Box 1179 Southold, NY 11971-0959 Re: Boyle Property > 4g35 -2448&Main Road Orient, NY Dear Mr. Verity: A visit was made to the above referenced property to review the construction of the pole building at the above referenced site. I inspected the footings at the facility were found to be installed to the depth and sizes in accordance with the plans by James A. Koppenhaver, PE dated August 29, 2016. The framing was found to be installed in accordance with the plans by James A. Koppenhaver, PE dated August 29, 2016. The trusses are connected to the structure with tie blocks as per the plans and were found to be acceptable. The steel W beam that is installed at the rear of the structure which is supported by steels columns was found to be acceptable. To the best of my knowledge, the building was constructed in accordance with the proposed plans and in accordance with the current Building Code of New York State. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 5, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 22.4453 Acre parcel located in the R- 80 Zoning District. It fronts NYS Route 25 for 260.07 feet on the southerly property line and the,northerly property line measures 610.93 feet, but the surveyor has indicated that the deeded measurement is 611.49 feet. The combined lot lines to the west measure 1,685.31 feet and the easterly property line measures 1,596.91 feet. The survey notes that these measurements are the actual numbers and vary as compared with the deed. The adjoining parcel to the west (SCTM# 1000-18-02-33) has 7.8814 Acres and is also owned and used by the applicant. The subject parcel is improved with a one (1) Story Frame and Stucco House, two Frame Barns, a Frame Garage, three Metal Barns, a Metal Building and the subject "as built" Metal Barn as shown on the survey prepared by John T. Metzger, L.S. dated December 11,2013 and last revised November 5, 2014(Barn Location). BASIS OF APPLICATION: Request for Variance(s)from Article IV, Section 280-15 and the Building Inspector's August 8, 2016, Notice of Disapproval based on an application for a building permit to legalize an "as built" farm accessory barn, at; 1) at more than the maximum height of 22 feet, located at: 24435 Route 25 (Main Road), Orient, NY. RELIEF REQUESTED: The applicant requests a variance for an as-built metal barn having a height of+/- 27 feet where the code permits a maximum height of 22 feet, as shown on the architectural drawing, Sheet A-2, prepared by James A. Koppenhaver,P.E., dated August 29, 2016. n � ,w �Y Mage 2, becember 15, 2016 #7005, Boyle SCTIVI No. 1000-18-2-34 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1,2016, at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.Metal Barns are characteristic of agricultural/farm'properties and the subject barn is located on an s 30+ acre agricultural site and is set back from Main Road approximately 1,000 feet and cannot be seen from the street. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject metal barn is as-built with a non-conforming height which requires a variance to be legalized. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 23%relief from the code. However, there exists another metal barn on this parcel approximately 75 feet from the subject as- built metal barn having the same style,width and similar length and appears to have the same height.Furthermore, the subject "as-built" metal barn is approximately 1,000 feet from NYS Route 25, and is centrally located on this 30 Acre site which mitigates any detriment to adjoining parcels., 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a legalizing an as-built Metal Barn, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the Survey prepared by John T. Metzger, L.S., dated December 11, 2013 and last revised November 5, 2014 (Barn Location) and the architectural drawing, Sheet A-2, prepared by James A.Koppenhaver,P.E., dated August 29, 2016. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms.
