Upon application of CUTCHOGUE FREE LIBRARY, Box 935, Cutchogue,_~Y for a Variance to the Zoning Ordinance, Article VII, Section 100-71, Bulk Schedule, for permlssion to construct addition with insufficient and sideyard setbacks, and small addition reducing the frontyard setback, at premises known as 28735 Main Road, Cutchogue, NY; County Tax Map Parcel No. [1000-102-05-22 and part of 23. The board made the following findings and determination: This is an application for a variance to ArtiCle VII, Section 100-71 and Bulk Schedule of the Zoning Code of the Town of Southold for permission to construct proposed additions at the rear, fiont &nd e~terIy'~ide of the existin~ brick, one-story structure for library use. The parcel in question is located in the "B-1 General Business" District and contains an area as exists of approximately 5,000 square feet, with 50' frontage along the north side of the Main Road (S.R. 25) and has an existing open sideyard area on the east of approximately 7.8 feet and on the west 4.7 feet, along a concrete sidewalk. The easterly side of the subject premises is used for access to the rear blacktop parking area for both the subject parcel and the parcel adjoining same on the east, which is improved with a one-stor~ frame building, set back approximately 19 feet from the present westerly side line, inclusive of the ll-foot wide blacktop driveway area and eight-foot sideyard area open between the driveway and the "Lhrk" building (on'the east). Applicant has simultaneously with this application filed an application for a Special Exception for permission to use the subject additions for library use, as conditionally permitted pur- suant to the requirements of Article VII, Section 100-70(B) [1] (a) of the Zoning Code. The reductions proposed by this application ara as follows: (a) 1.8' along the east side; (b) 15.3' from the front property line at its nearest point; (c) the addition on the prsmises as exists encroaches onto premises of Richard F. Lark, Esq. [the pending subdivision application ~as not been finalized]. The DATED: November 4, 1983. CHAIRMAN, SOUTHOLD D OF APPEALS Form ZB4 (rev. 12/81) P~ge 2 of 2 - Appeal No. 3110 Matter of CUTCHOGUE FREE LIBRARY Decision Rendered October 27, 1983 reduction along the east side would be for the purpose of a Main Side Entrance with a concrete walk and vestibule, with guardrail, fencing or other physical barrier separating the pedestrian area from the vehicles passing through the adjoining driveway. At the rear of the building is proposed a 47' by 42.5' wide addition (see Site Plan of June 8, 1983). On September 16, 1983 applicant filed an application to the Southold Town Planning Board for consideration of a two-lot division, Which would increase the size of the library parcel from 5,000 to approximately 15,117 square feet, and decrease the size of the adjoln!ng parcel on the east, presently owned by Richard F. Lark, Esq., from approximately 36,430 to 26,309 square feet. The subdivision as proposed would deepen the library parcel from 100 to 300.37 feet; however, the width would be unchanged except for the triangular-driveway easement of 345 sq. ft. at the southeasterly side. To date, an area variance pertaining to the lot area in this proposed division has not been filed. The status of the subdivision application of the library and Mr. Lark before the Planning Board as of this date, to the best of our understand- !ng, is that same is being held in abeyance pending Zoning Board of Appeals' decisions on the within variance and Special Exception applications for the proposed additions. Pursuant to Sections 1323, et seq. of the Suffolk County Charter, this matter was referred to the Suffolk County Planning Commission, which recommended that "the west side of the build- ing should be considered for library access with an unimpeded two (2)-tane driveway to the rearyard parking area .... " It is the opinion of this board that the relief requested be denied without prejudice f6r several reasons. The proposed Main ~easterly" Side Entrance along the one-lane driveway utilized by the two abutting businesses in this commercial district may endanger public safety; that is, individuals in passing from the parking area to the front areas of any of the businesses in this district, whether it be the library, or the abutting businesses, or the Fruit Farm across the highway, may perhaps decide not to go through the covered entrance of the library, thereby using the one-lane driveway area most easily accessible. The board upon personally visiting the site did find upon entering the driveway a "blind spot" in the driveway area when proceeding to the rear of the building. Also, for the record it is noted that these premises are located within 500 feet of a public school, playground, and busy commercial district. Also, in considering this appeal, the board determines: (1) that the practical difficulties or hardship are not sufficient to warrant the granting of this application "as applied"; (2) that the variance request is substantial in relation to the require- ments of the zoning code [which requires 100' setback for build- ings used as a library]; (3) that the circumstances are not unique; (4) that the relief requested will not be in harmony with and promote the general purposes of zoning 6f the protection and promotion of the public' health, safety and welfare; (5) that the interests of justice would be served by denying the application "as applied", with the recommendation that the library consider an alternative Main Entrance, perhaps at the westerly side. Now, therefore, on motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that Appeal No. 3110, the application of the CUTCHOGUE FREE LIBRARY for a Variance, be ~d hereby is DENIED WITHOUT PREJUDICE. Article VII, Section 100-70(B) [1] (b) and Article III, Section 100-30(B) [4] of the Zoning Code permits a library as noted by the attached conditions (a) through (f) [from page 10021 of the Zoning Code], by Special Exception from the Zoning Board of Appeals and subject to site plan approval from the Planning Board. If the parcel in question is proposed to be subdivided with a minimum of 30,000 sq. ft. in area and 150 feet of road frontage, then subdivision or set-off approval is required by the Planning Board. Mr. Fred Bentel (in summary The reduction in setback is required to provide for a coversd walkway lea~ng library patrons from the street and from th~ rear parking area to the library entrance. Library design dictates that tJere be a single control area in the library from w~ich all public areas of the library and the entrance-exit are visible. The control area and the entrance- exit should be in close proximity. Since ~atrons will be - 2 - arriving from each snd of the building, an entrance in the center is the most convenient with regard to both patrons and the control area. In order to keep patrons from using the com~on driveway, a covered walkway is provided. The alternative of having an uncovered walkway with a roof only over t~e entrance was considered. Keeping this roof to less than 30 sq. ft. conforms to code requirements and would require no variance. This was, however, rsjected on the basis that vehicular traffic and pedestrian traffic m~ght become inter- mingled if there were a less definitive demarcation than that provided by a covered walkway running the entire length of the building. Further, the library would no longer have the appearance of having a front e~tra~ce on the street. A second alternative, that of having the entrance and the walkway on the west side of the building was also considered but rejected on the basis of inconvenisnce to the parking area, the lack of adequate sideyard (4.7 ft.) and the fact that the heating plant, the bathroom and storage areas are located on that side of the building along with the utility entrance. Resolution - Mr. Lark understands the purpose of the set- back reduction. In order to fu~ther separate vehicular and pedestrian traffic Mr. Lark suggested that a barrier of some sort be installed along the covered walkway. The library agrees to incorporate a railing as part of the covered walkway to ~- hibit entrance to the l~brary except by first entering the covered walkway from either the street or the parking lot. 3. Goehringer, Chairman RE: Cutchogue Free Library Appeal Nos. 3109, 3110, 3111, 3112 Dear Mr. Goehringer: I am in receipt of a Notice to Adjoining Property Owner concerning the Cutchogue Free Library's Petitions for the above-captioned variances and special exceptions. As you are aware from your inspection of the property, I own the parcel of land on the northeasterly and northwesterly boundaries of the applicant's property (formerly the Southold Town Justice Court Building). Since the petitions to the Zoning Board of Appeals are a little ambiguous and confusing, I thought at the outset it would be best to give some back- ground to the Board. The Cutchogue Free Library has an option to purchase a seven foot triangular shaped strip on Main Road and a 10,117 square foot rectangular shaped parcel on the northwesterly boundary of their property from me. On the exercise of the Option, I will have a joint driveway agreement with the Library for access to the rear as well as granting them as easement to utilize my parking area in the rear of the Dremises. The purpose of granting the option to the Library was t~ allow them sufficient land to expand the building to provide a library facility for the community. I am attaching herewith a map of the property showing their proposed acquisition from me outlined in red. I have no objection to the Cutchogue Free Library's request for the use of their building as a library (Appeal Nos. 3109 and 3111). This was the very purpose for which the property was purchased. I also have no objection to the Library's re- quest concerning parking for library purposes (Appeal No. 3112). The Board is aware the large parking lot in the rear of my premises was previously leased to the Town of Southold Southold Town Board of Appeals ATT: Gerard P. The point being is if it was large enough for the Town of Southold to be used for Justice Court, I think it is large enough for use by the library patrons. However, Appeal No. 3310, the request for variances for yard setbacks presents a different problem. Nothing can be done with the existing yard setbacks as the building presently exists on the property. However, the Board should not allow any future reductions of the existing front yard setback of 19.6 feet as it will not be in keeping with the character of this neighborhood and is already substantially below the present zoning requirements. I strongly object to the Library's request for a reduction of their easterly side yard requirement. Originally when I agreed to sell the property to the Library, their entrance was either going to be on the southerly side of the building fronting on Main Road at the existing entrance or on the northerly side of their building adjacent to the parking lot. Their current site plan provides for the main entrance to be on the easterly side of their building. In order to do this, they have provided a "covered walk" and will need additional property from me for the driveway. I have advised them I will not sell them any more land nor will I allow them to widen the driveway in an easterly direction on my property. My reasons are simple. I want to maintain a 15 foot side yard from the westerly side of my building; and their plan for a front entrance fronting on the driveway in my opinion is poor planning. They claim it might be a more efficient use of their building to have the entrance at this location; however, it will be a hazard since library patrons will have to walk from the Main Road or the parking lot to gain access to the building, and will, no doubt, use the driveway for pedestrian use in spite of the provisions for the "covered walk". Since the "covered walk" will be an addition to the building, it will require a further reduction of the side yard. The applicant Library, has not shown any practical difficulties for the granting of this side yard variance in that the entrance containing the vestibule can be placed either on the northerly or southerly portion of their building. Since I will not grant them the use of any more of my property, the Library would be well advised to plan for the new addition and entrance elsewhere especially keeping in mind Southold Town Board of Appeals ATT: Gerard P. In effect, the parking facilities will not be upon the premises of the library. Section 100-112H (off-street parking) provides that the parking facilities may be on other property provided that the parking spaces are within 200 feet walkln~ distance from the lot to be served. This section further pro- vides that such spaces shall be in the same ownership as the use for which they are accessory. In effect, what this means is that the parking lot need not be on the same lot as the principal use but it must be in the same owner- ship. Section 100-121B provides that the Board of Appeals shall have the power to vary or modify the application of any regulation where there are practical difficulties or unnecessary hardship in carrying out the strict letter of the regulations. In effect, this means that the Board of Appeals has the power to grant a variance. Therefore, it is my opinion that the Planning Board could entertain the application of the library for the parkin~ field adjacent to its property but Mr. Henry E.
