Upon application of PATNICK REALTY CORP., by Gary Flanner Olsen, Esq., Main Road, Box 38, Mattituck, NY for a Variance to the Zoning Ordinance, Article VI, Section 100-60 permitting two residential dwellings in this B-Zoned District. Location of Property: 69430 Main Road, Greenport, NY; County Tax Map Parcel No. 1000-45-04-001. The board made the following findings and determination: By this appeal, appellant seeks to obtain a Certificate of Occupancy for a single-family residence (converted~ frgm a garage) which has appar- ently been used as such since 1968. The~principal building is a noncon- forming one-family residence preexisting the adoption of the zoning ordi- nance in 1957 and has continuously been used as a one-family residence. The premises in question is located at the south side of Main Road, Greenport with a road frontage of 300 feet and contains an acreage of 2.036. The premises is zoned "B-Light Business." In researching town records concerning this property, it appears Building Permit #11444Z and Certificate of Occupancy #Z10894 were issued on November 2, 1981 and February 26, 1982, respectfully, for "...a laundry room addition to existing dwelling." In considering this appeal, the board determines that under the circumstances, the use applied for will not alter the essential char- acter of the neighborhood; that the ~e will not prevent~the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; that the use will not prevent the orderly and reasonable use of permitted or legally established uses in the district wherein the proposed use is to be located, or of permitted or legally estab- lished uses in adjacent-use districts; that the safety, health, wel- fare, comfort and conveience and order of the town will not be adversely affected by the proposed use and its location; and that the interests of justice will be served by allowing the variance, as noted below. ( ) (X) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that applicant seeks to obtain a Certificate of Occupancy for a single family residence for a former garage, which has been converted into a residence, as shown on the survey annexed hereto, and made a part of this application. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicant, about 1968, converted a garage into a single family residence. Also located on the subject premises is the main dwelling, which pre- exited zoning, and now is a non-conforming residential building in a "B" Zone. Both the ma'~ln bt~ding and the converted garage have been utilized for single family residence purposes for many years. The total acreage exceeds two acres, and there is public water and each building has its own sanitary facilities. On October 19, 1981, an application was made to construct a pantry-closet-laundry room on the building which was formerly a garage, and in the application of paragraph 2(a), the existing use and occupancy was listed as "living area". A Building Permit was issued by the Southold Town Building Department, #114442, on November 2, 1981 "to con- struct laundry room addition to exising dwelling" and, accordingly, the Town of Southold has been aware that the said building has been used for residential purposes. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinity of this property and in this use district because both buildings, as shown on tbe surv'py of Roderiek Van Tuyl, dated October 3 l, 1973, have been utilized for residential pur- poses for many years and there is more than 80,000 square feet of land. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the two residences have been on the subject premises for many years and the granting of the variance would not change the character of the neighborhood.
