therein, which the party of the first part has or has power to convey or dispose of,
whether individually,or by virtue of said will of otherwise;

second part,the distributees or successors and assigns of the party of the second part

erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the southwesterly side of a 25 foot private road distant 441.15
feet southeasterly as measured along the southwesterly side of said 25 foot private road from the
corner formed by the intersection of the southwesterly side of private road and the southeasterly
side of North Road; said point being the northeast corner of the premises herein described and
the northeast corner of the premises herein described and the northwest corner of premises now
or formerly of Sennett;
RUNNING THENCE the following two (2) courses and distances along said landnow or
formerly of Sennett;
1. South 41 degrees 12 minutes 30 seconds West 49.77 feet to a point;
2. South 48 degrees 47 minutes 30 seconds East 176.00 feet to Arshamomaque Pond;
THENCE South 49 degrees 30 minutes 30 seconds West (tie line) 50.30 feet along the ordinary
high water mark of 1/22/1990 Arshamomaque Pond to land now or formerly of Mulvaney;
THENCE North 48 degrees 47 minutes 30 seconds West along last mentioned land now or
formerly of Mulvaney 225.89 feet to a point;
THENCE North 41 degrees 12 minutes 30 seconds East 99.54 feet to the southwesterly side of
25 foot private road;
THENCE North 48 degrees 47 minutes 30 seconds East along the southwesterly side of the
private road 57.15 feet to the point or place of BEGINNING.
TOGETHER with a non-exclusive right of way (in common with others over the abutting private
25 foot right of way extending from the southeasterly corner of the premises and running
northwesterly to the North Road.

AND the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid. Subject to the trust fund provisions of section
thirteen of the Lien Law. The word "party" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
