WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, situate, lying and being in East Marion, Town of
Southold, County of Suffolk and State of New York, known and designated as Lot I 1 as shown
on a certain map entitled "Map of Soundcrest Woods, Section One," filed in the Office of the
Clerk of the County of Suffolk on June 9, 1969 as File No. 5315, being more particularly
bounded and described as follows:
BEGINNING at a point on the easterly side of Stars Road at the northwesterly corner of Lot 11
as shown on the aforesaid filed map distant 1720.00 feet more or less from the corner of Main
Road (SR 25) and the easterly side of Stars Road;
RUNNING THENCE from said point and place of beginning, North 79 degrees 42 minutes 40
seconds East a distance of 194.02 feet to a point and lands now or formerly of Town of Southold;
THENCE along lands now or formerly of Town of Southold, South 10 degrees 48 minutes 30
seconds East a distance of 103.00 feet to a point and the northerly line of lands now or formerly
of Schroeder;
THENCE along lands now or formerly of Schroeder, South 79 degrees 42 minutes 40 seconds
West a distance of 194.95 feet to a point and the easterly line of Stars Road;
THENCE along the easterly line of Stars Road, North 10 degrees 17 minutes 20 seconds West a
distance of 103.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated October 18, 2001 and recorded November 3, 2001 in the Office of the Suffolk County
Clerk in Liber 12151, Page 288.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
