Upon application of LAST ASSOCIATES, Box 796, Cutchogue, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for per- mission to construct one-family dwelling with reduced front and rear yard setbacks upon parcel located on the north side of.Birch Avenue, Southold, NY; County Tax Map Parcel ID No. 1000-77-01-021. The board made the following findings and determination: By this appeal, appellant seeks permission to locate a proposed one-family dwelling on a parcel of land located at the north side of Birch Avenue, Southold, and which is more particularly known as Lots 229 and 230 of Goose Bay Estates Subdivision, Map No. 1176. An area variance is requested to locate the dwelling 35' from Birch Avenue and 33' from the rear property line. The parcel in question fronts along Birch Avenue 50.94 feet and has a depth of 120 feet. The board agrees with the reasoning of applicant in the type of house chosen and the positioning of the house. At the hearing, a neighbor, Mr. George Dalton appeared and informed the board that his water well was situated 32½ feet from the applicant's rear property line and the County Health Department had proposed a change in the location of the applicant's well and cesspool areas, if necessary. Mr. Dalton was also concerned about water runoff onto his property which he feels may affect his water. The applicant assures that the vegetation and trees outside the area of construction will not be disturbed. In considering this appeal, the board determines that the variance request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible for appellant other than a variance; that the relief requested will be in haiTaony with and promote the general p~rposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors, the interest of justice will be served by allowing the variance as indicated below. As a result of a mailing error I did not receive the Notice of the Hearing which I understand was sent out. Additionally, it is my understanding that some of the information submitted to the Board may not be accurate. Specifically, the location of my well point in relation to the location of the proposed dwelling was not properly measured and the effects of the downward slope of the land running from the proposed dwelling to my house have not been considered. Accordingly, I respectfully request that this application be adjourned for one month in order to permit me to have a survey conducted to accurately determine the location of my well point and to determine the effect the proposed dwelling will have on my house because of the slope of the lots. -2- I would also point out that I intend to build a raised deck on my house which may impair the sightlines of the proposed dwelling and I would expect that Last Associates will agree not to object to the building of such a deck and such agreement will include any subsequent owners of the proposed dwelling. At present Birch Avenue is a little used dirt road in poor condition. I would not recommend this access due to the abrupt turn at the intersection, additional necessary grading a~d poor sight distance for exiting traffic caused by the steep descending grade on ~edsr Avenue. I would recommend using Oak Avenue and Hickory Avenue ~hich is presently used for access to Lot 22. Both of these roads in 20 ft. R.O.W.'s are in fairly good condition with wid+~hs of from 12 to 14 ft. ~he surface is a l" *- course cf oil and sand on apparently stable base material. Hickory Avenue has the oil and sand surface only to the N.W. cc~ner of Lot 22. Access to Lot 21 ~uld have to be improved on t~ sides of Lot 22 and continued on Birch Avenue to say the center of the frontage at Lot 21. Recommendations for access using Oak Avenue, Hickory Awnue and the w~sterly section of Birch Avenue: 1. Roadwidth 14 ft. (Necessary clearing has been do=e). 2. Remove topsoil and loam for 12" where necessary (test holes show l2" depth on Birch and 3" on H~ckory). 3. Rep2ace topsoil excavation with bankrun sand ard gravel that contairm some loam. 4. Place a compacted surface course of stone blend or equal 3" in depth° 5. Some miner grading may be necessary to smooth out ~he p~ofile. Emergency vehicles would have to use a driveway at Lot 21 for turning. Road runoff drs&nage will go to Hickory Avenue and d~n to Oak Avenue. I do not believe this additional rcad will cause any drainage problem.
