerly lot and to bring the boundary midway between
the two houses.
2 The hardshipcreatedis UNIQUE and is notshared by oil properties alike in the immediate
vicinity ofthisproperty and in this use district because all of the surroUnding properties
are on lots containing frontage of 80 feet or less, except for one lot
of 92 feet on Peconic Bay Blvd.; and because this lot contains three to
four times the area of the surrounding lots; and because this property
contains two houses which have been there for many years.
3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THEDISTRICT because houses are already built on both of the
parcels, and because the proposed lots would be at least in proportion
to the size of those in the neighborhood. The attached tax map shows
many 80 foot lots, most of which have houses on them. I understand
that the two lots ~mmediately across the street, shown as 17.1 and
17.2 on the:attached tax map, were split several years ago.

Permil Administrator, a noUce of intention to commence work at least 48
hours in advance of the time of commencement and shall also noUfy him
promptly in writing of the completion of the work.
2. The permitted work shall be subiect to inspeclion by an authorized
representative of the Deparlmeut of Environmental Conservalion who may
order the work suspended if the public interest so requires.
3. As a condition of the issuance of lhis permit, the appJicant has ac-
cepted expressly, by the execution of the appJication, the full legal respon-
sibility for all damages, direct or indirect, of whatever nature, aed by whom-
ever suffered, arising out of the project described herein and has agreed to
indemnify and save harmless the State from suils, actions, damages and
costs of every name and description resulting from the said project.
4. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the waterway or flood plain or deep holes that may have a tendency to
cause injury to navigable channels or to the banks of the waterway.
5. Any material to be deposited or dumped under this permit, either in
the waterway or on shore above high-water mark, shall be deposited or dumped
at the locality shown on the drawing hereto attached, and, if so prescribed
thereon, within or behind a good and substantial bulkhead or bulkheads, such
as will prevent escape of the material into the waterway.
6. There shall be no unreasonable interference with navigation by the
work herein authorized.
7. That if future operations by the State of New York require an alteration
in the position of the structure or work herein authorized, or if, in the opinion
of the Department of Environmental Conservation it shall cause unreasonable
obstruction to the free navigation of said waters or flood flow~, or endanger
the health, safety or welfare of the people of the State, or loss or'destruction
of the natural resources of the State, lhe owner may be ordered by the Depart-
lent to remove or alter the structural work, obstructions, or hazards caused
~hereby without expense Io the State; and if, upon the expiration or revocation
of this permit, the structure, fill, excavation, or other moc[ification of the
watercourse hereby authorized shall not be completed, the owners shall,
without expense to the State, and to such extent and in such time and manner
as the Department of Environmental Conservation may require, remove all or
~ny portion of the uncompleted structure or fill and restore to its former
condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or
alteration.

CONDITIONS
8. That the Slate of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may he caused by or
result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to
compensation shall accrue from any such damage.
9. That if the display of lights and signals on any work hereby authorized
is not otherwise provided for by law, such lights and signals as may be pre-
scribed by the United States Coast Guard shall be installed and maintained
by and at the expense of the owner.
10. All work carried out under this permit shall be performed in accor-
dance with established engineering practice and in a workmanlike manner.
11. If granted under Articles 24 or 25, the Department reserves the right
to reconsider this approval at any time and after due notice and hearing to
continue, rescind m modify this permit in such a manner as may be found to
be just and equitable. If upon the expiration or revocation of this permit, the
modification of the wetland hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such
time and manner as the Department of Environmental Conservation may require,
remove all or any portion of the uncompJeted structure or fill and restore the
site to its former condition. No claim shall be made against the State of New
York on account of any such removal or alteration.
12. This peredl shall not be construed as conveying to the applicant any
righl to trespass upon the lands or interfere with the riparian rights of others
to perform the permitted work or as authorizing the impairment of any rights,
title or interesl in real or personal property beld or vested in a person not a
party to the permit.
13. The permittee is responsible for obtaining any other permits, ap-
provals, fonds, easements and riRhts-of-way which may be required for this
project.
14. If Rranted under ArticJe 36, this permit is granted solely on fhe basis
of the requirements of Article 36 of the Environmental Conservation Law and
Part 500 of 6 NYCR~ (Construction in Flood Plain Areas having Special Flood
Hazards - BuitdinR Permits) and in no way signifies that the project will be
free from flooding.
15. By acceptance of this permit the permittee agrees that the permit
is contingent upon strict compliance with the special conditions on the
reverse side.
SUPPLEMENTARY SPECIAL CONDITIONS
· he following condition~s apply to all permits:
A. If any of the permit conditions are unclear, the permittee shall contact t/m
Division of Regulatory Affairs at the address and telephone noted below.
B. A copy of this per~ttt or approval and supplementary conditions shall be avail-
able at the project site whenever authorized work is in progress.
The permit sign enclosed with this permit or a copy of approval letter shall be
protected from the weather and posted in a conspicious location at the work
site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt fo~t certifying
that he is fully aware of and understands all provisions and conditions of
this permit. Within one week of completion of the permitted work the bottom
portion of that form shall also be completed and returned.
For projects involving activities to be accomplished over a period of more
than one year, the permittee shall notify the Regional Permit Administrator in
writing at l~==t 48 hours to the co~nencement of' resumption of work each year.
If project design modifications take place after permit issuance, the permit-
tee shall submit the appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such modifications. The permit-
tee is advised that substantial modification may require submission of a new
application for perm/t.
All necessary precautions shall be taken to preclude contamination of any wet-
lands or waterway by suspended solids, sediment, fuels, solvents, lubricants,
epoxy coatings, paints, concrete, leachers or any other environmentally
deleterious materials associated with the project work.
Any failure to comply precisely with all of the terms and conditions of this
permit, ,mless authorized in writing, shall be treated as a violation of the
Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may be re-
quired from the U.S. Department of Army Corps of Engineers, New York District,
26 Federal Plaza, New York, NY 10007, (Attention Regulatory Functions Branch),
prior to commencing work authorized herein.
The granting of this permit does not relieve the permittee of the responsib-
ility of obtaining a grant, easement, or other necessary approval from the
Division of Land Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, New York 12242, which may be required for any
encroachment upon State-owned lands under water.
