This Indenture, made the 26th day of April, Two Thousand and
Seventeen,
BETWEEN
PETER C. STERLING and GEORGIENNE J. STERLING, both residing
at 1085 Harbor Lane, Cutchogue, New York 11935, party of -the
first part, and
SHAUN STERLING, residing at 2645 Elijah's Lane, Mattituck,
New York 11952, as Trustee of THE PETER C. STERLING
IRREVOCABLE TRUST dated April 26, 2017 and SHAUN STERLING, as
Trustee of THE GEORGIENNE a. STERLING IRREVOCABLE TRUST dated
April 26, 2017, as to a fifty percent (50%) interest to each

party of the first part by Deed dated _February 20, 1973 and
recorded in the Suffolk County Clerk's Office on February 22,
1973 in Liber 7348 at Page 165, the Grantor being the same
person described as the Grantee in said Deed.
Together with all right, title and interest, if any, of the
party of the first part in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
Together with the appurtenances and all the estate and rights
of the party of the first part in and to said premises;
To have and to hold the premises herein granted unto .the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
And the party of the first part covenants that the party of
the first part has not done 'or suffered anything whereby the
said premises have been encumbered in any way whatever,
except as aforesaid.
And the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and
will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost
of improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the
total of the same for any other purpose. The word "party"

ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being at Cutchogue, in the Town of Southold, County
of Suffolk and State of New York, bounded and described as follows:
BEGINNING at the northwesterly corner of the premises herein to be described,
at a point which is located the following courses and distances from the corner formed by
the intersection of the easterly side of Harbor Lane with the Southerly side of Main Road;
(1) Southerly along said easterly side of Harbor Lane, a distance of 1105.41 feet to a
point; (distant 340.46 feet southerly from a monument at highway deflection, Harbor
Lane); and (2)North 711 50' East a distance of 349.30 feet to the point of beginning, and
from said point of beginning; running thence North 71' 50' 00" East along the southerly
line of land now or formerly of E, Sterling, a distance of 278.2 feet to the ordinary high
water mark of Eugene's Creek; thence Southeasterly along same, on a tie line, bearing
South 22° 47"50" East a distance of 105.92 feet to land now or formerly of W. Sterling;
thence South 67° 46' 00" West along the northerly line of said land a distance of 410.0
feet to land now or formerly of Sterling; thence north 22° 14' 00" West along the
easterly line of said land, a distance of 135.0 feet to the point or place of beginning.
TOGETHER with a Right-of-Way in common with others for access between
Harbor Lane and the premises and for the installation of utility lines and equipment,
bounded and described as follows:
BEGINNING at a point on the easterly side of Harbor Lane, distance southerly
1105.41 feet from its intersection with southerly side Main Road (distant 340.66 feet
southerly from a monument at highway deflection, Harbor Lane;) as measured along said
easterly side of Harbor Lane, and from said point; running then North 71' 50' East, a
distance of 450.09 feet to a point; thence south 22° 14' 00" East, along the Westerly line
of the aforesaid premises, herein before described, a distance of 15.04 feet to a point;
thence South 71° 50' West, a distance of 348.51 feet to the easterly side of Harbor Lane,
thence in a northerly direction, along said easterly side of Harbor Lane, a distance of
30.24 feet to the point or place of beginning.
IT IS further agreed that the party of the Second Part Will bear one-quarter of the
expense of maintaining said Right-of-Way
SUBJECT TO THE FOLLOWING COVENANTS AND RESTRICTIONS:
1. No building other than one private dwelling for the use and occupancy of one family
with attached garage shall be erected on said premises. Plans and Specifications and the
location for said dwelling and any addition thereto, shall be approved by the party of the
first part.
2. No fowl, poultry, animals or livestock shall be kept, on said premises other than two
domestic pets which shall be housed in the residence.
3. No mobile type homes or trailers shall be kept, used, moved or allowed on said
premises regardless of their size with the exception of boat trailers which may be kept in
the rear of the premises.
