Southold Town Board of Appeals MAIN I~OAD- STATE RnAD 2=, SOUTHOLD, L.I., N.Y. 119'71 TELEPHONE (516) 765-1809 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. 3134 Application Dated May 18, TO: Mr. Hans H. Rieger 370 Harbor Road Orient, NY 11957 1983 (Public Hearing held 6/23/83) [Appellant(s)] At a Meeting of the Zoning Board of Appeals held on July 8, 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section IX] Request for Variance to the Zoning Ordinance Article III , Section 100-32 [ ] Request for The public hearing on this matter was held on June 23, 1983. Upon application of HANS H. RIEGER, 370 Harbor Road, Orient, NY for a Variance to the Zoning Ordinance, Article III, Section 100-32 for permission to construct accessory garage in the frontyard area at 370 Harbor Road, Orient, NY; County Tax Map Parcel No. 1000-027-04-006. The board made the following findings and determination: By this appeal, appellant seeks a variance to Article III, Section 100-32 of the Zoning Code which requires all accessory buildings to be located in~'the rearyard area. Appellant proposes to locate an accessory garage building, 20' by 22', approximately 13 feet from the northeast property line along Har~br Road and a minimum of three feet from the westerly property line. The garage is proposed to be set back from the existing one-family dwelling structure 30 feet. The premises in question contains an area of approximately 14,700 square feet, with frontage along Harbor Road of 68 feet and along Orient Bay 79.29 feet (at a tie line). The premises is improved with a one-family, two-story house which is centered upon the lot with side yards of 12 feet on each side. In viewing the neighborhood of the subject parcel, the board finds most of the parcels to be improved without accessory structures in the front yards. The board does, however, recognize the applicant's limited building area and do agree that the most practical area to build the proposed garage would be in front of the existing dwelling. It is the board's opinion that the garage can be constructed at a point approximately 10 feet from the dwelling rather than 30, and that the set back from Harbor Road can and should be no closer than 33 feet. In considering this appeal, the board determines that: (1) the variance is'not substantial; (2) the circumstances herein are unique and the practical difficulties have been shown; (3) by allowing the variance, no substantial detriment to adjoining properties would be created; (4) the difficulty cannot be obviated by a method feasible to appellants other than a variance; (5) no adverse effects will be produced on available governmental facilities of any increased popu- lation; (6) the relief will be in harmony with and promote the general purposes of zoning; and (7) the interests of justice will (CONTINUED ON PAGE TWO) DATED: July 13, 1983. Zoning ~ariance Article 111 Section 100-32. Your primar}~ condition however creates a tremendous difficulty to implement the proposal, since a ~etb cm of 33 feet from the property line would brin{~ the structure within 2 feet of the house. ! failed to outline the overall dimension of the garage and did not bring to your attention that there is a {}'-o" overhany in the back of the ~arage. 5he purpose of this space is to store firewood and a two foot canopy over the entrance to provide protection from the rain. ~e ~0 · ~h.e close proximity of ~ pro~, ,=~ structure to the existing house will not be in hmrmcny with the surroundings and in my opinion will not Dromote the Feneral purpose of a pleasant archztec~ur~l settin?l with the {iven environment. The closeness of the garage, a structure not very compatible with the residencial bufldfn{~] will be in sharp contrast, partfcularly since the residence is of synmetric desi~sn layed-out in the eenter of the lot. ~ecause of the exisZfn~] driveway of course the most logical and economically feasible location is in the proposed area but requires a proper distance from %he house, gPhe proposed !3 feet would have been ideal.
