The public hearing on-this application was'held on August 31, 1983,
at which time the hearing was declared closed pending d~liberations.
Upon application Of CUTCHOGUE FREE LIBRARY, Box 9~35, Cutchogue,
NY for a Special Exception to the Zoning Ordinance, Article VII, Sec--
tion 100-70(B) [1] (a) for permission to use proposed addition for
library use at premises known as 28735 Main Road, Cutchogue, NY;
County Tax Map Parcel No. 1000-102-05-22 and part of 23.
The board made the following findings and determination:
This is an application for a Special Exception pursuant to
Article VII, Section 100-70(B)[11 (a) of the Zoning Codei of the Town
of Southold to establish library use of proposed additions at the
rear and easterly side of the existing brick, one-story s~ruc~ure.
Libraries are conditionally permitted by Special Exception approval
in the following zoning districts: "A~Residential and Agricultural,"
"M-Light Multiple-Residehce," "M-1 General Multipte-R~s. idence,"
"B-Light B~siness," "B-1~ General Business," "C-Light I~dustrial"
and C-1 General Industrial." The parcels in question ~are located
· n the "B-1 General Business" District.
The premises as exists contains an area of approximately
5,000 square feet, 50' frontage along the North Side o~ Main
(S.R. 25) Road and has an existing open sideyard area ~n the
east of ~pproximately 7.8 feet and o~ the west 4.7 fee~, along
a concrete sidewalk. The easterly side of the subject premises
is used for access to the rear blacktop parking area f~r both
the subject parcel and the parcel adjoining same on th~ east
(now of R. Lark), which is improved with a one-story frame
building which is set back approximately 19' from the
present westerly side line, inclusive of the ll-foot wide black-
top driveway area and eight-foot sideyard area open between the
driveway and the "Lark" building.
Applicant has simultaneously with this application filed
an application for a variance for permission to constrUct the
above-noted additions with reductions in side and fron~ yard
setbacks, respectively 1.8' and 15.3' The reduction along the
east side would be for the purpose of a Main Side Entrance with

a covered walk and vestibule, with guardrail, fencing or other
physical barrier separating the pedestrian area from the vehicles
passing through the adjoining driveway. At the rear of the
existing library building is proposed a 47' by 42.5' wide addi-
tion, which encroaches over the rear property line of this par-
cel as exists at the present time, (see Site Plan of June 8, 1983).
On September 16, 1983 applicant filed an application to
the Southold Town Planning Board for consideration of a two-lot
division, which would increase the size of the library parcel
from 5,000 to approximately 15,117 square feet, and decrease
the size of the adjoining parcel on the east, presently owned by
Richard F. Lark, Esq., from approximately 36,430 to 26,309 square
feet. The subdivision as proposed would deepen the library parcel
from 100 to 300.37 feet; however, the width would be unchanged
except for the triangular-driveway easement of 345 sq. ft. at the
southeasterly side. To date, an area variance pertaining to the
lot area in this proposed division has not been filed. The status
of tbs subdivision application of the library and Mr. Lark before
the Planning Board as of this date, to the best of our understand-
ing~ is that same is being held in abeyance pending Zoning Board
of Appeals' decisions on the within Special Exception and variance
for the proposed additions.
Pursuant to Sections 1323, et seq. of the Suffolk County
Charter, this matter was referred to the Suffolk County Planning
Commission, which recommended that "the west side of the build-
ing should be considered for library access with an unimpeded
two (2)-lane driveway to the rearyard parking area .... "
It is the opinion of this board that the use as may be
conditionally permitted by Special Exception pursuant to the
zoning code should be denied without prejudice pending a deter-
mination on any and all pending or proposed variance applications
directly related to this application, since allowing this Special
Exception as applied would not be in compliance with the standards
provided in the zoning ordinance, which is necessary in view of
this application.
It is also the opinion of this board that the special
exception permit be denied without prejudice since the proposed
Main Side Entrance along the one-lane driveway (for two established
businesses) in this ~om~ercial district may endanger public safety;
that is, individuals in passing from the parking area to the front
areas of any of the businesses in this district, whether it be the
library, or the adjomning premises, or the Fruit Farm across the
highway, may perhaps decide not to go through the covered entrance
of the library, thereby using the one-lane driveway area. The
board upon personally visiting the site did find upon entering the
driveway a "blind spot" in the driveway area when proceeding to
the rear of the building. Also, for the record it is noted that
these premises are located within 500 feet of a public school,
playground, and busy commercial district.-~
In passing on this application, the board has considered
items (a) through (1) of Article XII, Section 100-121(C) [2] of
the Zoning Code. "'
Now, therefore, on motion by Mr. Grigonis, seconded by Mr.
Goehringer, it was
RESOLVED, that Appeal No. 3109, the application of the
CUTCHOGUE FREE LIBRARY for a Special Exception, be and hereby
iS DENIED WITHOUT PREJUDICE.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Grigonis,
Douglass and Sawicki. This resolution was unanimously adopted.

-Dear Mr. Peters:
This morning our office received a brief note con-
cerning a proposal of the library to locate in Cutchogue
on a particular site located along North Street presently
containing 2.3035 acres and located in the B-1 General
Business District.
Article VII, Section 100-70(B) [1] (b) and Article III,
Section 100-30(B) [4] of the Zoning Code permits a library
as noted by the attached conditions (a) through (f) [from
page 10021 of the Zoning Code], by Special Exception from
the Zoning Board of Appeals and subject to site plan
approval from the Planning Board.
If the parcel in question is proposed to be subdivided
with a minimum of 30,000 sq. ft. in area and 150 feet of
road frontage, then subdivision or set-off approval is
required by the Planning Board.
We are enclosing a set of forms for a Special Excep-
tion and ask that if you plan to proceed as above noted,
please submit your plans to the Building Inspector for
verification of the above set of procedures and any other
requirement that ~ay be needed under the Building or
other c6des which the Zoning Board does not have authority.

centrally located in Cutchogue for the location of the new
Cutchogue~iew Suffolk Free Library. In order to meet the Code
Of The Town of $outhold, approximately one acre of land
i~ required. Attached is a survey o£ a plot under consideration.
C n this plot be subdivided into two equal pzrcels of greater than
o~e acre each? If so, in your opinion, can ~ library be located

Gentlemen:
Subject premises is located in the B-1 Light

The lot is existing and is nob-conforming in area and
width. The existing building does not meet code requirements
for front, side and rear yard setbacks, Art. VII, Sec. 100-71,
Bulk Schedule.
The proposed addition will reduce front yard and side
yard setbacks further than now exists with the covered.walk
and vestibule as shown.
Board of Appeals action No. 3111, dated July 8, 1983
approved the use of this premises under the Special Exception
requirement. The conditions under this appeal did not allow
any further side yard reductions and that entrance/exit
shall not be located on the east side of the existing building.
Off-street parking requirements are to be determined by
the Flanning Board per Art. XI, Sec. 100-112 and shall com-
ply to sub-sections B, C, D, E, and H. Under sub-section H
of this section the Board of Appeals granted a variance under
Appeal No. 3112, dated July 8, 1983 to permit accessory off-
street parking on lots "23A" & "23B" as shown on the site
plan dated June 8, 1983, to increase area for library use.
This certification is made in accordance with Art. xIII,
Sec. 100-113 c relative to zoning regulations.

arriving frown each end of the building, an entrance in the
center is the most convenient with regard to both patrons and
the control area. In order to keep patrons from using the
common driveway, a covered walkway is provided.
The alternative of having an ~ncovered walkway with a
roof only over tee entrance was considered. Keeping this roof
to less than 30 sq. ft. conforms to code r~}quirements and would
require no variance. This was, howew~r, r~jectsd on the basis
that vehicular traffic and medestrian traffic might becom~ inter-
mingled if there were a less definitive demarcation than that
provided by a covered walkway running the entir~ length of th~
building. Further, the library weuld no longer have the
appearance of having a front entrance on the street.
A second alternative, that of having the emtrance and the
walkway on the west side of the building was also considered
but rejected on the basis of inconveni~nce to th~ parking area,
the lack of o. dequate sid~yard (~.7 ft.) and th~ fact that the
heating ~lant, the b~throom and storage areas are !oc~ted on
that side of th~ building along with the utility entrsnce.
Resolution - ~[r. Lark understands the purpose of tbs set-
back r~duction. In order to fu .ther separate vehicular and
pedestrian traffic ~r. Lark sug~gested that a barrier of scme
sort be installed along the cow~red walkway. The library agrees
to incorporate a railing as part of the cove~ed walkway to '~o-
hibit entrance to the library except by first entering the
covered walkway from either the street or tbs parking lot.

This revision provides the £ollowing added inflormation: new -

a meeting held between i.lr. Lark and Cutchogue Library representatives

Dear Mr. Goehringer:
I am in receipt of a Notice to Adjoining Property Owner
concerning the Cutchogue Free Library's Petitions for the
above-captioned variances and special exceptions.
As you are aware from your inspection of the property, I
own the parcel of land on the northeasterly and northwesterly
boundaries of the applicant's property (formerly the Southold
Town Justice Court Building). Since the petitions to the
Zoning Board of Appeals are a little ambiguous and confusing,
I thought at the outset it would be best to give some back-
ground to the Board.
The Cutchogue Free Library has an option to purchase a
seven foot triangular shaped strip on Main Road and a 10,117
square foot rectangular shaped parcel on the northwesterly
boundary of their property from me. On the exercise of the
Option, I will have a joint driveway agreement with the
Library for access to the rear as well as granting them as
easement to utilize my parking area in the rear of the premises.
The purpose of granting the option to the Library was to allow
them sufficient land to expand the building to provide a
library facility for the community. I am attaching herewith
a map of the property showing their proposed acquisition from
me outlined in red.
I have no objection to the Cutchogue Free Library's request
for the use of their building as a library (Appeal Nos. 3109
and 3111). This was the very purpose for which the property
was purchased. I also have no objection to the Library's re-
quest concerning parking for library purposes (Appeal No.
3112). The Board is aware the large parking lot in the rear
of my premises was previously leased to the Town of Southold

for Justice Court parking purposes. The point being is if
was large enough for the Town of Southold to be used for
Justice Court, I think it is large enough for use by the
library patrons.

However, Appeal No. 3310, the request for variances for
yard setbacks presents a different problem. Nothing can be
done with the existing yard setbacks as the building presently
exists on the property. However, the Board should not allow
any future reductions of the existing front yard setback of
19.6 feet as it will not be in keeping with the character of
this neighborhood and is already substantially below the
present zoning requirements.
I strongly object to the Library's request for a reduction
of their easterly side yard requirement. Originally when I
agreed to sell the property to the Library, their entrance was
either going to be on the southerly side of the building
fronting on Main Road at the existing entrance or on the
northerly side of their building adjacent to the parking lot.
Their current site plan provides for the main entrance to be
on the easterly side of their building. In order to do this,
they have provided a "covered walk" and will need additional
property from me for the driveway. I have advised them I will
not sell them any more land nor will I allow them to widen the
driveway in an easterly direction on my property. My reasons
are simple. I want to maintain a 15 foot side yard from the
westerly side of my building; and their plan for a front entrance
fronting on the driveway in my opinion is poor planning. They
claim it might be a more efficient use of their building to
have the entrance at this location; however, it will be a
hazard since library patrons will have to walk from the Main
Road or the parking lot to gain access to the building, and
will, no doubt, use the driveway for pedestrian use in spite of
the provisions for the "covered walk". Since the "covered walk"
will be an addition to the building, it will require a further
reduction of the side yard. The applicant Library, has not
shown any practical difficulties for the granting of this side
yard variance in that the entrance containing the vestibule can
be placed either on the northerly or southerly portion of their
building. Since I will not grant them the use of any more of
my property, the Library would be well advised to plan for the
new addition and entrance elsewhere especially keeping in mind

the barrier Law (Public Building Law §51) concerning appropri-
ate entrances for the use by the handicapped.
Therefore, I respectfully request the Southold Town Board
of Appeals deny the Cutchogue Free Library's request for
reduced front and side yards.

Thank you for your letter of May 2, 1983. We are in
receipt of what I presume is a second site plan submission
for the Cutchogue Library. However, there is no covering
letter indicating, number one, the fact that any lease agree-
ment that may be pending is actually in effect; number two,
on your page one of your submission I can find no ingress or
egress on your property for parking; number three, Mr. Lark
has indicated your last set of working plans are not accept-
able to him; number four, I would draw your attention to the
Town Attorney's final paragraph in letter dated January 20,
1983 that the Planning Board could entertain a parking field"
adjacent to your property, but it would be conditional upon
obtaining a variance from the Board of Appeals of the require-
ment that the parking field be in the same ownership as the
premises which it serves. As it appears from your last set
of drawings that this may be the case and no structural alter-
ations would be done to the building.
We would be most happy to handle this as rapidly as pos-
sible, certainly pertaining to your letter of funding.

Dear Henry:
You recently sent me correspondence between the Board and the Cutchogue
Library, along with your letter of January 5, 1983, and asked for my
opinion as to whether or not the Planning Board may permit off-street
parking facilities on property not owned by the applicant but under a lease
from an adjoining owner. In effect, the parking facilities will not be upon
the premises of the library.
Section 100-112H (off- street parking) provides that the parking facilities
may be on other property provided that the parking spaces are within 200
feet walking distance from the lot to be served. This section further pro-
vides that such spaces shall be in the same ownership as the use for which
they are accessory. In effect, what this means is that the parking lot need
not be on the same lot as the principal use but it must be in the same owner-
ship.
Section 100-12lB provides that the Board of Appeals shall have the power
to vary or modify the application of any regulation where there are practical
difficulties or unnecessary hardship in carrying out the strict letter of the
regulations. In effect, this means that the Board of Appeals has the power
to grant a variance.
Therefore, it is my opinion that the Planning Board could entertain the
application of the library for the parkin~ field adjacent to its property but

not owned by it provided that, in the event it should approve of such off-street
parking, the approval should be conditioned upon the applicant obtainin~ a
variance from the Board of Appeals of the requirement that the parkin~ field

As a result of the enactment of HR 1718, the Emergency Jobs WilliamPat~
Bill, by the U. S. Congress and President Reagan, $50,000,000 has been
appropriated for the renovation and construction of public libraries.
Grant applications are required within 60-90 days to generate employment
quickly. In order to qualify, firm plans must be underway, and matching
funds must be available. We are in a unique position to capitalize on
this for the following reasons:
a) We have preliminary working drawings which require only
minor revision and go-ahead authorization.
b) We are presently in a general fund raising and have
received in excess of $30,000 to date.
c) We have assurance from the North Fork Bank md Trust
Company that mortgage money will be available to us.
d) Our architect indicates that if we can give him design
approval by mid-May, he can have bid packages available
for local contractors by mid-August.
We have pending before the Planning Board a Site Development Plan, and
before the Board of Appeals requests for variances and special exception.
We are requesting prompt consideration to enable us to capitalize on the
